On the one hand, cram schools recruit students by giving teachers kickbacks, which is unfair competition in business. If the circumstances are serious, it may constitute the crime of bribery by non-staff personnel. On the other hand, teachers share kickbacks for students to participate in the college entrance examination, which belongs to taking advantage of their positions and accepting bribes.
It is illegal to take kickbacks. Primary and secondary schools are not allowed to organize students to participate in any training courses on their own or in the name of short-term education and training institutions, and it is clearly stipulated that those who accept benefits in organizing students to make up classes shall be punished as commercial bribery.
