What if the foster care power of attorney expires?
Legal Analysis: When the power of attorney for foster care expires, it is necessary to go through the formalities of notarization for foster care at the foreign notary office where the foster care person lives in Chinese mainland. If one or both of the entrusted adoptive parents cannot go through the formalities of foster care notarization in the prescribed foreign-related notarization institution, they shall apply for notarization of the Power of Attorney for Foster Children to the consular notarization institution in China of their country of residence in accordance with legal procedures. Please also pay attention to the temporary residence registration of foreigners in China and the extension of legal visas (residence permits).

Legal basis: Article 12 of the Measures for the Administration of Family Foster Care shall go through the following procedures to establish a family foster care relationship:

(1) application. The family that intends to carry out foster care shall submit a written application to the child welfare institution, and provide proof materials such as household registration book, copy of ID card, family income and housing situation, health status of family members and consistent application;

(2) evaluation. Children's welfare institutions shall organize professionals or entrust social work service agencies and other third-party professional institutions to conduct on-the-spot investigations on the applicant families, verify whether the applicant families have foster care conditions and parenting ability, understand their neighborhood relations, social contacts, criminal records, community environment, etc., and put forward evaluation opinions according to the survey results;

(3) review. Children's welfare institutions shall, according to the evaluation opinions, review the job-seeking families and report them to the competent civil affairs department for the record after determination;

(4) training. Child welfare institutions should train the main caregivers of foster families;

(5) sign a contract. Children's welfare institutions shall sign a foster care agreement with the main caregivers of foster families, specifying the foster care period, the rights and obligations of foster parents, the main caregivers of foster families, the foster care integration period, the liability for breach of contract and handling. The Family Foster Care Agreement shall come into effect as of the date of signature (seal) by both parties.
