Article 1 In order to strengthen the management of administrative law enforcement certificates, promote strict and standardized fair and civilized law enforcement, and safeguard the legitimate rights and interests of citizens, legal persons and other organizations, these measures are formulated in accordance with the provisions of the Administrative Punishment Law of the People's Republic of China, the Regulations of Jilin Province on Administrative Law Enforcement and other laws and regulations, and combined with the actual situation of this province. Article 2 Administrative law enforcement officers of the administrative organs of this province, organizations authorized by laws and regulations and organizations entrusted by administrative organs according to law (hereinafter referred to as administrative law enforcement organs) shall obtain the Jilin Provincial Administrative Law Enforcement Certificate (hereinafter referred to as the Administrative Law Enforcement Certificate) issued by the people's Government of Jilin Province before they can engage in administrative law enforcement. Where laws, administrative regulations and rules of state ministries and commissions provide otherwise, such provisions shall prevail. Article 3 The legal institutions of the people's governments at or above the county level shall be responsible for the examination, issuance, supervision and management of administrative law enforcement certificates. The administrative law enforcement organs are responsible for the application, recycling and daily use management of administrative law enforcement certificates. Fourth administrative law enforcement certificate certification funds into the provincial budget, administrative law enforcement personnel qualification training, examination funds shall be guaranteed by all levels of finance. Fifth administrative law enforcement certificates shall meet the following conditions:

(1) On-the-job staff of administrative law enforcement organs;

(2) Having the cultural level and professional quality suitable for the post of administrative law enforcement;

(three) after the administrative law enforcement qualification training and examination;

(four) other conditions determined by the administrative law enforcement organs. Sixth administrative law enforcement personnel who meet the prescribed conditions shall apply for administrative law enforcement certificates from the legal institutions of the government at the same level by their administrative law enforcement organs. Seventh administrative law enforcement qualification training includes comprehensive legal knowledge training and professional legal knowledge training.

Comprehensive legal knowledge training is organized by the legal institutions of the people's governments at or above the county level; Professional legal knowledge training is organized by administrative law enforcement organs at all levels. Article 8 The legal institution of the provincial government shall organize the preparation of comprehensive legal knowledge test questions, establish a question bank, and make the test questions public on the portal website of the Legal Affairs Office of the People's Government of Jilin Province.

The legal institutions of the people's governments at or above the county level shall regularly organize comprehensive legal knowledge examinations. Conditional city (state) and county (city, district) shall adopt computer examination method and use the examination question bank established by the legal institution of the provincial government.

Professional legal knowledge examination is organized and implemented by administrative law enforcement organs at all levels. Ninth administrative law enforcement organs to apply for administrative law enforcement certificates, should fill in the electronic form of basic information of administrative law enforcement personnel compiled by the legal institution of the provincial government, and report to the legal institution of the government at the same level. After the approval of the legal institution of the government, it shall be submitted to the legal institution of the provincial government step by step. Tenth administrative law enforcement organs at all levels and the legal institutions of the people's governments at or above the county level shall strengthen the qualification examination of administrative law enforcement personnel, and prohibit the application and issuance of administrative law enforcement certificates for contract workers, temporary workers and public welfare posts. Eleventh administrative law enforcement certificates by the legal institution of the provincial government unified production, overprinter Jilin Provincial People's government administrative law enforcement certificates dedicated seal. Twelfth administrative law enforcement certificates shall specify the following items:

(a) the name, photo and work unit of the holder;

(two) the number and seal of the certificate;

(3) Categories and regions of administrative law enforcement;

(four) the validity period of the certificate, the annual inspection mark and the instructions for use;

(5) The QR code of the basic information of the holder. Thirteenth administrative law enforcement personnel engaged in administrative law enforcement activities, should take the initiative to produce administrative law enforcement certificates, identify themselves. Do not produce administrative law enforcement certificates, the administrative counterpart has the right to refuse its administrative law enforcement behavior. Article 14 The legal institution of the provincial government shall establish an information management system for administrative law enforcement personnel in the whole province, and citizens, legal persons and other organizations can obtain basic information of law enforcement personnel through the mobile phone inquiry system or scanning the QR code of documents. Fifteenth administrative law enforcement certificates are inspected once every three years, and those who pass the inspection are affixed with annual inspection marks. If the annual inspection label is not affixed at the expiration of the validity period, the certificate is invalid. Sixteenth administrative law enforcement personnel shall properly keep the administrative law enforcement certificates, and shall not alter or lend them to others. No unit or individual may forge, alter or print administrative law enforcement certificates without authorization. Article 17 If the post, law enforcement category and law enforcement area of administrative law enforcement personnel change, the administrative law enforcement organ to which they belong shall apply to the legal institution of the government at the same level for renewal of administrative law enforcement certificates. With the approval of the legal institution of the government, apply for a new certificate, recover the old one, and submit it to the legal institution of the provincial government step by step for the record. Eighteenth administrative law enforcement officers lost their administrative law enforcement certificates, and after being declared invalid by the administrative law enforcement organs to which they belong, they shall re-apply for administrative law enforcement certificates from the legal institutions of the government at the same level. Nineteenth administrative law enforcement personnel are no longer engaged in administrative law enforcement because of transfer, retirement, resignation, dismissal and other reasons. The administrative law enforcement certificate shall be recovered by the subordinate administrative law enforcement organ and submitted to the legal institution of the government at the same level, which shall be submitted to the legal institution of the provincial government step by step for the record. Article 20 If an administrative law enforcement officer engages in administrative law enforcement activities and commits any of the following acts, the administrative law enforcement organ at the same level or at a higher level or the legal institution of the government shall, depending on the circumstances, order him to make corrections, informed criticism or temporarily detain his administrative law enforcement certificate:

(1) Failing to show or refusing to show law enforcement certificates when performing official duties;

(two) to carry out law enforcement activities without the annual inspection of administrative law enforcement certificates;

(3) refusing to accept supervision and inspection;

(four) other acts in violation of laws, regulations and rules.
