Provisions of Shenyang Municipality on the Administration of Preschool Education
Article 1 In order to strengthen the management of preschool education, promote the development of preschool education, and ensure the healthy growth of preschool children, these Provisions are formulated in accordance with the Education Law of the People's Republic of China and the Law of People's Republic of China (PRC) on the Promotion of Private Education, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to preschool education and management and the work of preschool education institutions within the administrative area of this Municipality.

Preschool education as mentioned in these Provisions refers to the education of preschool children.

The preschool education institutions mentioned in these Provisions refer to kindergartens and other institutions that provide full-time, time-divided, boarding care and education for preschool children. Article 3 Social organizations and citizens are encouraged to establish pre-school education institutions according to law.

Encourage domestic and foreign organizations and individuals to support the development of preschool education in the form of donations. Article 4 People's governments at all levels shall strengthen their leadership over preschool education, comprehensively coordinate the development of preschool education, and incorporate preschool education into the national economic and social development plan of the region. Article 5 The municipal education administrative department shall be in charge of preschool education in this Municipality, and make overall planning and management of preschool education.

District and county (city) education administrative departments are responsible for the management of preschool education within their respective administrative areas, and supervise and guide all kinds of preschool education institutions.

Development and reform, finance, industry and commerce, prices, construction, planning, civil affairs, health, population and family planning, disabled persons' federations, women's federations and other departments shall, in accordance with the division of responsibilities, do a good job in relevant preschool education. Article 6 The site selection, architectural design, area quota, staffing, facilities and equipment of pre-school education institutions must meet the safety and health standards stipulated by the state. Seventh units or individuals to set up pre-school education institutions, should apply to the local district, county (city) education administrative department for registration and approval. The administrative department of education shall, within 20 days from the date of accepting the application, examine and approve those who meet the prescribed conditions, issue school licenses, and file with the municipal administrative department of education in accordance with the regulations.

After being approved by the administrative department of education, a private preschool education institution shall go through the legal person registration formalities with the civil affairs department in accordance with the relevant provisions.

Where a pre-school education institution changes its registered items or goes out of business, the sponsor shall go to the original examination and approval authority 1 month in advance to go through the formalities of change or closure. Article 8 The places of pre-school education institutions shall not be adjacent to places with noisy and dirty environment such as bazaars, public places of entertainment, hospitals, garbage and sewage treatment stations, or places that are not conducive to children's healthy physical and mental growth and endanger children's safety. Early education guidance centers cannot be located in office buildings, shopping malls, supermarkets and other places.

Pre-school education consulting service institutions that hold pre-school education and training shall apply to the administrative department of education in accordance with the provisions and apply for a school license. Ninth units or individuals applying for pre-school education institutions shall provide the following materials to the administrative department of education:

(a) the application and planning of preschool education institutions;

(2) Qualification certificates of promoters and legal persons;

(three) the articles of association of the preschool education institution and the list of the board of directors (or board of directors);

(four) the qualification certificates and health certificates of the faculty and staff;

(five) proof of real estate and site and necessary proof of funds;

(six) the fire safety certificate issued by the fire department and the certificate of the community or street office;

(seven) catering service license;

(8) Other necessary documents.

If a pre-school education institution is jointly organized, a joint school-running agreement shall also be submitted. Tenth pre-school education institutions according to the facilities, management level, quality of conservation education. Implement hierarchical management. The grade standard of preschool education institutions shall be jointly formulated by the municipal education administrative department and the municipal health administrative department. Eleventh pre-school education institutions should establish safety protection, health care and safety responsibility system to prevent the occurrence of food poisoning and infectious diseases, and ensure the personal safety and health of children. Such as food poisoning, epidemic situation of infectious diseases, accidental injuries, lost children, etc. , shall promptly report to the health, public security, education and other relevant departments. And take immediate emergency measures. Twelfth pre-school education places shall not set up dangerous facilities that threaten the safety of children; Do not use toxic and harmful substances to make games and teaching AIDS. Thirteenth pre-school education institutions should choose the contents and methods of conservation education in accordance with state regulations, and should take games as the basic activities.

Teachers and other staff of pre-school education institutions shall respect and care for pre-school children, and shall not discriminate, insult, abuse, intimidate, corporal punishment or corporal punishment in disguised form. Fourteenth pre-school education institutions, nursing, education, medical and other staff should meet the following conditions:

(a) the person in charge of pre-school education institutions and teachers should have graduated from preschool normal schools (including pre-school education majors in secondary vocational and technical schools) or above, and have obtained teacher qualifications;

(two) health care doctors should have the "kindergarten health care personnel qualification certificate";

(3) Nurses should have a high school education or above and have received vocational skills training for infants;

(4) Chefs should receive corresponding vocational skills training and obtain corresponding vocational qualification certificates;

(five) the staff of pre-school education institutions shall obtain a physical health certificate before taking up their posts. The staff of pre-school education institutions shall have a health examination once a year.

Patients with chronic infectious diseases and mental illness are not allowed to engage in preschool education.
