Interim Measures of Lanzhou Municipality on Administrative Assessment according to Law
Chapter I General Provisions Article 1 In order to comprehensively promote administration according to law and speed up the construction of a government ruled by law, these Measures are formulated in accordance with the relevant provisions of the State Council, such as the Outline for Comprehensively Promoting Administration According to Law, the Decision of the Municipal and County Governments on Strengthening Administration According to Law, and the Opinions on Strengthening the Construction of a Government Ruled by Law, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the assessment of administration according to law within the administrative area of this Municipality. Article 3 The term "assessment of administration according to law" as mentioned in these Measures refers to the assessment, evaluation, rewards and punishments and other activities of the assessment organs to promote the administration according to law of the assessed units. Fourth city and county (District) people's government unified leadership within their respective administrative areas of administrative examination according to law.

City, county (District) people's government set up a leading group office for administration according to law, and specifically organized the administrative examination according to law. Article 5 The Municipal People's Government shall be responsible for assessing the administrative situation of its subordinate departments and county (District) people's governments according to law.

County (District) people's government is responsible for the assessment of its subordinate departments and township (town) people's government, street offices in accordance with the law.

Where the local people's government is responsible for the administrative examination according to law by the dual management and vertical management departments, the examination results shall be copied to the higher management departments; If the superior management department is responsible for the assessment, the assessment results shall be copied to the local people's government. Article 6 Administrative examination according to law shall follow the principles of seeking truth from facts, fairness and justice, public participation and graded responsibility. Chapter II Contents and Basic Requirements of Examination Article 8 Contents of administrative examination according to law:

(1) Strengthen organizational leadership;

(two) the construction of administrative capacity according to law;

(3) Strengthen and standardize system construction;

(4) Scientific and democratic decision-making according to law;

(five) standardize the administrative law enforcement behavior;

(6) Strengthening administrative supervision;

(7) Resolving contradictions and disputes according to law;

(eight) comprehensively promote the openness of government affairs. Ninth basic requirements for strengthening the assessment of organizational leadership:

(a) to establish a guidance and coordination mechanism for administration according to law, improve the leadership, supervision and coordination mechanism, formulate specific measures and supporting measures to promote administration according to law, and incorporate the work funds into the financial budget and guarantee them;

(two) to implement the annual report system of administration according to law. Improve the system of supervision, inspection and assessment of administration according to law, formulate phased deployment and annual tasks of administration according to law, and supervise, inspect and assess the implementation of tasks;

(three) to strengthen the legal institutions and team building. According to the needs of the work, the legal institution is set up independently, equipped with full-time staff, and the office funds are included in the financial budget to be guaranteed. Give full play to the role of staff, assistants and legal advisers of legal institutions;

(4) Establish and improve the administrative accountability system focusing on the chief executive, and improve the government's execution and credibility. Tenth basic requirements for the evaluation of administrative capacity building according to law:

(a) to establish a long-term mechanism for legal knowledge learning and training, and to implement the system of studying law at government executive meetings and meetings of ministries and bureaus (commissions and offices);

(two) should be held not less than two times a year leading cadres administration according to law or legal lectures;

(three) to establish a system of administrative inspection and legal knowledge test for leading cadres in government departments according to law;

(four) the implementation of the legal knowledge test and administrative inspection system before the appointment of the proposed leading cadres;

(5) Incorporating the knowledge of administration according to law into the training of civil servants;

(six) organize administrative law enforcement personnel to participate in general legal knowledge training and specialized legal knowledge rotation training;

(seven) in a timely manner to carry out the newly promulgated laws, regulations and rules related to the industry to learn publicity and special training. Eleventh to strengthen and standardize the basic requirements of system construction evaluation:

(a) the formulation of government regulations and normative documents shall conform to the statutory authority and procedures, and comply with the provisions of laws, regulations and policies;

(two) drafting local regulations, formulating government regulations, and implementing the system of project demonstration, public participation, expert consultation and demonstration, and collective discussion and decision;

(three) the government published regulations and normative documents in legal form, and submitted for the record according to the prescribed requirements and time limit; Supervise the subordinate organs to perform the duties of filing normative documents and conduct a comprehensive review of the filing documents;

(four) improve the revision, abolition and regular cleaning system of government regulations and normative documents, and announce the cleaning results to the public in a timely manner. Twelfth according to the basic requirements of scientific and democratic decision-making:

(a) standardize administrative decision-making procedures, improve the rules of major decisions, and take public participation, expert argumentation, risk assessment, legality review and collective discussion and decision as the necessary procedures for major decisions;

(two) the implementation of the government legal institutions responsible person to attend the government executive meeting system and the department legal institutions responsible person to attend the business meeting system of the department bureau (commission, office);

(three) the establishment of a major decision-making demonstration hearing system;

(four) to establish and improve the accountability system for major decisions. Thirteenth basic requirements for standardizing the evaluation behavior of administrative law enforcement:

(a) the implementation of the administrative law enforcement responsibility system, to carry out law enforcement evaluation, strengthen the accountability of administrative law enforcement;

(two) to perform their duties according to law, investigate and deal with illegal cases, implement the benchmark of administrative punishment discretion, promote and standardize the work of relatively centralized administrative punishment, and actively promote the pilot work of comprehensive law enforcement;

(3) Refine the process of law enforcement, clarify the links and steps of law enforcement, and improve relevant systems;

(four) the implementation of administrative law enforcement files check system, standardize the administrative law enforcement files;

(five) the implementation of administrative law enforcement qualification management, law enforcement officers engaged in law enforcement activities should hold valid certificates and take the initiative to produce;

(six) improve the financial security system for law enforcement funds, prohibit the issuance of fines and confiscations, and strictly implement the system of separation of fines and confiscations and two lines of revenue and expenditure.
