Chapter I General Provisions Article 1 These Provisions are formulated for the purpose of establishing an educational supervision system and strengthening administrative supervision over educational work. Article 2 The task of educational supervision is to supervise, inspect, evaluate and guide the educational work of the people's governments at lower levels, the educational administrative departments at lower levels and schools, to ensure the implementation of national educational guidelines, policies and regulations, and to achieve educational goals. Article 3 At present, the scope of educational supervision mainly includes primary and secondary education, preschool education and related work.

Institutions exercising the functions and powers of educational supervision may, upon the entrustment of the people's government at the same level or the administrative department of education at the same level, supervise the educational work other than those specified in the preceding paragraph. Chapter II Institutions Article 4 According to the relevant regulations of the State Council, the State Education Commission shall exercise the functions and powers of educational supervision and be responsible for the management of educational supervision throughout the country. Its main responsibilities are:

(a) to formulate the principles, policies and rules and regulations of educational supervision;

(two) to formulate educational supervision plans and guidance programs;

(3) Organizing the implementation of national education supervision;

(four) to guide the local education supervision work;

(5) Organizing supervisor training;

(six) summarize and popularize the experience of educational supervision, and organize educational supervision and scientific research. Article 5 The State Education Commission shall set up educational supervision institutions to be responsible for the specific work of educational supervision. Article 6 Local educational supervision institutions shall be established at or above the county level.

The organizational forms and institutional responsibilities of educational supervision at or above the county level shall be determined by the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government. Seventh local people's governments at or above the county level shall determine the establishment of educational supervision institutions according to the scale of educational undertakings and other actual conditions within their respective administrative areas. Chapter III Inspectors Article 8 Institutions exercising the functions and powers of educational supervision shall be equipped with corresponding full-time inspectors, and their appointment and removal shall be handled in accordance with the personnel management authority and procedures of the relevant state administrative organs. Ninth institutions exercising the authority of education supervision may employ part-time inspectors according to the needs of their work.

Part-time inspectors have the same powers as full-time inspectors. Tenth inspectors by the people's government at the same level or the administrative department of education issued a certificate of inspector. Eleventh special inspector must meet the following basic conditions:

(a) adhere to the four cardinal principles, adhere to the reform and opening up, loyal to the cause of socialist education;

(two) familiar with the national education guidelines, policies and regulations, with a high level of policy;

(three) with a bachelor's degree or equivalent, more than ten years of experience in education, familiar with the education and teaching business;

(four) go deep into reality, contact with the masses, abide by the law, act fairly, and dare to tell the truth;

(5) good health. Article 12 Inspectors shall receive necessary training. Chapter IV Supervision Article 13 Educational supervision is divided into comprehensive supervision, special supervision and regular inspection, which shall be organized and implemented by educational supervision institutions according to the decisions of people's governments at the corresponding levels, educational administrative departments or higher supervision institutions. Fourteenth supervision institutions or inspectors shall supervise according to the relevant national guidelines, policies and regulations, and have the following functions and powers;

(a) to participate in the relevant meetings of the supervised units;

(two) to require the supervised units to provide documents related to the supervision matters and report their work;

(three) on-site investigation of the supervised units. Fifteenth in violation of the principles, policies and regulations, supervision institutions or inspectors have the right to stop. Sixteenth supervision institutions or supervisors shall, after completing the supervision task, inform the supervised units of the supervision results and put forward opinions and suggestions. Seventeenth supervision institutions or supervisors put forward opinions and suggestions, supervision units without justifiable reasons, should be accepted, and take corresponding improvement measures. When necessary, the supervision institution may conduct a review. Eighteenth supervision institutions to complete the task of supervision, supervision results should be reported to the people's government at the same level, the administrative department of education and the superior supervision institutions, put forward opinions and suggestions, and can be announced to the public. Chapter V Punishment Article 19 If the supervised unit and its relevant personnel are under any of the following circumstances, the competent authority shall give informed criticism to the unit, and the directly responsible personnel and the person in charge of the unit may be given corresponding administrative sanctions according to the cadre management authority:

(a) refusing to implement the supervision measures of supervision institutions and supervisors;

(2) Obstructing or resisting inspectors from exercising their functions and powers according to law;

(3) retaliating against inspectors. Twentieth inspectors in any of the following circumstances, depending on the seriousness of the case, given the corresponding administrative sanctions:

(a) the use of authority for personal gain;

(two) the use of authority to shield others or infringe upon the legitimate rights and interests of others;

(three) other acts of abuse of power. Chapter VI Supplementary Provisions Article 21 Provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with these Provisions and in light of the actual conditions in their respective regions, formulate implementation measures. Article 22 The State Education Commission shall be responsible for the interpretation of these Provisions. Article 23 These Provisions shall come into force as of the date of promulgation.
