The relevant departments of the State Council shall be responsible for railway safety management in accordance with the responsibilities stipulated by laws and the State Council. Article 4 The local people's governments at all levels along the railway and the relevant departments of the local people's governments at or above the county level shall, according to their respective functions and duties, strengthen the education on railway safety protection, implement the responsibility system for joint defense of road protection, prevent and stop acts endangering railway safety, coordinate and handle matters related to railway safety protection, and do a good job in railway safety protection. Article 5 Units engaged in railway construction, transportation, equipment manufacturing and maintenance shall strengthen safety management, establish and improve the safety production management system, implement the main responsibility of enterprise safety production, set up safety management institutions or equip safety management personnel, implement national standards and industry standards, ensure production safety and product quality and safety, strengthen the safety education and training of employees, and ensure the necessary capital investment for safety production.
The staff of railway construction, transportation, equipment manufacturing and maintenance units shall strictly implement the rules and regulations and carry out standardized operations to ensure railway safety. Sixth railway supervision departments, railway transport enterprises and other units shall formulate emergency plans in accordance with relevant state regulations and organize emergency drills. Article 7 It is forbidden to disturb the order of railway construction and transportation. It is forbidden to damage or illegally occupy railway facilities and equipment, railway signs and railway land.
Any unit or individual has the right to report the damage or illegal occupation of railway facilities and equipment, railway signs, railway land and other acts that affect railway safety to the railway supervision department, public security organs or other relevant departments. The railway transport enterprises and departments that have received the report shall handle it in a timely manner according to their respective responsibilities.
Units or individuals that have made outstanding contributions to the maintenance of railway safety shall be commended and rewarded in accordance with relevant state regulations. Chapter II Quality and Safety of Railway Construction Article 8 The survey, design, construction and supervision of railway construction projects and the procurement of building materials and equipment shall be subject to tender according to law. Article 9 Units engaged in survey, design, construction and supervision of railway construction projects shall obtain corresponding qualifications according to law and engage in railway construction activities within the scope permitted by their qualification grades. Article 10 Railway construction units shall select survey, design, construction and supervision units with corresponding qualification levels to carry out engineering construction, supervise and inspect the quality and safety of construction projects, and make inspection records for future reference. Article 11 The survey, design, construction and supervision of railway construction projects shall abide by the provisions of laws and administrative regulations on the quality and safety management of construction projects, and implement national standards, industry standards and technical specifications.
The survey, design and construction units of railway construction projects are responsible for the survey, design and construction quality according to law, and the supervision units are responsible for the construction quality according to law.
High-speed railways and railway construction projects with complex geological structures shall implement engineering geological investigation and supervision systems. Article 12 The safety facilities of a railway construction project shall be designed, constructed and put into use simultaneously with the main project. Investment in safety facilities should be included in the budget estimate of construction projects. Article 13 The materials, building components, equipment and other products used in railway construction projects shall conform to the compulsory national standards and industrial standards for product quality. Article 14 The construction period of a railway construction project shall be reasonably determined and adjusted according to engineering geological conditions, technical complexity and other factors, as well as national standards, industry standards and technical specifications.
No unit or individual may, in violation of the provisions of the preceding paragraph, require railway construction, design and construction units to shorten the construction period. Fifteenth railway construction project completion acceptance shall comply with the relevant provisions of the state, railway transport enterprises shall conduct operational safety assessment. Only those that pass the acceptance and evaluation and meet the operational safety requirements can be put into operation. Sixteenth railway construction projects in railway lines and their adjacent areas shall be carried out in accordance with the "Regulations on the Safety Management of Railway Business Line Construction". The railway construction unit shall, in conjunction with the relevant railway transport enterprises and engineering design and construction units, formulate a safe construction plan and implement the construction according to the plan. After the completion of construction, the site shall be cleaned up in time, and the safety of railway operation shall not be affected. Seventeenth new construction, renovation design speed10.20 km above the railway or the railway design capacity to meet the requirements of the the State Council railway industry supervision and management institutions, should set up interchange facilities.
If it is necessary to build or rebuild expressways, first-class highways or urban roads where expressways and railways cross, interchange facilities shall be set up, and priority shall be given to the scheme of underpassing railways.
Where the completed railways and highways are grade crossings under the circumstances specified in the preceding two paragraphs, they shall be gradually transformed into grade crossings.
If the newly-built or rebuilt high-speed railway needs to cross ordinary railways, roads, aqueducts, pipelines and other facilities, priority should be given to the high-speed railway crossing scheme.
