Article 33 Where a talent intermediary service institution, in violation of these Provisions, expands its business scope without authorization, fails to accept inspection according to law or provide false materials, or fails to go through the formalities for license change in accordance with the provisions, the personnel administrative department of the government at or above the county level shall give it a warning and may impose a fine of 1 10,000 yuan; If the circumstances are serious, it shall be ordered to suspend business for rectification. Article 36 Where an employing unit, in violation of these Provisions, refuses to employ or raises the employment standards on the grounds of nationality, sex and religious belief, or refuses to employ personnel, or charges fees from applicants or seeks illegal benefits by fraudulent means, the personnel administrative department of the government at or above the county level shall order it to make corrections; If the circumstances are serious, a fine of 10000 yuan shall be imposed.

Thirty-seventh individuals who violate these regulations and cause losses to the original unit shall be liable for compensation.

Article 38 Where an employer, a talent intermediary service agency or an advertisement publisher publishes a false advertisement for talent recruitment, the administrative department for industry and commerce shall punish it in accordance with Article 37 of the Advertising Law.

If the talent intermediary service agency publishes advertisements beyond the permitted business scope, and the advertisement publisher publishes advertisements for the intermediary service agency beyond the permitted business scope or without a license, the administrative department for industry and commerce shall impose a fine of 10000 yuan; If there is illegal income, a fine of less than 3 times the illegal income may be imposed, but the maximum amount shall not exceed 30 thousand yuan.
