Chapter I General Provisions

Article 1 These Regulations are formulated in accordance with the relevant provisions of the Constitution of People's Republic of China (PRC) and the Military Service Law of People's Republic of China (PRC).

Article 2 In order to strengthen the revolutionization, modernization and regularization of the China People's Liberation Army, facilitate the command and management of the army, and enhance the sense of responsibility and honor of officers, the system of ranks of officers shall be implemented.

Article 3 The ranks of officers refer to the titles and symbols that distinguish the ranks of officers, indicate their identity, and the honors conferred on officers by the state.

Article 4 The ranks of officers shall be divided into active ranks and reserve ranks according to the nature of their service.

Article 5 Officers with high ranks shall be higher than those with low ranks. When an officer with a high rank belongs to an officer with a low rank, the officer with a high rank is the superior.

Article 6 Officers in active service who are transferred to the reserve shall be labeled as "reserve". If an officer in active service retires, his rank shall be retained, and the rank shall be preceded by "Retired".

Chapter II Determination of Ranks and Grades of Officers in Active Service

Article 7 The ranks of officers are divided into the following three grades and ten grades:

(1) General officers: General, Lieutenant General and Major General.

(2) Senior colonel: senior colonel, colonel, lieutenant colonel and major;

Junior officers: captain, lieutenant and second lieutenant.

Article 8 The ranks of officers shall be divided according to the following provisions:

(1) Military, political and logistics officers:

Lieutenant general, major general, senior colonel, colonel, lieutenant colonel, major, captain, captain and second lieutenant.

The ranks of naval and air force officers are preceded by "Navy" and "Air Force" respectively.

(2) Professional and technical personnel:

Chapter III Establishment of Job Grades for Officers in Active Service

Article 9 The China People's Liberation Army implements the system of ranks of officers.

The chairman of the Central Military Commission does not confer military ranks;

Deputy regimental posts: lieutenant colonel and major;

Full-time posts: major, lieutenant colonel;

Deputy battalion commander: captain, major;

Company positions: captain, lieutenant;

Deputy company posts: lieutenant and captain;

Rank: second lieutenant, lieutenant.

Twelfth professional and technical officers to implement the following job grades and ranks:

Senior professional and technical positions: at least lieutenant general;

Intermediate professional and technical positions: senior colonel to captain;

Chapter iv conferring ranks on officers in active service for the first time

Article 13 Officers' ranks shall be conferred in accordance with their ranks.

Article 14 The conferment of military ranks shall be based on the officer's position, ability and political integrity, work performance, contribution to the revolutionary cause and military service experience.

Article 15 A person who holds the post of officer for the first time shall be awarded the first rank in accordance with the following provisions:

(a) graduated from a military secondary specialized school and awarded the rank of second lieutenant;

College graduates awarded the rank of second lieutenant, can be awarded in accordance with the relevant provisions of the General Political Department of China People's Liberation Army;

University graduates are awarded the rank of lieutenant, and in accordance with the relevant provisions of the General Political Department of the People's Liberation Army, they can be awarded the rank of second lieutenant;

Those who have obtained a master's degree shall be awarded the rank of captain, and in accordance with the relevant provisions of the General Political Department of the People's Liberation Army of China, the rank of lieutenant may be awarded;

If a graduate student has not obtained a master's degree, he shall be awarded the rank of lieutenant;

Those who receive a doctorate shall be awarded the rank of major, and may be awarded the rank of captain in accordance with the relevant provisions of the General Political Department of the People's Liberation Army of China.

(2) When soldiers are appointed as officers in wartime, the ranks shall be compiled according to the ranks of officers, and the corresponding ranks shall be awarded.

(3) Military civilian cadres and personnel from non-military departments who hold the posts of officers shall be given ranks according to the ranks of officers and be awarded corresponding ranks.

Article 16 The first conferment of the rank of officer shall be approved in accordance with the following provisions:

(1) General, Lieutenant General, Major General, Senior Colonel and Colonel shall be awarded with the approval of chairman of the Central Military Commission;

(2) Lieutenant Colonel and Major shall be awarded with the approval of the head of the People's Liberation Army headquarters, major military regions, arms and services or other units equivalent to military regions;

(3) Captains, lieutenants and second lieutenants shall be conferred with the approval of the heads of the group army or other units at the corps level that have the power to appoint and dismiss officers.

Chapter V Promotion of Ranks of Officers in Active Service

Article 17 Officers' ranks shall be promoted according to the following time limits:

(1) Time limit for promotion to the rank of officer in peacetime: second lieutenant is promoted to lieutenant, two years for those who have graduated from junior college or above, and three years for others;

Captain promoted to captain, captain promoted to major, major promoted to lieutenant colonel, lieutenant colonel promoted to colonel, colonel promoted to senior colonel, each for 4 years;

Promotion to the rank of senior colonel or above is based on the officer's position, ability and political integrity and contribution to national defense construction.

(2) The time limit for the promotion of officers' ranks in wartime may be shortened, and the specific measures shall be formulated by the Central Military Commission (CMC) according to wartime conditions.

The time spent by officers studying in institutions of higher learning is included in the period of rank promotion.

Article 18 The rank of an officer shall generally be gradually promoted within the prescribed time limit.

Article 19 If an officer's promotion expires, he/she violates military discipline and does not meet the promotion conditions stipulated by the Central Military Commission (CMC), his/her promotion will be suspended or he/she will be discharged from active service.

Article 20 If an officer's rank is lower than the lowest rank in the new post grade because of his post promotion, he shall be promoted to the lowest rank in the new post grade in advance.

Article 21 Officers who have made outstanding achievements in combat or work may be promoted ahead of schedule.

Twenty-second officers who were appointed as vice-chairmen and members of the Central Military Commission (CMC) were promoted to generals, and chairman of the Central Military Commission conferred the rank of generals.

Article 23 promotion to an officer post other than that specified in article 22 of this law shall be approved in accordance with the authority of appointment and removal of officers. However, the promotion of the ranks of the following officers shall be approved in accordance with the following provisions:

(a) deputy division (brigade) level officers promoted to senior colonel, professional and technical officers promoted to senior colonel, major general, lieutenant general, approved by chairman of the Central Military Commission;

(2) The promotion of professional and technical officers to colonel shall be approved by the heads of the PLA headquarters, major military regions, arms and services, or other units equivalent to major military regions;

(3) Where an officer at the deputy battalion level is promoted to a major, or a professional and technical officer is promoted to a major or lieutenant colonel, it shall be approved by the head of the group army or other units at the corps level that have the power to appoint and remove officers.

Chapter VI Demotion, Cancellation and Deprivation of Ranks of Officers in Active Service

Article 24 If an officer is transferred to a lower post because he is incompetent for his current job, and his post grade is higher than the highest grade in the new post grade, he shall be adjusted to the highest grade in the new post grade. The approval authority of the adjusted rank is the same as that of the original rank.

Article 25 Officers who violate military discipline may be demoted in rank according to the relevant regulations of the Central Military Commission (CMC). The authority to approve the demotion of a rank is the same as the authority to approve the first award of that rank.

The demotion of an officer's rank does not apply to second lieutenant officers.

Article 26 If an officer's rank is demoted, the time limit for his promotion shall be recalculated according to the demoted rank.

After an officer is demoted, his mistakes have been corrected and he has made remarkable achievements in battle or work, the time limit for promotion to the rank may be shortened.

Article 27 If a person is dismissed from his post and officer status, his rank as an officer shall be revoked. The authority to approve the abolition of an officer's rank is the same as that to approve the conferment of an officer's rank for the first time.

If an officer is expelled from the army, his rank shall be revoked. The power to approve the abolition of military ranks is the same as the power to approve the expulsion from the army.

Article 28 If an officer commits a crime and is sentenced to deprivation of political rights or fixed-term imprisonment of more than three years according to law, the court shall decide to deprive him of his rank. Retired officers who commit crimes shall be deprived of their ranks in accordance with the provisions of the preceding paragraph.

If an officer is deprived of his rank after committing a crime and needs to serve in the army after serving his sentence, it shall be handled in accordance with the provisions of Article 16 of these regulations.

Chapter VII Marks and Wearing of Ranks of Officers in Active Service

Article 29 The epaulettes, logo patterns and wearing methods of officers' ranks shall be promulgated by the Central Military Commission (CMC).

Article 30 The epaulettes and symbols worn by officers must conform to their ranks.

Chapter VIII Supplementary Provisions

Article 31 The rank system for reserve officers shall be formulated separately.

Article 32 The system of ranks of soldiers shall be formulated by the State Council and the Central Military Commission (CMC).

Article 33 The Chinese People's Armed Police Force implements the police rank system, and the specific measures shall be formulated by the State Council and the Central Military Commission (CMC).

Article 34 The General Staff Department and the General Political Department of the People's Liberation Army of China shall formulate implementation measures according to these Regulations, which shall be implemented after being approved by the Central Military Commission (CMC).

Article 35 These Regulations shall come into force as of the date of promulgation.
