These Regulations apply to the reserve resources of ancient pear trees with the age of 100 or more and more than 80 years. Article 3 The protection, management and utilization of ancient pear trees shall adhere to the principles of planning first, scientific management, protection first and rational utilization. Fourth city and county people's governments should strengthen the organization and leadership of the protection and management of ancient pear trees. The ancient pear tree protection and management institution in Gaolan County is specifically responsible for the daily work of the ancient pear tree protection and management.
City, county forestry and county development and reform, public security, finance, natural resources, ecological environment, housing construction, planning, agriculture, water affairs, culture, tourism and other administrative departments shall, according to their respective responsibilities, do a good job in the protection and management of ancient pear trees.
Shichuan Town People's Government shall, within the scope of its functions and powers, do a good job in the protection, management and utilization of ancient pear trees.
Villagers' committees and villagers' groups shall perform the duties of mass autonomous organizations and rural land contracting parties according to law, and guide villagers to do a good job in the protection of ancient pear trees by formulating village rules and regulations and improving land contracting contracts. Article 5 The municipal and county people's governments shall incorporate the protection of ancient pear trees into the overall plan for national economic and social development, and formulate special plans for the protection, management and utilization of ancient pear trees. Sixth city and county people's governments shall set up special funds for the protection of ancient pear trees, which shall be included in the annual budget for the protection, management and utilization of ancient pear trees. Seventh ancient pear tree protection and management institutions shall perform the following duties:
(a) to organize the implementation of the special plan for the protection, management and utilization of ancient pear trees;
(two) to supervise and guide the main body responsible for the maintenance of ancient pear trees, and to include the ancient pear trees over 80 years old in the scope of protection every natural year, and to register and manage the pear trees over 50 years old;
(three) responsible for the daily inspection of ancient pear trees, timely and properly handle the problems found;
(four) to investigate and deal with the illegal acts of destroying ancient pear trees and their growing environment and protection facilities;
(five) responsible for the monitoring and prevention of pests and diseases of ancient pear trees;
(six) responsible for supervising the fire prevention work of ancient pear trees;
(seven) responsible for the investigation, registration and regular monitoring of ancient pear tree resources, and the preparation of test reports;
(eight) to carry out "Tian Bashi" and other professional and technical personnel training, to carry out the protection, management and utilization of ancient pear trees with the content of ancient planting inheritance and modern science and technology conservation;
(nine) other duties as prescribed by the people's government of the city or county. Article 8 The people's governments of cities, counties and towns shall strengthen publicity and education on the protection of ancient pear trees, popularize protection knowledge and enhance public awareness of protection. Article 9 The Standing Committee of the County People's Congress and the Presidium of the Town People's Congress shall organize supervision and inspection on the implementation of these Regulations every year, and listen to and consider the reports of the County People's Government and the Town People's Government on the protection, management and utilization of ancient pear trees. Article 10 All units and individuals have the obligation to protect ancient pear trees. Have the right to discourage and report acts that damage ancient pear trees.
After receiving the report, the ancient pear tree protection and management institution shall promptly deal with it, keep the informer confidential, and give appropriate rewards to the informer. Eleventh units and individuals are encouraged to donate money to protect or adopt ancient pear trees. Units and individuals that donate money to protect and adopt ancient pear trees can enjoy the right of signature within the time limit for donating money for adoption. Specific measures for donating money to protect or adopt ancient pear trees shall be formulated by the county people's government.
Units and individuals that have made remarkable achievements in the protection of ancient pear trees shall be commended and rewarded by the county people's government. Twelfth county forestry administrative departments and ancient pear tree protection and management institutions organize experts to identify the age of ancient pear trees, and report them to the county government for confirmation and announcement, and report them to the municipal forestry administrative departments for the record. Thirteenth County People's Government shall, according to the special plan for the protection, management and utilization of ancient pear trees, delimit the core protection areas and ecological protection areas of ancient pear trees.
The construction activities in the core protected areas shall strictly implement the special plan for the protection, management and utilization of ancient pear trees, and prohibit the new construction, reconstruction and expansion activities that damage and affect the growth of ancient pear trees.
Ecological conservation areas should give priority to the protection of ecological resources and appropriately develop forestry, fruit industry and rural tourism; Construction activities that do not affect the growth of ancient pear trees can be carried out moderately after approval. Fourteenth construction activities in the ecological protection zone, the construction unit shall formulate the protection scheme of ancient pear trees before construction, and report to the ancient pear tree protection and management institutions for review. The protection and management institution of ancient pear trees shall put forward examination opinions within ten working days after receiving the protection plan and submit them to the county people's government for examination and approval.
Without the approval of the ancient pear tree protection plan, the construction unit shall not start construction. Fifteenth county people's government to protect the ancient pear trees, and set up protective fences, lightning protection devices and other corresponding protective facilities according to actual needs.
The ancient pear tree protection board is designed, made and hung by the ancient pear tree protection management organization. The ancient pear tree protection card shall indicate the name, scientific name, surname, age, number, unit or individual responsible for maintenance, setting time, telephone number and other contents and information of the ancient pear tree by electronic means such as QR code. Hanging the ancient pear tree protection card shall not affect the growth of ancient pear trees.
No unit or individual may move or damage the protection board and protection facilities of ancient pear trees without authorization.
