Article 1 The name of this Association is "China Association of Architectural Education", and the English translation is China Association of Construction Education, abbreviated as CACE.
Article 2 This Association is a non-profit social organization serving the national construction education, and the relevant departments of construction education, schools, enterprises, institutions and organizations participate voluntarily. It is the link and bridge between the member units and the competent government departments, and has the qualification of legal person.
Article 3 The purpose of this Association is: to abide by the national constitution, laws, regulations and policies; Abide by social morality; Unite and organize national architectural educators, carry out academic research, cooperation and exchange, work consultation, education and training and social services, actively promote educational reform, and serve to improve the quality of construction workers, train qualified architectural talents and develop socialist architectural education.
Article 4 This Association accepts the professional guidance, supervision and management of the Ministry of Education, the Ministry of Housing and Urban-Rural Development and the Ministry of Civil Affairs.
Article 5 The domicile of this Association is in Haidian District, Beijing.
Chapter II Business Scope and Activity Principles
Article 6 The business scope of this Association is as follows:
(a) proceeding from the actual construction, making work plans, conducting academic research, and exploring the laws and characteristics of construction education.
(two) to discuss the hot and difficult issues in the reform and development of construction education, and to reflect the results of the discussion or make suggestions to the leading organs.
(three) entrusted by the competent department of construction education, responsible for relevant education, teaching management, quality evaluation, qualification demonstration, certificate management, textbook compilation and foreign exchanges and cooperation.
(four) actively organize all kinds of training and consulting work in the construction industry. Cooperate with relevant departments to carry out architectural education reform experiments.
(five) to guide the scientific research cooperation activities of member units and carry out the evaluation of educational scientific research achievements and teaching achievements.
(six) to study and introduce the development and experience of architectural education at home and abroad, and to carry out international academic exchange activities.
(seven) to carry out activities to create a learning organization in member units.
(eight) editing and publishing construction education publications and teaching materials.
(nine) to reflect the opinions and demands of the construction educators to the party and the government, and safeguard the legitimate rights and interests of the construction educators.
(ten) to commend and reward units and individuals that have made outstanding achievements in educational research, activities of this association and services for educational construction.
(eleven) the establishment of economic, technical and social service institutions in line with the purpose of this association. Actively participate in social welfare activities.
Article 7 The Association shall carry out its activities in accordance with the business scope stipulated in the articles of association, and adhere to the principles of honesty and self-discipline, honesty and trustworthiness, fairness and justice, no fraud and no harm to the legitimate rights and interests of the state, members and individuals.
Chapter III Members
Article 8 The members of this Association are mainly group members, that is, unit members, and a small number of individual members can be recruited as needed. The construction education associations of all provinces, autonomous regions and municipalities directly under the Central Government shall serve as members of the board of directors on the principle of voluntary participation.
Article 9 A member applying to join this Association must meet the following conditions:
(a) support the articles of association;
(2) Having the will to join this Association;
(3) Departments, enterprises, institutions and individuals with full capacity for civil conduct established according to law within the business scope of this Association.
Article 10 The membership procedure is:
(1) Submit an application for membership to the Association or its authorized organization (i.e. professional committee);
(two) discussed and adopted by the plenary meeting of the professional committee or the meeting of the Standing Committee;
(three) after consultation with the relevant departments and in line with my wishes, I was invited as an individual member with the consent of the executive Council meeting of the Association;
(4) Membership cards shall be uniformly distributed by the secretariat of this Association.
Article 11 Members shall enjoy the following rights:
The right to vote, to be elected and to vote;
(two) the right to participate in the activities of the association;
(three) to obtain the priority of our services;
(four) have the right to know, criticize, suggest and supervise the work of this association;
(5) the right to voluntarily join and freely withdraw.
Article 12 Members shall perform the following obligations:
(a) abide by the articles of association;
(two) to implement the resolutions of this Council;
(three) to safeguard the legitimate rights and interests of this association;
(four) to complete the work assigned by the association;
(five) to pay membership fees in accordance with the provisions;
(six) to reflect the situation to this Council and provide relevant information;
(seven) concerned about the work of the association, and actively participate in the activities of the association.
Article 13 A member who withdraws from the club shall notify the club in writing and return his membership card. If you don't pay the membership fee or participate in the activities of the association for two consecutive years without reason, it will be regarded as automatic withdrawal and the association will withdraw its membership card.
Fourteenth members who seriously violate the articles of association, after investigation by the secretariat of the association, report to the Council for approval and be removed from the list.
Chapter IV Organization and Person in Charge
Article 15 The organizing principle of this Association is democratic centralism. The composition of the leading group and the decision-making on major issues must be decided through collective discussion in accordance with the principle that the minority is subordinate to the majority.
Article 16 The person in charge of this Association refers to the president, vice-president and secretary-general.
Article 17 the secretariat of this association is an office.
Article 18 The highest authority of this Association is the members' congress, and its functions and powers are:
(a) to formulate and amend the articles of association;
(2) To elect and recall the directors of this Association;
(3) Hiring the honorary president of the Association;
(four) to review the work report and financial report of the Association;
(five) to discuss and decide on the working principles and major issues of this association.
Nineteenth members' congress can only be held when more than two thirds of the members' representatives are present, and its resolutions can only take effect when more than half of the members' representatives are present to vote. Member representatives may entrust an agent to attend the meeting, and the agent shall present the power of attorney and exercise the right to vote within the scope of authorization.
Article 20 If the term of office of a member congress is five years, and it needs to be changed or postponed in advance due to special circumstances, it must be voted by the board of directors, reported to the competent business unit for examination and approval, and approved by the registration authority of the association. The longest extension shall not exceed 1 year.
Article 21 The Council of the Association is the executive body of the general meeting of members, leading the Association to carry out its daily work during the intersessional period and being responsible for the general meeting of members. The directors shall be nominated by the previous Standing Council and elected by the current members' congress before taking office.
Article 22 The functions and powers of the Council of this Association are:
(a) to implement the resolutions of the members' congress;
(two) to elect and recall the chairman, vice chairman and secretary general;
(three) to listen to and consider the work report of the secretariat and check the work of the secretariat.
(four) to prepare for the convening of the members' congress;
(five) to report the work and financial situation to the members' congress;
(six) to decide to absorb or recall members;
(7) Deciding to establish offices, branches, representative offices and entities;
(eight) to decide on the appointment and removal of the Deputy Secretary General and the principal responsible persons of the branches;
(nine) to lead the work of the institutions of this Association;
(ten) to formulate internal management system;
(eleven) to decide on other major issues.
Article 23 The meeting of this Council shall be held only when more than two thirds of the directors are present, and its resolutions shall take effect only after being voted by more than two thirds of the directors present.
Article 24 The Council shall meet at least once a year. If the directors are unable to attend for some reason, they may entrust others to attend on their behalf, and the power of attorney shall specify the authorized matters. Under special circumstances, the Council can also be convened in the form of communication.
Article 25 The Association shall establish a standing council. The Standing Council shall be elected by the board of directors, exercise the functions and powers in Items (1), (4), (6), (7), (8), (9) and (10) of Article 22 when the board of directors is not in session, and be responsible to the board of directors. The number of managing directors shall not exceed 65,438+0/3 of the number of directors.
Article 26 The Standing Council shall be convened at least once every six months, and it may also be convened by means of communication under special circumstances.
Article 27 The chairman, vice-chairman and secretary-general of this Association must meet the following conditions:
(a) adhere to the party's line, principles and policies, good political quality;
(2) It has great influence in the business field of the Association;
(3) The chairman and vice-chairman shall not be over 70 years old. The post-holding age of the Secretary-General is generally not more than 60 years old, and may not be more than 65 years old with the approval of superiors according to work needs. The secretary-general is full-time.
(4) Being in good health and able to stick to normal work;
(5) Having not been subjected to criminal punishment of deprivation of political rights;
(6) Having full capacity for civil conduct.
Article 28 If the chairman, vice-chairman and secretary-general of the Association are over the maximum working age, they can take up their posts only after being approved by the Council, reported to the competent business unit for examination and approved by the registration administration organ of the Association.
Article 29 The term of office of the Chairman, Vice-Chairman and Secretary-General of this Association is 5 years. The term of office of the Chairman, the Vice-Chairman and the Secretary-General shall not exceed two terms. If it is necessary to extend the term of office due to special circumstances, it shall be approved by more than two-thirds of the members' congress, reported to the competent business unit for review and approved by the registration authority of the association before taking office.
Article 30 The president of this Association shall be the legal representative. Only after the registration management organ of the association reports to the competent business unit for examination and approval can it take up the post. The legal representative of this Association shall not concurrently serve as the legal representative of other organizations.
Article 31 The chairman of this Association shall exercise the following functions and powers:
(a) to convene and preside over the Council and the Standing Council;
(two) to check the implementation of the resolutions of the members' congress, the Council and the Standing Council.
(3) Signing relevant important documents on behalf of this Council.
Article 32 The Secretary-General of this Association shall exercise the following functions and powers:
(a) to preside over the daily work of the office and organize the implementation of the annual work plan;
(2) Coordinating the work of branches, representative offices and entities;
(3) Nominating deputy secretaries-general and full-time responsible persons of offices, branches, representative offices and units, and submitting them to the Council or the Standing Council for decision;
(four) to decide on the employment of full-time staff of offices, branches, representative offices and entities;
(five) report to the Council or the Standing Council;
(6) Handling other daily affairs.
Chapter V Principles of Asset Management and Use
Thirty-third sources of funds of the Association:
(1) membership fees;
(2) donation;
(3) government funding;
(4) Income from activities or services provided within the approved business scope;
(5) Other lawful income.
Article 34 The Association shall collect membership fees in accordance with the relevant provisions of the State.
Article 35 the funds of this association must be used for the business scope and career development as stipulated in the articles of association, and shall not be distributed among members.
Article 36 The Association shall implement the Accounting System for Non-profit Organizations, conduct accounting according to law, establish and improve the internal accounting supervision system, and ensure the legality, truthfulness, accuracy and completeness of accounting materials.
Article 37 An association shall be equipped with accountants with professional qualifications. Accounting personnel shall not concurrently serve as cashiers. Accountants must conduct accounting and exercise accounting supervision. When an accountant transfers his job or leaves his post, he must go through the handover procedures with the recipient.
Article 38 The asset management of this Association must implement the asset management system stipulated by the state. Accept the supervision of this bureau and relevant departments. If the source of assets belongs to the state appropriation or social donation or subsidy, it must accept the supervision of audit institutions and publish relevant information to the society in an appropriate way.
Article 39 Before changing its members or changing its legal representative, an association must accept the financial audit organized by the registration authority and the competent business unit of the association.
Article 40 The assets and other income of this Association are protected by law, and no unit or individual may occupy, privately divide or misappropriate them.
Article 41 The wages, insurance and welfare benefits of the full-time staff of this Association shall be implemented with reference to the provisions of relevant state institutions.
Chapter VI Procedures for Amending the Articles of Association
Forty-second amendments to the articles of association of this association must be approved by the Council or the Standing Council, and then reported to the members' congress for approval.
Article 43 The revised articles of association of the Association shall come into effect within 15 days after being approved by the members' congress, examined and approved by the competent business unit and reported to the registration administration organ of the Association.
Chapter VII Termination Procedure and Property Disposal after Termination
Article 44 If an association has fulfilled its purpose or is dissolved or needs to be revoked due to division or merger, the Standing Council shall propose a termination motion.
Article 45 The motion to terminate this Association must be voted by the members' congress and submitted to the competent business unit for examination and approval.
Forty-sixth before the termination of this association, a liquidation organization should be established under the guidance of the competent business unit and relevant authorities to clean up the creditor's rights and debts and deal with the aftermath. During the liquidation period, no activities other than liquidation will be carried out.
Article 47 An association shall be terminated after its registration is cancelled by the association registration authority.
Article 48 The remaining property after the termination of this Association shall be used for the development of undertakings related to the purposes of this Association under the supervision of the competent business units and the registration and administration organs of associations and in accordance with the relevant provisions of state organs.
Chapter VIII Supplementary Provisions
Article 49 The Articles of Association was adopted by the fourth member congress on September 22, 2008. Where the provisions of the Articles of Association are inconsistent with the national laws, regulations and policies, the national laws, regulations and policies shall prevail.
Article 50 The right to interpret the Articles of Association belongs to the Standing Council of the Association.
Article 51 The Articles of Association shall come into force as of the date of approval by the association registration authority.
