Classified employment and classified assessment

Chapter I General Provisions

Article 1 In order to improve the job classification of civil servants, establish a management system that conforms to the characteristics of professional and technical civil servants, improve management efficiency and scientific level, and build a high-quality professional civil servant team, these Provisions are formulated in accordance with the Civil Service Law and relevant laws and regulations.

Article 2 The term "professional and technical civil servants" as mentioned in these Provisions refers to civil servants who specialize in professional and technical work, provide technical support and guarantee for organs to perform their duties, and their duties are highly technical and low in substitutability.

Article 3 The management of professional and technical civil servants shall adhere to the principles of Party management of cadres, having both ability and political integrity, putting morality first, paying attention to performance, industry recognition, multi-channel development, professional construction, and paying equal attention to supervision, restraint and encouragement.

The management of professional and technical civil servants should adhere to the principles of openness, equality, competition and merit, and be carried out in accordance with the statutory authority, conditions, standards and procedures.

Article 4 The central competent department of civil servants shall be responsible for the comprehensive management of professional and technical civil servants throughout the country. The local competent departments of civil servants at or above the county level shall be responsible for the comprehensive management of professional and technical civil servants within their respective jurisdictions. The competent department of civil servants at higher levels shall guide the management of professional and technical civil servants at lower levels. The competent departments of civil servants at all levels shall guide the management of professional and technical civil servants at the same level.

Chapter II Post Setting

Article 5 The positions of professional and technical civil servants shall, according to the nature of work, professional characteristics and management needs, set up institutions or posts in organs whose main responsibilities are professional and technical work.

The scope of professional and technical civil servants' positions shall be determined by the central competent department of civil servants.

Article 6 An organ shall, according to its functions, the state administrative establishment and the scope of post setting determined by the central competent department of civil servants, formulate a post setting plan for its professional and technical civil servants, and determine the specific job responsibilities and qualifications of the posts.

Article 7 The positions of professional and technical civil servants in the central and state organs and their directly affiliated institutions shall be reported to the central competent department of civil servants for examination and approval; The post setting scheme for professional and technical civil servants of the organs below the provincial level and their directly affiliated institutions shall be audited by the competent department of civil servants at the provincial level and reported to the competent department of civil servants at the central level for the record.

Chapter III Positions and Levels

Article 8 Professional and technical civil servants shall be managed according to the job sequence.

Professional and technical civil service positions are divided into eleven levels. The general titles from high to low are: first-level director, second-level director, first-level senior supervisor, second-level senior supervisor, third-level senior supervisor, fourth-level senior supervisor, first-level supervisor, second-level supervisor, third-level supervisor, fourth-level supervisor and professional technician.

Article 9 The corresponding relationship between the positions and grades of professional and technical civil servants is as follows:

(9) Level 3 supervisors: Level 23 to Level 17;

(10) level 4 supervisor: level 24 to 18;

Article 10 The positions of professional and technical civil servants are generally approved according to a certain proportion of the positions of professional and technical civil servants, and the specific measures shall be formulated separately by the central competent department of civil servants.

Chapter IV Appointment, Removal and Promotion of Posts

Article 11 The appointment, removal and promotion of professional and technical civil servants shall be carried out by party committees (party groups) at all levels and their organizational (personnel) departments in accordance with the cadre management authority and in accordance with legal conditions and procedures.

Twelfth professional and technical civil servants should have the corresponding professional and technical qualifications, and meet the other requirements of the proposed post, in accordance with the professional and technical civil servants' job sequence, within the specified post setting range and post number.

Thirteenth professional and technical qualifications from high to low are advanced, intermediate and primary. Advanced includes positive advanced and deputy advanced.

First-class or second-class directors and first-class senior supervisors shall have all senior professional and technical qualifications; Two, three and four senior executives should have professional and technical qualifications at or above the deputy senior level; The first-level and second-level supervisors shall have professional and technical qualifications above the intermediate level; Where three or four supervisors and professional and technical personnel, should have primary or above professional and technical qualifications.

Measures for the evaluation of professional and technical qualifications shall be formulated separately by the central competent department of civil servants.

Article 14 A professional and technical civil servant who intends to be promoted to a post shall have the basic conditions such as ideological and political quality, working ability, education level, professional and technical qualifications, working years and working experience, and the annual assessment results within the specified working years are all qualified or above.

The length of service for promoting professional and technical civil servants shall be stipulated separately by the central competent department of civil servants.

Fifteenth professional and technical civil servants who are determined to be incompetent in the annual assessment shall be reduced by one grade in accordance with the relevant provisions of their posts.

Sixteenth professional and technical civil servants who are transferred from other posts or have their professional and technical qualifications cancelled shall be dismissed.

Seventeenth newly hired professional and technical civil servants who have passed the examination after the probation period and obtained the corresponding professional and technical qualifications shall be graded within the post level below the first-level supervisor according to the regulations.

Chapter V Management and Supervision

Article 18 The recruitment of professional and technical civil servants at the post level below the first-level supervisor shall be based on open examination, strict inspection, equal competition and merit-based admission.

The examination content is set according to the ideological and political quality, professional ability and different job requirements of professional and technical civil servants, focusing on the basic knowledge of professional technology and the ability to deal with practical problems with professional technology.

For professional and technical civil servant positions that are difficult to form competition due to special majors, other evaluation methods can be used to recruit civil servants.

Nineteenth according to the needs of the work, the organ may, in accordance with the relevant provisions of the civil service appointment system, implement the appointment system for some professional and technical civil servants.

Article 20 The assessment of professional and technical civil servants shall be based on the job responsibilities and professional and technical work undertaken, with a comprehensive assessment of morality, ability, diligence, performance and honesty, focusing on the assessment of work performance. The assessment results serve as an important basis for evaluating professional and technical qualifications.

Twenty-first professional and technical civil servants should receive initial training, specialized business training and on-the-job training, and the training content should focus on the professional and technical knowledge and skills necessary for their work.

Professional and technical civil servants should receive professional and technical training in accordance with the requirements of continuing education and the needs of knowledge renewal.

Article 22 Personnel engaged in professional and technical work in state-owned enterprises, institutions, people's organizations and mass organizations who have held deputy senior professional and technical positions for more than two years or have held full senior professional and technical positions may be transferred to the organs in accordance with the relevant provisions on the transfer of civil servants and hold positions at or above the fourth level senior supervisor in accordance with the recognized professional and technical qualifications.

Article 23 The transfer of professional and technical civil servants is generally carried out within the scope of professional and technical civil servants. Because of the need of work, it can also be carried out between different work categories.

Professional and technical civil servants transferred within the scope of professional and technical civil servants are generally transferred to the same professional post. Due to work needs, they can also be transferred to related or similar professional posts.

For civil servants who need to be transferred from other positions because of their work, they should generally have worked in professional and technical civil servants for five years, and determine their job levels through comparison in accordance with the management authority of cadres, taking into account their work experience, working years and other conditions.

Civil servants in other positions who are transferred to professional and technical civil servants shall have the professional and technical qualifications required for the transfer.

Twenty-fourth professional and technical civil servants implement a unified national salary system combining posts with grades, and implement a subsidy policy that reflects the characteristics of post responsibilities in accordance with relevant state regulations.

Article 25 The state encourages professional and technical civil servants to make inventions in their work and rewards those who have achieved remarkable economic or social benefits.

Those who have made outstanding contributions can be included in the assessment scope of special allowances of the State Council and local governments.

Qualified professional and technical civil servants can participate in the selection of major talent projects and scientific research projects of the central and local governments upon approval.

Article 26 professional and technical civil servants who commit fraud, neglect their duties, engage in malpractices for selfish ends and other violations of discipline and law shall be given criticism and education, organizational treatment or disciplinary action in accordance with relevant regulations; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twenty-seventh in any of the following circumstances, the leading organs at or above the county level or the competent department of civil servants shall, in accordance with the management authority, distinguish between different situations and order them to make corrections or declare them invalid; Responsible leaders and directly responsible personnel shall be criticized, educated, organized or disciplined according to the seriousness of the case; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) expanding the scope of professional and technical civil servants without authorization;

(two) the number of professional and technical civil servants;

(three) to relax the qualification conditions or change the professional and technical qualification evaluation standards without authorization;

(four) hiring, transferring, transferring and appointing in violation of the prescribed conditions and procedures;

(five) in violation of state regulations, changing the salary, welfare and insurance treatment standards of professional and technical civil servants;

(six) other acts in violation of regulations.

Chapter VI Supplementary Provisions

Twenty-eighth professional and technical civil servants who hold leadership positions, if there are other provisions in laws and regulations on their selection, appointment, management and supervision, shall be implemented in accordance with the relevant provisions.

Twenty-ninth professional and technical civil servants management, the provisions are not specified, in accordance with the Civil Service Law and its supporting regulations.

Thirtieth organs (units) engaged in professional and technical work with reference to the Civil Service Law shall be managed with reference to these Provisions with the approval of the competent departments of civil servants at or above the provincial level.

Article 31 The Organization Department of the CPC Central Committee, Ministry of Human Resources and Social Security and the State Civil Service Bureau shall be responsible for the interpretation of these Provisions.
