Regulations on safety production license

Article 3 The safety production supervision and management department of the State Council is responsible for the issuance and management of safety production licenses for non-coal mining enterprises, dangerous chemicals and fireworks production enterprises managed by the central government. The safety production supervision and management departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the issuance and management of safety production licenses for non-coal mining enterprises and dangerous chemicals and fireworks production enterprises other than those specified in the preceding paragraph, and accept the guidance and supervision of the safety production supervision and management departments of the State Council.

Article 6 An enterprise that has obtained a safety production license shall meet the following conditions for safety production: (1) Establish and improve the responsibility system for safety production, and formulate perfect rules and regulations and operating procedures for safety production; (two) the safety investment meets the requirements of safe production; (three) the establishment of safety management institutions, equipped with full-time safety management personnel; (four) the main person in charge and the safety production management personnel have passed the examination; (five) special operations personnel have passed the examination by the relevant competent departments and obtained the qualification certificate for special operations; (six) employees have received safety education and training; (seven) to participate in industrial injury insurance according to law and pay insurance premiums for employees; (eight) the factory buildings, workplaces and safety facilities, equipment and technology meet the requirements of relevant laws, regulations, standards and regulations on safety in production; (nine) there are measures for the prevention and control of occupational hazards, and the employees are equipped with labor protection articles that meet the national standards or industry standards; (ten) safety evaluation according to law; (eleven) there are major hazard detection, evaluation, monitoring measures and emergency plans; (twelve) there are emergency rescue plans for production safety accidents, emergency rescue organizations or emergency rescue personnel, equipped with necessary emergency rescue equipment and equipment; (thirteen) other conditions stipulated by laws and regulations.
