The financial funds mentioned in the preceding paragraph refer to budgetary funds, extra-budgetary funds and business income. Article 4 Government procurement shall follow the principles of openness, fairness, impartiality and efficiency, safeguard public interests and promote the implementation of relevant social and economic policies of the state and Ningbo. Article 5 The Ningbo Municipal Government Procurement Leading Group (hereinafter referred to as the procurement leading group) is the leading organization of government procurement in this Municipality, responsible for formulating government procurement policies, reviewing government procurement catalogues, and coordinating, managing and supervising government procurement in this Municipality.
The procurement leading group consists of the government procurement management office (hereinafter referred to as the procurement office), which is located in the Municipal Finance Bureau and is responsible for the daily management of government procurement and performs the following duties:
(a) the implementation of government procurement policies;
(two) the preparation of the draft catalogue of government procurement;
(3) Examining the annual government procurement plan;
(four) to formulate the implementation measures adopted by the government;
(5) Accepting complaints about government procurement;
(six) other relevant government procurement affairs authorized by the procurement leading group. Article 6 The Ningbo Municipal Government Procurement Center (hereinafter referred to as the procurement center) is a procurement institution of the municipal government and a public institution directly under the Municipal Finance Bureau. It accepts the leadership of the procurement leading group and performs the following duties:
(a) unified organization and implementation of the procurement business listed in the centralized procurement catalogue;
(two) entrusted by the procurement authority to purchase or organize bidding matters on behalf of the procurement authority;
(three) to undertake the procurement business of procurement agencies that do not have or do not have independent procurement qualifications;
(four) responsible for government procurement statistics, procurement analysis, procurement review and procurement fund settlement;
(5) Establish a network of suppliers and experts, and train purchasing managers and technicians;
(six) to undertake other related procurement affairs entrusted by the procurement leading group. Article 7 Government procurement shall be subject to social supervision.
Any organization or individual has the right to sue and report illegal acts in government procurement. Government procurement agencies can prevent unhealthy practices in procurement by inviting personnel from relevant departments such as supervision, auditing, industry and commerce, or appointing supervision liaison officers to conduct daily supervision over the whole government procurement activities. Chapter II Scope and Methods of Government Procurement Article 8 The Procurement Office shall, according to the actual needs of government procurement, prepare a draft catalogue of government procurement, submit it to the procurement leading group for deliberation, and publicize it to the public after deliberation and approval.
The compilation of government procurement catalogue should consider the requirements of promoting national industrial policy, which is conducive to promoting economic development, and gradually expand the scope of centralized procurement according to needs and possibilities. Article 9 A purchaser shall prepare an annual government procurement plan according to the approved government procurement catalogue and the budget and fund implementation approved by the financial department, and submit it to the procurement office for review. Tenth approved government procurement plan, which belongs to centralized procurement, shall be organized and implemented by the procurement center; Decentralized procurement shall be organized and implemented by all purchasers. Article 11 The methods of government procurement include: open tender procurement, invited tender procurement, negotiation procurement, inquiry procurement, single-source procurement or other methods.
Public bidding procurement refers to the procurement method in which public bidding announcement is issued to the society, more than three suppliers participate in bidding, and suppliers are selected according to the prescribed procedures.
Invitation to bid procurement refers to the procurement method in which more than three suppliers are invited to bid, more than three suppliers participate in bidding, and the suppliers are selected according to the prescribed procedures.
Negotiation procurement refers to the procurement method that directly invites more than three suppliers to negotiate on the technology, quality, performance, business conditions and price of the goods or services they provide.
Inquiry procurement refers to a procurement method that compares quotations provided by more than three suppliers to ensure competitive prices.
Single-source procurement refers to direct procurement with only 1 supplier without competitive conditions. Article 12 The following procurement projects shall be subject to public bidding:
(1) materials with a contract price of more than100000 yuan;
(2) Lease repair works with a contract amount of more than 200,000 yuan;
(3) Services with the contract amount of 10 million yuan or more;
(4) Items that should be purchased centrally as stipulated in the procurement catalogue. Article 13 As stipulated in Article 12 of these Measures, under any of the following circumstances, with the consent of the Procurement Office, you may invite tenders:
(a) the cost of public bidding is too high, which is not commensurate with the value of the procurement project;
(2) Procurement projects can only be obtained from a limited range of suppliers because of their complexity or professionalism.
