Measures for the administration of practicing veterinarians and rural veterinarians
Chapter I General Provisions

Article 1 In order to safeguard the legitimate rights and interests of practicing veterinarians and rural veterinarians, standardize animal diagnosis and treatment activities, strengthen the team building of practicing veterinarians and rural veterinarians, and ensure animal health and public health safety, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on Animal Epidemic Prevention.

Article 2 Licensed veterinarians mentioned in these Measures include licensed veterinarians and licensed assistant veterinarians.

The term "rural veterinarian" as mentioned in these Measures refers to the personnel who have not obtained the qualification of practicing veterinary medicine and engaged in animal diagnosis and treatment activities in the countryside after filing.

Article 3 The Ministry of Agriculture and Rural Affairs shall be responsible for the management of national licensed veterinarians and rural veterinarians, strengthen the information construction, and establish and improve the information management system of licensed veterinarians and rural veterinarians.

The Ministry of Agriculture and Rural Affairs and the competent department of agriculture and rural affairs of the provincial people's government shall formulate and implement the continuing education plan for practicing veterinarians and rural veterinarians, and improve the quality and professional level of practicing veterinarians and rural veterinarians.

The competent agricultural and rural departments of the local people's governments at or above the county level shall be responsible for the management of practicing veterinarians and rural veterinarians within their respective administrative areas, and strengthen the supervision and management of the filing, practice activities and continuing education of practicing veterinarians and rural veterinarians.

Fourth to encourage practicing veterinarians and rural veterinarians to receive continuing education. The continuing education of practicing veterinarians and rural veterinarians may entrust relevant institutions or organizations to undertake specific tasks.

The institution where practicing veterinarians work shall support practicing veterinarians to participate in continuing education.

Article 5 Licensed veterinarians and rural veterinarians practice according to law, and their rights and interests are protected by law.

Veterinary trade associations shall, in accordance with laws, regulations, rules and articles of association, strengthen industry self-discipline, timely reflect industry demands, and provide information consultation, publicity and training, rights protection, dispute resolution and other services for veterinarians.

Article 6 Employees and rural veterinarians who have made outstanding contributions to animal epidemic prevention shall be commended and rewarded in accordance with relevant state regulations.

Veterinary practitioners and rural veterinarians who are sick, disabled or dead due to their participation in animal epidemic prevention work shall be given subsidies or pensions in accordance with relevant state regulations.

The competent agricultural and rural departments of the people's governments at the county level and the township (town) people's governments shall give priority to rural veterinarians as village-level animal epidemic prevention officers.

Chapter II Qualification Examination for Veterinary Practitioners

Article 7 The State implements the qualification examination system for practicing veterinarians.

Meet one of the following conditions, you can sign up for the national qualification examination for practicing veterinarians:

(a) personnel with college education or full-time college students, professional compliance with the National Veterinary Qualification Examination Committee announced the registered professional directory;

(2) Obtained the professional title of veterinarian or above before June 5438+ 10, 2009;

(three) rural veterinarians who have been registered or registered according to law and engaged in animal diagnosis and treatment activities for more than ten years.

Article 9 The qualification examination for practicing veterinarians is divided into general veterinarians and aquatic animals, including basic, preventive, clinical and comprehensive application subjects.

Article 10 The National Veterinary Qualification Examination Committee established by the Ministry of Agriculture and Rural Affairs is responsible for examining and approving examination subjects and examination outlines, issuing examination announcements, and determining examination papers. , supervise, guide and determine the qualification standards for the examination work.

Article 11 Those who pass the qualification examination for practicing veterinarians shall be awarded the qualification certificate of practicing veterinarians or assistant veterinarians by the competent agricultural and rural departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government according to the examination standards.

Chapter III Practice Filing

Article 12 Anyone who has obtained the qualification certificate of practicing veterinary medicine and engaged in animal diagnosis and treatment activities in an animal diagnosis and treatment institution shall file with the filing organ where the animal diagnosis and treatment institution is located.

Thirteenth meet one of the following conditions, can be registered as a rural veterinarian:

(a) to obtain a secondary professional degree in veterinary medicine, animal husbandry (animal husbandry and veterinary medicine), Chinese veterinary medicine (national veterinary medicine), aquaculture and other related majors;

(2) Obtaining the professional skill appraisal certificate or professional skill grade certificate of the animal epidemic prevention and control personnel at or above the intermediate level and the aquatic animal epidemic prevention and control personnel;

(three) engaged in animal epidemic prevention work in the village for five years.

Fourteenth practicing veterinarians or rural veterinarians shall submit the following materials to the filing authority:

(1) Filing information form;

(2) proof of identity.

In addition to the materials specified in the preceding paragraph, practicing veterinarians shall also submit the employment certificates of animal clinics, and rural veterinarians shall also submit academic certificates, professional skill appraisal certificates or professional skill grade certificates and other materials for the record.

Fifteenth filing materials meet the requirements, should be filed in a timely manner; If it does not meet the requirements, it shall inform the archival filing person to correct the relevant materials at one time.

The filing organ shall optimize the filing process, gradually realize unified online handling, and improve the filing efficiency.

Sixteenth licensed veterinarians can record a number of licensed animal clinics in the same county; Engaged in animal diagnosis and treatment activities in different counties, should be respectively to the animal diagnosis and treatment institutions where the filing authority for the record.

In case of any change in the medical institutions for practicing animals, the filing information shall be updated in a timely manner in accordance with the provisions.

Chapter IV Management of Practical Activities

Seventeenth veterinary practitioners and rural veterinarians suffering from human and animal infectious diseases shall not directly engage in animal diagnosis and treatment activities.

Eighteenth practicing veterinarians should practice in animal clinics for the record, except for consultation, support, invitation to visit and first aid between animal clinics.

A practicing veterinarian who specializes in the diagnosis and treatment of aquatic animal diseases after filing shall not engage in the diagnosis and treatment of other animal diseases.

Rural veterinarians shall engage in animal diagnosis and treatment activities in rural areas of the county where the filing organ is located, and shall not engage in business in cities and towns.

Nineteenth practicing veterinarians can engage in the prevention, diagnosis and treatment of animal diseases, write prescriptions, fill in diagnostic documents, and issue relevant animal diagnosis and treatment certificates.

A licensed assistant veterinarian may engage in animal health examination, sampling, dispensing, drug administration, acupuncture and other activities, and assist in carrying out operations, autopsies and other activities under the guidance of a licensed veterinarian, but may not prescribe for animal diagnosis and treatment, fill in diagnosis certificates, and issue relevant supporting documents.

Twentieth practicing veterinarians should standardize the filling of prescription notes and medical records. Without personal diagnosis and treatment, it is not allowed to prescribe, fill in the diagnosis certificate and issue relevant supporting documents for animal diagnosis and treatment.

Veterinary practitioners shall not falsify diagnosis results and issue false animal diagnosis and treatment certificates.

Article 21 Veterinary-related students who have participated in the teaching practice of animal diagnosis and treatment and graduates who have not yet obtained the qualification certificate of practicing veterinarians and participated in work practice in animal diagnosis and treatment institutions shall assist in participating in animal diagnosis and treatment activities under the supervision and guidance of practicing veterinarians.

Twenty-second practicing veterinarians and rural veterinarians shall perform the following obligations in their practice activities:

(1) Abide by laws, regulations, rules and relevant management regulations;

(two) engaged in animal diagnosis and treatment activities in accordance with the technical operation specifications;

(3) Abide by professional ethics and perform veterinary duties;

(four) care for animals, publicize animal health knowledge and animal welfare.

Twenty-third practicing veterinarians and rural veterinarians shall use veterinary drugs and veterinary instruments in accordance with the relevant provisions of the state, and shall not use counterfeit veterinary drugs, drugs and other compounds prohibited by the Ministry of Agriculture and Rural Affairs or veterinary instruments that do not meet the requirements.

Veterinary practitioners and rural veterinarians shall immediately report to the competent agricultural and rural authorities of the local people's government when they find serious adverse reactions that may be related to the use of veterinary drugs and veterinary instruments.

Twenty-fourth practicing veterinarians and rural veterinarians shall dispose of used veterinary instruments and medical wastes in animal diagnosis and treatment activities in accordance with regulations.

Article 25 When practicing veterinarians and rural veterinarians find animals infected or suspected to be infected in animal diagnosis and treatment activities, they shall immediately report to the competent agricultural and rural departments of the local people's government or the prevention and control institutions of animal diseases in accordance with state regulations, and take control measures such as isolation and disinfection quickly to prevent the spread of animal diseases.

When practicing veterinarians and rural veterinarians find that animals have or are suspected to have diseases that should be culled according to state regulations in animal diagnosis and treatment activities, they shall not be treated without authorization. Twenty-sixth practicing veterinarians and rural veterinarians shall, in accordance with the requirements of the local people's government or the competent department of agriculture and rural areas, participate in the prevention, control and extermination of animal diseases, and the units where practicing veterinarians work and rural veterinarians shall not hinder or refuse.

Practitioners and rural veterinarians can carry out animal epidemic prevention and disease diagnosis and treatment activities by undertaking services purchased by the government.

Twenty-seventh practicing veterinarians shall, before the end of March each year, truthfully report the veterinary practice activities of the previous year in accordance with the requirements of the competent agricultural and rural departments of the people's governments at the county level.

Twenty-eighth local people's governments at or above the county level shall establish and improve the daily supervision system, and supervise and inspect the implementation of laws, regulations and rules by practicing veterinarians and rural veterinarians within their respective jurisdictions.

Chapter V Legal Liability

Twenty-ninth in violation of the provisions of these measures, a practicing veterinarian has one of the following acts, and shall be punished in accordance with the provisions of the first paragraph of Article 106th of the Law of People's Republic of China (PRC) on Animal Epidemic Prevention:

(a) engaged in animal diagnosis and treatment activities during the period of being ordered to suspend animal diagnosis and treatment activities;

(2) engaging in animal diagnosis and treatment activities beyond the county where the record is filed or the scope of practice;

(3) A licensed assistant veterinarian directly performs surgery, or writes prescriptions for animal diagnosis and treatment, fills in diagnosis certificates, and issues relevant supporting documents.

Article 30 A practicing veterinarian who, in violation of the provisions of these measures, rescues animals suffering from or suspected of suffering from diseases that should be culled according to the provisions of the state, has caused or may cause the spread and epidemic of animal diseases, shall be punished in accordance with the provisions of the second paragraph of Article 106 of the Law of People's Republic of China (PRC) on Animal Epidemic Prevention.

Thirty-first practicing veterinarians who violate the provisions of these measures and fail to truthfully form a veterinary practice report according to the requirements of the competent agricultural and rural departments of the people's government at the county level shall be punished in accordance with the provisions of Article 108 of the Law of People's Republic of China (PRC) on Animal Epidemic Prevention.

Thirty-second in violation of the provisions of these measures, practicing veterinarians have one of the following acts in animal diagnosis and treatment activities, the competent agricultural and rural departments of the local people's governments at or above the county level shall order them to make corrections within a time limit and impose a fine of 1000 yuan to 5000 yuan:

(a) do not use medical records, or should be prescribed without a prescription;

(two) the prescription and medical records are not standardized;

(three) without authorization for personal diagnosis and treatment, prescription, fill in the diagnosis, animal diagnosis and treatment related documents issued;

(4) Forging diagnosis results and issuing false animal diagnosis and treatment certificates.

Thirty-third in violation of the provisions of these measures, rural veterinarians do not engage in animal diagnosis and treatment activities in accordance with the provisions of the record, and the competent agricultural and rural departments of the local people's governments at or above the county level shall order them to make corrections within a time limit and impose a fine of 1000 yuan to 5000 yuan.

Chapter VI Supplementary Provisions

Thirty-fourth people who have obtained the qualification certificates of practicing veterinarians employed by animal farms, experimental animal breeding units, veterinary drug production enterprises, zoos and other units may apply for practicing veterinarians for the record on the basis of employment contracts, but may not carry out animal diagnosis and treatment activities abroad.

Article 35 The competent agricultural and rural departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, according to local conditions, decide that licensed assistant veterinarians shall independently engage in animal diagnosis and treatment activities in rural areas, and manage their practice activities according to the licensed veterinarians.

Thirty-sixth the term "filing authority" as mentioned in these Measures refers to the competent department of agriculture and rural affairs of the people's government at the county (municipal district) level; If there is no competent department of agriculture and rural areas in the municipal area, the filing organ shall be the competent department of agriculture and rural areas at the next higher level.
