Regulations of Shenzhen Municipality on Vocational Training
Chapter I General Provisions Article 1 In order to strengthen and promote vocational training, improve the overall quality of workers, and meet the needs of sustainable economic and social development, these Regulations are formulated in accordance with the provisions of the Labor Law of People's Republic of China (PRC), the Vocational Education Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation in Shenzhen. Article 2 These Regulations shall apply to the vocational training activities carried out within the administrative area of Shenzhen. Article 3 The term "vocational training" as mentioned in these Regulations refers to vocational education activities with professional standards and professional norms as the main content and with the main goal of cultivating and improving workers' vocational skills, including pre-job training, on-the-job training, job transfer training, re-employment training and other skills training. Article 4 Vocational training should meet the needs of economic development, scientific and technological progress and employment, and serve to cultivate and improve the employability, work ability and career change ability of workers.

Vocational training should be combined with the implementation of employment access system and vocational qualification certificate system. Article 5 The government shall incorporate vocational training into the overall planning of economic and social development, formulate a development plan for vocational training, make overall arrangements and develop vocational training undertakings.

The government should give full play to the role of various vocational and technical colleges and other training institutions, encourage and support enterprises, institutions, social organizations and other social organizations and individuals to carry out various forms of vocational training, and encourage and help workers to participate in vocational training. Article 6 The employing unit shall establish a vocational training system and provide employees with vocational training in a planned way according to the actual situation of the enterprise. Article 7 Laborers have the right to participate in vocational training according to law and the obligation to receive vocational training according to the needs of their posts. Article 8 The government protects the legitimate rights and interests of vocational training institutions. Vocational training institutions shall enjoy autonomy in running schools according to law.

Vocational training institutions shall abide by laws and regulations, implement the national vocational education policy and ensure the quality of vocational training. Article 9 The municipal and district labor administrative departments (hereinafter referred to as labor departments) are the competent departments of vocational training within their respective administrative areas and are responsible for the implementation of these Regulations. Article 10 Vocational training trade associations are self-regulatory organizations of vocational training institutions. The operation of trade associations and the rights and obligations of their members shall be stipulated in the articles of association. Its main responsibilities are as follows:

(a) the implementation of laws and regulations on vocational training;

(two) to formulate specific plans and measures for the implementation of vocational training development planning;

(three) to guide the professional setting and development direction of vocational training;

(4) Formulating rules for vocational training;

(five) to reflect the opinions and demands of members and safeguard the legitimate rights and interests of members;

(six) to handle matters entrusted by the labor department. Chapter II Vocational Training Institutions Article 11 The government may establish vocational training institutions according to the development plan of vocational training and actual needs.

Enterprises, institutions, social organizations and other social organizations and individuals may set up vocational training institutions if they meet the following conditions and are approved by the labor department:

(1) Having an organizational structure and management system;

(2) Having teachers and managers suitable for the applied vocational training activities;

(3) Having sites, facilities and equipment that meet the requirements of the government;

(four) there are not less than one hundred thousand yuan of school funds;

(five) in line with the government's vocational training development plan. Article 12 After accepting an application for establishing a vocational training institution, the labor department shall make a decision on whether to approve it within 20 working days from the date of accepting the application. If the establishment is approved, the school license shall be issued and copied to the education administrative department at the same level for the record; If the establishment is not approved, the applicant shall be given a written reply. Thirteenth vocational training institutions shall, after obtaining the school license, handle the registration of public institutions or private non-enterprise units in accordance with the relevant provisions, carry out vocational training activities within the scope specified in the school license, and conduct annual inspection in accordance with the provisions.

The school license shall not be leased or transferred. Article 14 The government shall establish a public training base for vocational training according to the development plan of vocational training (hereinafter referred to as the public training base). The public training base is open to the society and provides practical training services.

The government encourages and supports enterprises, trade organizations and other social organizations or individuals to establish training bases. Fifteenth vocational training institutions engaged in charging vocational training services shall not violate the provisions of the competent pricing department. Chapter III Implementation of Vocational Training Article 16 Vocational training shall be implemented in accordance with national vocational (skill) standards; If there is no national occupational (skill) standard, it shall be implemented in accordance with the occupational norms determined by the provincial and municipal labor departments.

Without the standards and norms stipulated in the preceding paragraph, vocational training institutions shall report the training plan to the labor department for the record before implementing vocational training. Seventeenth labor departments should provide various forms of labor preparation training for ordinary junior and senior high school graduates who have failed to enter higher education. Eighteenth labor departments to re-employment training for unemployed workers, the required funds from the unemployment insurance fund to pay for retraining. Article 19 The government shall organize vocational training for the disabled according to their physical health and employment aspirations. Disabled persons shall be given appropriate living expenses during vocational training. The expenses and living expenses for the disabled to participate in vocational training are paid from the employment security fund for the disabled. Article 20 The employing unit shall, according to laws and regulations and the actual situation of the unit, provide pre-job vocational training for newly hired employees, and provide on-the-job and post-transfer vocational training for employees in a planned way.

Employees engaged in technical jobs must undergo vocational training before taking up their posts. If the state stipulates that it should have professional qualifications, it can only be employed after obtaining the corresponding professional qualifications.
