The "Regulations on Safety Management" clearly points out that foreign-invested cooperative enterprises should provide overseas safety education and training for their dispatched personnel before going abroad in accordance with the principle of "whoever sends them is responsible".
The general contractor of the project shall take overall responsibility for the safety education and training of its subcontractors. Personnel without safety training shall not be dispatched. In addition, enterprises should put forward specific requirements for dispatched personnel, standardize the behavior of overseas personnel, and require them to abide by laws and respect local customs and habits.
A foreign-invested cooperative enterprise shall formulate an overseas safety management system, establish an emergency handling mechanism for overseas safety emergencies, and guide its dispatched offices to formulate safety precautions and emergency plans. At the same time, foreign-invested cooperative enterprises should require overseas institutions and personnel to conscientiously fulfill their social responsibilities, do a good job in environmental protection, solve local employment, actively participate in public welfare undertakings, and create a good external environment for foreign investment cooperation.
Background and purpose of issuing safety management regulations
In September 2005, the General Office of the State Council forwarded the opinions of the Ministry of Commerce and other three departments on strengthening the safety protection of institutions and personnel of overseas Chinese-funded enterprises, which played an important guiding role in protecting the safety of institutions and personnel of overseas Chinese-funded enterprises, promoting the sustainable development of foreign investment cooperation business and ensuring the smooth implementation of the "going out" strategy.
In recent years, with the rapid development of foreign investment cooperation business and the continuous expansion of its scale, the international situation faced by China enterprises "going global" is more severe and complicated. Traditional security factors and non-traditional security factors are intertwined, and international terrorist activities are increasingly rampant, which seriously threatens the safety of overseas Chinese-funded enterprises and personnel.
In this context, it is of great practical significance for the Ministry of Commerce and other departments to formulate the Regulations on Safety Management to strengthen the safety protection of institutions and personnel of overseas Chinese-funded enterprises under the new situation.
