Provisions of Tianjin Municipality on the Administration of Talent Market (97 amendments)
Article 1 These Provisions are formulated in accordance with the relevant laws and regulations of the state and the actual situation of this Municipality in order to standardize the behavior of talent exchange services, strengthen the supervision and management of the talent market and promote the healthy and orderly development of the talent market. Article 2 These Provisions shall apply to the management of the talent market within the administrative area of this Municipality. Article 3 The term "talents" as mentioned in these Provisions refers to professional and technical personnel and management personnel with secondary school education or professional and technical post qualifications, as well as other personnel engaged in professional and technical work with considerable professional knowledge and management level.

The term "talent market" as mentioned in these Provisions refers to organizations and places that provide intermediary services for talent selection and unit recruitment with talents and employers as the main body.

The talent market management mentioned in these Provisions includes the management of talent exchange service institutions, talent recruitment exchanges and other exchange service activities. Article 4 The talent market of this Municipality shall, in accordance with the provisions of laws and regulations, under the guidance and supervision of the personnel department of the government, and according to the needs of social and economic development, implement the principle of equal competition and adopt various forms to make the rational flow, allocation and use of talents to serve the reform, opening up, economic construction and the development of various undertakings. Article 5 The municipal personnel management department is the competent authority of this Municipality's talent market.

District and county personnel management departments shall be responsible for the management of the talent market in this district and county according to the division of responsibilities.

The administrative departments of industry and commerce, finance and price management of this Municipality shall supervise and manage the talent market according to law. Article 6 The establishment of a talent exchange service institution must meet the following conditions:

(1) Having a fixed office space and necessary funds and facilities;

(2) The business scope of the application conforms to the provisions of personnel regulations and policies;

(3) Having a sound management system and operating rules;

(four) full-time staff of not less than five people, and its main management personnel must undergo professional training by the competent department;

(5) Other conditions stipulated by the state and this Municipality.

The establishment of for-profit talent exchange service institutions must also meet the necessary conditions for industrial and commercial registration. Seventh municipal departments and municipal people's organizations, enterprises and institutions, the central and other provinces and cities in Tianjin need to set up talent exchange service institutions, they should apply to the municipal personnel management department; District and county departments, district and county people's organizations, enterprises and institutions need to set up talent exchange service institutions, and shall apply to the district and county personnel management department.

After receiving the application, the municipal or district/county personnel management department shall make a decision on examination and approval within 30 days; Those who pass the examination will be issued the Tianjin Talent Exchange Service License (hereinafter referred to as the License). To apply for the establishment of a profit-making talent exchange service institution, one must apply to the administrative department for industry and commerce for industrial and commercial registration after obtaining the license.

Where a talent exchange service institution needs to set up a branch, it shall go through the formalities in accordance with the provisions of the first paragraph of this article. Eighth of the talent exchange service institutions to implement the annual inspection system. The annual inspection of non-profit talent exchange service institutions shall be the responsibility of the municipal, district and county personnel management departments; The annual inspection of for-profit talent exchange service institutions shall be conducted by the personnel management department of the city, district and county jointly with the administrative department for industry and commerce. Article 9 A talent exchange service institution applying for opening a talent market shall meet the following conditions:

(1) Having a fixed negotiation place with a construction area of not less than 100 square meter;

(2) Having the necessary facilities and guarantee conditions for holding a talent recruitment exchange meeting;

(3) Being able to open the market regularly, at least once a month;

(4) Having the necessary conditions for industrial and commercial registration. Article 10 Where a talent exchange service institution and its talent market need to be changed or terminated, it shall go through the formalities of change or termination in accordance with the original application procedures. Eleventh applications for the establishment of a talent market shall be handled in accordance with the procedures for applying for the establishment of a talent exchange service institution. Twelfth held a talent recruitment exchange meeting must comply with the following provisions:

(1) The organizer shall be an approved talent exchange service organization;

(2) The organizer shall submit an application to the municipal personnel management department 15 in advance, and it can only be carried out after approval;

(3) The organizer shall examine the qualifications of the recruiting unit;

(4) There are strict organizational plans and safety measures to protect the legitimate rights and interests of enrollment units and candidates;

(five) the recruitment unit shall not charge any fees to the candidates;

(six) other conditions stipulated by the state and this Municipality. Thirteenth use of radio, television, newspapers and other news media to publish talent recruitment and hold talent recruitment exchange advertisements, must apply to the municipal personnel management department. The municipal personnel management department shall give a reply to the application with complete materials within 2 days. Fourteenth talent exchange service agencies have the responsibility to verify the information provided by job seekers and employers, and shall truthfully introduce them to all parties concerned. Fifteenth non-profit talent exchange service institutions fees, fees, by the municipal price management department in conjunction with the municipal financial management department and the municipal personnel management department for approval.

For-profit talent exchange service institutions shall report the charging items and standards to the municipal price management department and the municipal personnel management department for the record.
