Chapter I General Provisions

In order to strengthen the construction of civil servant classification management system and build a team of high-quality professional and technical civil servants, these Provisions are formulated in accordance with the Civil Service Law of People's Republic of China (PRC).

These Provisions shall apply to civil servants who hold professional and technical positions in organs at all levels and their directly affiliated or dispatched institutions. Professional and technical positions should have specific requirements for professional and technical ability, engage in professional and technical work, perform professional and technical duties, and provide professional support and technical support for the organs to implement public management.

Position setting
Article 4
Organs at all levels shall, in accordance with the principles of scientific rationality, simplicity and high efficiency, set up professional and technical posts in the professional series and categories stipulated by the state. Other professional categories can be added due to work needs.
Article 5
The establishment of professional and technical positions should control the proportion. In principle, the corresponding proportion is determined according to the number of administrative establishments of organs at all levels.
Article 6
The establishment of professional and technical positions shall be subject to the examination and approval system. By the central competent department of business according to the professional and technical work responsibilities, tasks, the nature of the work and personnel structure and other factors, to determine the category of professional and technical positions and set the proportion, approved by the central competent department of civil servants before implementation.
Article 7
According to the needs of the work, organs at all levels may, in accordance with the relevant provisions of the state, implement the appointment system for some professional and technical positions with strong social universality and less demand.
Chapter III Positions and Levels
Article 8
The positions of professional and technical civil servants are divided into leadership positions and non-leadership positions. The management of professional and technical civil servants in leading positions shall be implemented with reference to the relevant provisions of comprehensive management civil servants.
The name of the non-leadership position of professional and technical civil servants is professional and technical officer. From high to low, it is divided into nine job grades, namely: first-level professional technical officer, second-level professional technical officer, third-level professional technical officer, fourth-level professional technical officer, fifth-level professional technical officer, sixth-level professional technical officer, seventh-level professional technical officer, eighth-level professional technical officer and ninth-level professional technical officer.
The positions mentioned below in this article refer to the non-leadership positions of professional and technical civil servants.
Article 9
The corresponding relationship between professional and technical civil servants' positions and levels is:
(1) First-class professional and technical officers: grades 12 to 7;
(2) Grade II professional and technical positions: Grade 14 to Grade 9;
(3) Three-level professional and technical positions: 17 to 11;
(4) Professional and technical officers of Grade 4: Grade 19 to Grade 13;
(5) Five professional and technical officers: 21 to 15;
(6) Professional and technical officers at Grade 6: Grade 22 to Grade 16;
(7) Professional and technical officers at Grade 7: Grade 23 to Grade 17;
(8) Professional and technical officers at Grade 8: Grade 24 to Grade 17;
(9) Grade 9 professional and technical officers: Grade 25 to Grade 18;
Article 10
The post setting of professional and technical civil servants shall be implemented in accordance with the following provisions:
(a) professional and technical positions of organs at or above the provincial level, can set up one to nine professional and technical officers;
(two) professional and technical positions of municipal organs can be set up two to nine professional and technical officers;
(3) There may be four to nine professional and technical officers for professional and technical posts in county-level organs.
The establishment of professional and technical officers from grade one to grade four shall be controlled by structural proportion. In principle, it is determined according to the total number of professional and technical positions of organs at all levels. The specific structural proportion shall be formulated by the central competent department and implemented after being approved by the central competent department of civil servants.
Article 11 The people's police and professional and technical civil servants of the customs and diplomatic institutions abroad shall be assigned ranks corresponding to their posts according to their work characteristics.

Article 12 The recruitment of professional and technical civil servants below Grade Five shall be subject to the examination and employment system. With the approval of the competent department of civil servants at or above the provincial level, the qualification conditions for applying for positions can be relaxed.
Thirteenth professional and technical civil service recruitment examination content is set according to the ability and quality of the position, focusing on the professional basic knowledge of the applicants and the ability to use professional technology to deal with practical problems.
Fourteenth professional and technical civil servants, with the approval of the competent department of civil servants at or above the provincial level, can simplify the procedures or adopt other assessment methods.

Fifteenth professional and technical civil servants, in accordance with the management authority, to conduct a comprehensive assessment of their morality, ability, diligence, performance, honesty, focusing on the assessment of technical level and work performance.
Sixteenth professional and technical civil servants mainly take the form of annual assessment. At the same time, after democratic evaluation, the person in charge of this organ or the authorized evaluation Committee will determine the evaluation order.
Seventeenth professional and technical civil servants in the annual assessment of excellent grades, generally not less than the annual excellent grades 10%.
Chapter vi
Appointment, removal and promotion of posts
Article 18 The appointment, removal and promotion of professional and technical civil servants shall be carried out in accordance with the management authority, legal conditions and procedures.
Article 19 The appointment of professional and technical civil servants shall be carried out in accordance with the sequence of professional and technical posts and within the prescribed post quota and job structure proportion.
Twentieth professional and technical civil servants, should have the basic qualifications required by the proposed post. Professional and technical posts subject to occupation qualification access control shall include the requirements of access control.
The basic qualifications of professional and technical civil servants and their acquisition methods shall be formulated by the central competent department of business and implemented after being audited by the central competent department of civil servants.
Twenty-first newly hired professional and technical civil servants after the probation period expires and pass the examination, according to their academic qualifications, majors and work ability to determine the corresponding professional and technical positions. Generally according to the following provisions:
(1) Graduated from a doctoral degree and held a five-level professional and technical post;

Article 22
Professional and technical civil servants should reach the following basic service years for promotion, and conduct a comprehensive investigation on their professional level, professional ability, realistic performance and work performance, and select the best ones.
(a) to be promoted to a first-class professional and technical position, he shall hold a second-class professional and technical position, a bureau-level deputy or an equivalent position for more than 5 years;
(2) Those who are promoted to the second-level professional and technical posts shall hold the third-level professional and technical posts, the county-level chief posts or equivalent positions for more than five years;
(3) To be promoted to a third-level professional and technical post, one shall hold a fourth-level professional and technical post, a county-level deputy post or an equivalent post for more than 4 years;
(4) To be promoted to the fourth-level professional and technical officer, one shall have served as a fifth-level professional and technical officer, a section chief at the township level or an equivalent position for more than four years;
(5) Those who are promoted to five-level professional and technical posts shall hold six-level professional and technical posts for more than three years, and serve as township deputies or equivalent positions for more than five years;
(6) Those who have been promoted to a six-level professional and technical post shall hold a seven-level professional and technical post for more than two years;
(7) Those who have been promoted to seven-level professional and technical positions shall have held eight-level professional and technical positions for more than three years, and have been a clerk or equivalent position for more than five years;
(eight) the promotion of eight professional and technical positions should be nine professional and technical positions for more than 2 years, clerks or equivalent positions for more than 3 years.
Twenty-third professional and technical civil servants should be gradually promoted. Those who are particularly outstanding in their work or have special needs can be promoted to one level or above. Measures for exceptional or leapfrog promotion shall be formulated separately by the central competent department of civil servants.
Twenty-fourth professional and technical civil servants transferred from professional and technical posts shall be transferred from professional and technical posts. (○ Provisions on the Transfer of Civil Servants (for Trial Implementation) Article 2
The term "transfer" as mentioned in these Provisions refers to the non-leadership positions in which the personnel engaged in public affairs in state-owned enterprises, institutions, people's organizations and mass organizations are transferred to the organs to hold leadership positions above deputy researcher or other equivalent positions. Article 15 The level and relevant treatment of the transferred personnel shall be determined according to their transferred posts, combined with their original posts, work experience, education level and other conditions, and with reference to the personnel with the same conditions in the transferred organs. . )
Twenty-fifth professional and technical civil servants are determined to be incompetent in the annual assessment, and they will be reduced by one post level.
Twenty-sixth professional and technical civil servants leading positions and non-leading positions shall not concurrently hold each other in principle. If it is really necessary to engage in professional and technical work because of work, it may be concurrently employed with the approval of the appointment and removal organ.
Chapter VII
Encouragement and reward
Twenty-seventh professional and technical civil servants or collectives who have made outstanding achievements and contributions in professional and technical work shall be rewarded according to the relevant provisions of the state in any of the following circumstances:
(1) Having made important and creative achievements and outstanding contributions in the field of scientific research;
(two) made significant and creative achievements in engineering technology, and achieved remarkable results;
(three) outstanding achievements have been made in the popularization of science and technology, the popularization and transformation of scientific and technological achievements, and the management of science and technology, which have produced remarkable social or economic benefits;
(four) made significant contributions in important special work;
(five) long-term work in the forefront of science and technology, faithfully perform their duties, outstanding performance in their posts.
Twenty-eighth professional and technical civil servants should be included in the scope of scientific and technological awards and subsidies such as awards and subsidies for professional and technical personnel established by the state or national academic organizations.
Article 29 The central competent department of business may, according to the characteristics of professional and technical work in this industry and with the approval of the central competent department of civil servants, independently establish various incentive mechanisms such as awards, incentive allowances and research funds for professional and technical personnel in this industry.
Chapter VIII

Thirtieth according to the requirements of professional and technical positions and the needs of professional and technical personnel to update their knowledge, professional and technical civil servants are trained at different levels.
Thirty-first newly hired professional and technical civil servants shall receive initial training during the probation period. Civil servants who hold professional and technical positions shall implement the continuing education system for professional and technical personnel in accordance with relevant state regulations.
Professional and technical civil servants should participate in full-time or concentrated continuing education for no less than 12 days or 72 hours each year.

Thirty-fourth state-owned enterprises, institutions, people's organizations, mass organizations engaged in professional and technical personnel transferred to the office, should hold senior professional and technical positions or deputy senior professional and technical positions for more than 2 years.
Other types of civil servants to professional and technical civil servants, should meet the qualifications required by the proposed post, and in the proportion of professional and technical posts and job structure.
The internal communication of professional and technical civil servants should be carried out between the same or similar professional and technical posts.
Thirty-fifth professional and technical civil servants in any of the following circumstances, with the approval of the appointment and removal organ, can be transferred to other categories of civil servants:
(a) engaged in professional and technical work for more than five years, and it is really necessary to change jobs because of work;
(two) due to health status, technical level and other reasons;
(three) other unsuitable to continue to engage in professional and technical work.

Chapter 10
Wages and benefits
Thirty-seventh professional and technical civil servants shall implement the salary system of combining positions and grades as stipulated by the state. Chapter II XI Retirement
Fortieth professional and technical civil servants should retire if they reach the retirement age stipulated by the state or completely lose their ability to work.
Forty-first professional and technical civil servants who have worked in strong magnetic, radioactive and toxic posts for a long time may retire early upon their own voluntary application and approval by the appointment and removal organ.
Forty-second civil servants who have held professional and technical positions at or above the second level may, with the approval of the appointment and removal organ, extend their retirement age for no more than three years in principle:
(a) has undertaken important work (such as key scientific research projects) and other tasks have not been completed, which has a greater impact on post-retirement work;
(2) Special majors, new disciplines and key disciplines are in urgent need;
(three) the unit with weak technical force is really required by the work;
(4) Those who have played a gatekeeper role in business or played a leading role in professional disciplines and have not been replaced after retirement.
Chapter XII Supplementary Provisions
Article 43 The professional and technical personnel of public institutions managed according to the Civil Service Law may be managed according to these Provisions.
Article 44 People's Republic of China (PRC) and Ministry of Human Resources and Social Security shall be responsible for the interpretation of these Provisions.
