The technical supervision departments of all districts and counties are responsible for the supervision and management of product quality in their respective regions.
The competent departments of enterprises shall, according to their respective responsibilities, do a good job in the supervision and management of the quality of industrial products in this system.
Consumers' associations in this Municipality may conduct social supervision on the quality of industrial products according to law. Chapter II Product Quality Responsibility of Production Enterprises and Distribution Enterprises Article 4 Production enterprises and distribution enterprises shall establish or designate product quality management institutions, with full-time or part-time staff to strengthen product quality management. Article 5 The product quality of a production enterprise must meet the relevant quality standards of the state and this Municipality.
The product quality of production enterprises, where there is no national, industrial or municipal product quality standards, must meet the enterprise standards filed with the technical supervision department. Article 6 The products of production enterprises (including famous brand production enterprises) must meet the following conditions before leaving the factory:
(a) in accordance with the provisions of article fifth of these measures.
(2) Having a product inspection certificate.
(3) Product name, manufacturer's name, place of origin (address is required for important industrial products), specification, grade, model, production batch number, factory date and main technical indicators (or composition, content and weight) indicated in Chinese. Except for export products.
(four) the products used within a time limit must indicate the production time and expiration time.
(5) High-end durable consumer goods must have Chinese instructions. Except for export products.
(six) toxic, flammable, explosive and other dangerous goods must be marked with signs prescribed by the state on the internal and external packaging.
(seven) the products subject to production license, production license and quality certification shall have the license, production license and certification number and validity period.
The quality of export products sold to China must comply with the provisions of items 2 to 7 of the first paragraph of this article. If the quality of export products sold to China cannot meet the domestic standards, they shall be downgraded and reduced in price. Article 7 The production of new products involving personal safety and health must be inspected by the product quality supervision and inspection institutions at or above the municipal level or the inspection institutions designated by the technical supervision departments before they can be sold out of the factory. Article 8 The Municipal Bureau of Technical Supervision may, according to the needs of product quality supervision, implement the pre-factory inspection system for a few products and important agricultural means of production involving personal safety and health.
Before the sale, the distribution enterprise shall apply to the Municipal Bureau of Technical Supervision for inspection with the documents and relevant materials specified in Items (2) to (7) of Paragraph 1 of Article 6 of these Measures. After receiving the inspection application, the Municipal Bureau of Technical Supervision shall issue a notice of qualified products within three days; Among them, if the Municipal Bureau of Technical Supervision considers it necessary to carry out quality inspection, it shall issue a notice of inspection and acceptance within three days after making the conclusion of product quality inspection. Ninth distribution enterprises shall, when purchasing goods, check and accept the quality of products in accordance with the regulations. Article 10 The products distributed by distribution enterprises must conform to the provisions of Article 6 of these Measures. Eleventh consumers found unqualified products within the quality responsibility period stipulated by the production enterprise or distribution enterprise, the distribution enterprise shall be responsible for handling. The distribution enterprises must implement the "Three Guarantees" for the products that are guaranteed to be repaired, replaced and returned by the state and this Municipality or the dealers. During the warranty period, if the main performance faults of the three-guarantee products are repaired three times within six months and still fail to meet the quality standards, the distribution enterprise shall replace them or refund them.
If the unqualified products cause economic losses to consumers, the distribution enterprise shall compensate them. The unqualified product quality is caused by the production enterprise, and the distribution enterprise shall recover from the production enterprise. Twelfth prohibit the production and distribution of fake and shoddy products and other substandard products.
The counterfeit and shoddy products mentioned in the preceding paragraph refer to:
(1) Failure or deterioration;
(2) Endangering safety and personal health;
(three) the marked quality indicators are inconsistent with the actual situation;
(four) fraudulent use of high-quality products or quality certification marks;
(5) Doping, adulterating, filling the fake with the real or filling the old with the new;
(six) other fake and inferior products stipulated by the state and this Municipality. Thirteenth production enterprises and distribution enterprises shall not sell products that can not reach the level stipulated in the relevant standards, but still have the use value, and must clearly mark the words "processed products" on the products or packaging. Article 14 Organizers of large-scale exhibition activities such as product exhibitions shall strengthen the quality management of products on display, and shall not display fake and inferior products or other unqualified products.
If the quality of the displayed products is unqualified and the legitimate rights and interests of consumers are harmed, the organizers of the distribution activities shall bear joint and several liability when consumers cannot claim compensation from the distribution enterprises.
