In order to strengthen the qualification management of property management enterprises, according to the Measures for the Qualification Management of Property Management Enterprises issued by the Ministry of Construction (OrderNo. Ministry of Construction 125, hereinafter referred to as the Measures) and the Detailed Rules for the Implementation of the Qualification Management of Property Management Enterprises in Henan Province issued by the Provincial Construction Department (Yu Jian [2005] No.45, hereinafter referred to as the Detailed Rules), the qualification management of property management enterprises is carried out in combination with the actual situation of our city.
Property management enterprises engaged in property management activities within the administrative area of this Municipality shall obtain the qualification of property management enterprises in accordance with the Measures, Detailed Rules and these Provisions before they can carry out property management activities.
Two, the city real estate management bureau is responsible for the city's property management enterprise qualification management.
County (city), District Real Estate Management Bureau (Institute), responsible for the management of property management enterprises in this area.
Three, the property management enterprise qualification level is divided into one, two, three. Its standards and reporting conditions shall be implemented in accordance with the provisions of the Detailed Rules.
The qualification grade of newly established property management enterprises is tentatively set for one year according to the lowest grade. Within one month before the expiration of the validity period, it shall apply to an enterprise with the necessary conditions for qualification recognition. Those who fail to apply for approval within the time limit shall be cancelled.
4. The name of the company applying for property management qualification shall be consistent with the content of property management business activities, and the title shall include? Property management? Words.
Five, the newly established property management enterprises shall have not less than three professionals who have obtained professional qualification certificates in accordance with the relevant provisions of the state.
Six, the qualification management of property management enterprises to implement the grading examination and approval system.
City real estate management bureau is responsible for the qualification examination and approval of enterprises below level three (including level three) and the qualification examination of secondary enterprises.
County (city) and district real estate management bureaus (institutes) are responsible for the preliminary examination of newly established enterprises' qualifications.
Seven, the application for the approval of the qualification level of property management enterprises, more than one month to three months did not declare, to show proof of funds issued by the bank, more than three months did not declare.
Eight, property management companies to undertake projects outside the county (city) or district registration `, should go to the county (city) or district real estate management bureau (institute) for the record, and accept its supervision and management.
Nine, registered outside the city of property management enterprises, intends to engage in property management in Zhengzhou City, should hold the following documents and materials to the Municipal Real Estate Management Bureau for registration, can participate in the bidding of property management projects, undertake property project activities, and accept the guidance, supervision and management of the municipal and district real estate management departments.
(a) the application report of bidding and contracting property management projects;
(two) the certificate of the real estate administrative department where the enterprise is located (letter of introduction);
(three) the original and photocopy of the enterprise qualification certificate and business license (stamped with the official seal of the enterprise);
(four) the certificate of the legal representative of the enterprise and the power of attorney of the legal representative;
(five) the identity certificate of the person in charge of the enterprise, the list of all personnel and the qualification certificates of all kinds of managers and professional and technical personnel;
(6) enterprise qualifications and credit files;
(seven) other relevant documents and certificates.
Ten, property management companies to apply for change of name, legal representative and other matters, shall submit the following materials:
1, enterprise qualification grade application form;
2. New business license;
3. Original and photocopy of qualification certificate;
4. Articles of association;
5. Resolutions of the board of directors;
6. The changed property service contract;
7, qualification declaration floppy disk;
8, credit file floppy disk.
Eleven, the quality management of property management enterprises to implement the annual assessment and dynamic management system. The fourth quarter of each year is the annual assessment time, and those who do not participate in the annual assessment without justifiable reasons shall be dealt with in accordance with the provisions of the Measures.
If the annual assessment does not meet the original qualification conditions, the qualification grade shall be re-recognized;
Property management enterprises in the business activities of major malignant events, business service behavior does not match the level of enterprise qualification or fails to fulfill the obligations stipulated in the service agreement, in accordance with the "Regulations on Property Management" in the State Council, "Regulations on Property Management in Henan Province" and "Measures" to give corresponding punishment.
Twelve, without the approval of the Municipal Real Estate Management Bureau, beyond the qualification level conditions, take over and participate in bidding activities without authorization, be demoted or revoked qualification, and be punished in accordance with the provisions of the Measures.
13. The property management enterprise fails to declare in time, changes the contents of enterprise qualification files and credit files, fails to perform due obligations, complains about illegal business practices, and refuses to rectify within the prescribed time limit. Those who have more than two records will be demoted or disqualified.
Fourteen. Matters not covered in these Provisions shall be implemented in accordance with the relevant provisions of the Measures and these Rules. ;
