Measures for the issuance and management of qualification certificates for seismic safety evaluation (for Trial Implementation)
Chapter I General Provisions Article 1 These Measures are formulated in order to strengthen the management of seismic safety evaluation of engineering construction sites and ensure the quality of seismic safety evaluation. Article 2 The technical person in charge of the project who is engaged in the seismic safety evaluation of engineering construction sites within the territory of People's Republic of China (PRC) shall apply for the seismic safety evaluation qualification certificate (hereinafter referred to as the evaluation qualification certificate) in accordance with the conditions and procedures stipulated in these Measures, and carry out the seismic safety evaluation of engineering construction sites with the certificate. Article 3 Evaluation certificates are divided into Grade A and Grade B. ..

Engineering and technical personnel with Grade-A evaluation certificate can serve as project technical leaders for site seismic safety evaluation of engineering construction projects, technical transformation projects and development zone construction projects of various scales.

Engineering and technical personnel with Grade B "Evaluation Certificate" can be the project technical person in charge of seismic safety evaluation of provincial large and medium-sized construction projects, technical transformation projects and construction sites of development zones.

Article 4 The evaluation certificate shall be examined and issued by the State Seismological Bureau, and shall be subject to supervision and management. Chapter II Conditions and Procedures for Applying for Appraisal Certificate Article 5 A person who meets the following conditions may apply for a Class A appraisal certificate:

(a) engaged in seismic safety evaluation for more than five years and has a senior technical title.

(two) familiar with the technology and knowledge in this research field, master the advanced technology and development trend at home and abroad, can solve key engineering and technical problems.

(3) Undertaking the seismic safety evaluation of several major projects and independently compiling the seismic safety evaluation report.

(four) familiar with and master the regulations, standards and technical specifications on seismic safety evaluation issued by the State Seismological Bureau, and can be skillfully used in combination with practical work. Article 6 Anyone who meets the following conditions may apply for a Grade B assessment certificate:

(a) engaged in seismic safety evaluation for more than three years and with intermediate or above technical titles.

(two) to understand the technology and knowledge in this research field, absorb and adopt advanced technology at home and abroad, and solve more complicated engineering and technical problems.

(three) to undertake the seismic safety evaluation of large and medium-sized provincial engineering projects, and independently write the seismic safety evaluation report.

(four) to understand the laws, regulations, standards and technical specifications on seismic safety evaluation issued by the State Seismological Bureau, and to be able to apply them in practical work. Article 7 Procedures for applying for the Evaluation Certificate:

The personnel who apply for the evaluation certificate shall submit a written application report to the unit, receive the Application Registration Form for the Qualification Certificate for Seismic Safety Evaluation (hereinafter referred to as the Application Registration Form), fill it out according to the specified requirements, and submit it to the provincial earthquake department and the competent department of industry for signing the audit opinion. After the qualification examination of the National Seismic Intensity Evaluation Committee, it shall be issued by the State Seismological Bureau. Chapter III Assessment and Management of Certificates Article 8 Entrusted by the State Seismological Bureau, the National Seismic Intensity Assessment Committee formulates assessment contents and standards, and evaluates engineers and technicians who apply for certificates. Article 9 The validity period of the Appraisal Certificate is five years. Those who continue to engage in seismic safety evaluation after the expiration must re-apply for a certificate. Article 10 Invalidation, demotion and revocation of appraisal certificates.

If the holder leaves his post for more than one year, the original certificate will automatically become invalid. If it is found that the holder has one of the following acts or facts, the issuing authority may revoke or withdraw his certificate.

(a) the contents filled in the application registration form are inconsistent with the facts;

(2) Submitting false certification materials;

(3) Lending the Appraisal Certificate;

(four) beyond the scope of the "evaluation certificate" to undertake seismic safety evaluation;

(five) the evaluation quality is inferior;

(6) Failing to perform the appraisal contract;

(seven) do not implement the relevant laws, regulations and standards promulgated by the state and local governments. Article 11 The State Seismological Bureau shall regularly manage the evaluation certificates, establish a system of upgrading and demotion, and conduct irregular inspections on the holders. According to the inspection results, the holder shall be confirmed, downgraded or revoked. Some holders need to fill in the application registration form again because of the change of conditions, and after the qualification examination of the National Seismic Intensity Evaluation Committee, they will be issued with upgraded certificates. Twelfth "evaluation certificate" is lost, should immediately report to the unit and the State Seismological Bureau, and declared invalid. Re-fill in the application registration form and issue a new certificate after verification by the State Seismological Bureau. Thirteenth personnel who have not obtained the "Evaluation Certificate" in accordance with these provisions shall not be the technical person in charge of seismic safety evaluation of engineering construction sites. Article 14 If the conclusion of the evaluation report completed by the holder is improper or wrong, resulting in adverse effects and other losses, the holder shall be fined in addition to revoking his evaluation certificate and returning all the evaluation fees; If the consequences are serious, they should be held accountable. If the holder fails to perform the evaluation contract and causes losses, it shall be handled in accordance with the above provisions. Article 15 If the management personnel who audit and issue evaluation certificates practice favoritism, abuse their powers, neglect their duties, and violate the provisions of these measures, the unit leaders shall give criticism and education, administrative sanctions respectively according to the circumstances, and adjust their posts. If the case constitutes a crime, criminal responsibility shall be investigated according to law.
