Regulations of Henan Province on Vocational Training
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Labor Law of People's Republic of China (PRC), the Vocational Education Law of People's Republic of China (PRC), the Employment Promotion Law of People's Republic of China (PRC) and other laws and regulations, in combination with the actual situation of this province, in order to standardize vocational training activities, improve workers' vocational skills and literacy, promote employment and entrepreneurship, and serve economic and social development. Article 2 These Regulations shall apply to vocational training and related management activities within the administrative area of this province.

The term "vocational training" as mentioned in these Regulations refers to the education and training activities for workers' technical business knowledge, practical operation ability and professional quality, including pre-job training, on-the-job training, re-employment training and entrepreneurship training. Article 3 Vocational training shall adhere to the principles of overall planning of urban and rural areas, employment orientation, skill-based and lifelong training, establish and improve a vocational training system for all workers in accordance with the national occupational classification and occupational grading standards and the requirements of technological progress and industrial upgrading to meet the needs of the market and employment and entrepreneurship. Article 4 Vocational training should strengthen the training of workers' vocational skills, at the same time strengthen the cultivation of workers' social morality, professional ethics and legal awareness, improve their professional quality, and carry forward and inherit the craftsman spirit. Fifth people's governments at or above the county level shall incorporate the development of vocational training into the national economic and social development plan, establish and improve the coordination mechanism of vocational training, and promote vocational training.

The human resources and social security departments of the people's governments at or above the county level shall be responsible for the overall planning, supervision and management of vocational training within their respective administrative areas.

The people's governments at or above the county level development and reform, education, industry and information technology, civil affairs, finance, housing and urban construction, transportation, agriculture, commerce, state-owned assets supervision and management and other relevant departments shall do a good job in vocational training within their respective functions and duties.

Township people's governments and sub-district offices shall do a good job in vocational training according to law.

Trade unions, youth leagues, women's federations, science and technology associations, disabled persons' federations, vocational education clubs and other social organizations shall assist the people's governments in carrying out vocational training. Article 6 People's governments at or above the county level and their relevant departments shall strengthen vocational training and publicity, and guide the whole society to respect labor, admire skills and encourage creativity. Article 7 Laborers have the right to receive vocational training according to law. Enterprises and other employers have the obligation to ensure that employees participate in the skills training required for their posts according to law.

Encourage workers to participate in various forms of vocational training. Chapter II Vocational Training System Article 8 People's governments at or above the county level shall, according to the needs of economic and social development in their respective administrative areas, establish and improve vocational training systems focusing on vocational colleges, enterprises and vocational training institutions, and strengthen vocational training capacity building. Article 9 The municipal people's government under the provincial jurisdiction shall, according to the needs of the development of local pillar industries, rely on vocational colleges, vocational training institutions or independently build public training bases with reasonable layout and high skill content to provide skills training and skill appraisal services for the society.

Encourage qualified county (city, district) people's governments to build public training bases. Tenth encourage and support enterprises, institutions, social organizations and individuals to set up vocational colleges or vocational training institutions in accordance with the relevant provisions of the state, and carry out various forms of vocational training.

The establishment of private vocational training institutions shall meet the conditions stipulated by relevant state laws and regulations, and shall be examined and approved by the human resources and social security departments of the people's governments at or above the county level in accordance with the authority and procedures prescribed by the state, and sent to the education departments at the same level for the record. Without approval according to law, vocational training may not be carried out for the society. Eleventh people's governments at or above the county level and their relevant departments shall incorporate the training of vocational training teachers into the construction plan of teachers, strengthen supervision and management, and ensure that teachers meet the needs of vocational training development.

Vocational colleges and vocational training institutions should strengthen the construction of teachers, and implement the system of on-the-job training for teachers and regular internships in enterprises.

Teachers in vocational colleges and vocational training institutions should have ideological and political qualities and professional skills that are compatible with vocational training tasks.

Implement a full-time and part-time teacher system. Support vocational colleges and vocational training institutions to introduce and hire professional and technical personnel and highly skilled personnel with practical experience as training teachers. Article 12 An enterprise shall establish a system of employee vocational training, and specify the institutions or personnel responsible for employee vocational training. Large and medium-sized enterprises should build training bases that meet the needs of enterprise development by themselves or relying on vocational colleges and vocational training institutions.

Enterprises should accept students and teachers' internships in vocational colleges and vocational training institutions; For internship, appropriate labor remuneration shall be given in accordance with relevant regulations. Chapter III Implementation of Vocational Training Article 13 The human resources and social security departments of the people's governments at or above the county level shall, jointly with relevant departments, formulate medium-and long-term vocational training plans and annual implementation plans, and organize their implementation. Article 14 The human resources and social security department of the provincial people's government shall, according to the actual situation of this province, jointly with the relevant departments and industry associations, and according to the national vocational grade standards or the technical specifications of enterprise posts, formulate the norms and guidelines for government-funded vocational training services, and improve the standardization level of vocational training. Article 15 The human resources and social security departments of the people's governments at or above the county level shall organize rural migrant workers and urban registered unemployed people to participate in primary and intermediate skills training, and organize fresh middle school graduates who have not continued their studies and have employment needs to participate in labor preparation training for a certain period of time.
