Enterprise staff training should implement the principle of teaching according to needs, combining learning with application, and directional training.
Article 5 The labor administrative departments of governments at all levels shall be responsible for the training of local enterprises and employees, and the comprehensive economic departments of governments at all levels shall be responsible for the training of local enterprise managers.
Article 6 The competent department of industry shall be responsible for guiding and coordinating the training of employees in this industry, formulating training plans for employees in this industry according to law, and organizing the preparation of training plans, outlines, teaching materials and training teachers for employees.
Seventh social organizations, mass organizations and public training institutions can voluntarily undertake the task of staff training according to the needs of enterprises.
Chapter II Responsibilities of Enterprises and Employees
Article 8 An enterprise shall establish and improve the rules and regulations for employee training, and provide employees with on-the-job training, job transfer training, promotion training and job transfer training according to the actual situation of the unit, and provide pre-job training for apprentices and other newly hired personnel.
Article 9 An enterprise shall incorporate employee training into its medium-and long-term and annual plans to ensure training funds and other training conditions.
Article 10 An enterprise shall incorporate staff training into the post objectives and economic responsibility system of the factory director (manager) and accept the supervision and assessment of the staff and workers' congress and the superior competent department.
Eleventh enterprises should combine the reform of employment and distribution system, and establish a system combining training, assessment, use and treatment.
Article 12 An enterprise shall pay basic salary, bonus and related welfare to employees who have been approved to participate in off-the-job training for less than half a year (unless otherwise agreed by both parties).
Thirteenth senior managers of large and medium-sized state-owned enterprises should participate in the qualification training of employees in accordance with the relevant provisions of the state, and obtain professional qualification certificates within the prescribed time limit.
Laborers engaged in technical jobs must go through technical level training, participate in employee skill appraisal, and obtain professional qualification certificates (technical level certificates) before taking up their posts.
Employees engaged in special operations must undergo training and examination in accordance with state regulations and obtain the qualification certificate for special operations before they can take up their posts.
Fourteenth employees who participate in full-time or non-full-time training funded by enterprises shall sign training contracts with enterprises.
The training contract shall specify the training objectives, contents, forms, time limit, rights and obligations of both parties and liabilities for breach of contract.
Fifteenth enterprises shall, in accordance with the provisions of the training contract, ensure the study time of employees, create the necessary learning conditions, and give full play to the professional knowledge they have learned.
Sixteenth employees should participate in training in accordance with the provisions of the state and enterprise arrangements, consciously abide by the rules and regulations of training, and have the obligation to pass on the knowledge and skills they have learned to other employees of the enterprise.
Seventeenth employees should fulfill the obligations stipulated in the training contract, obey the work arrangements of the unit, and do their jobs well.
Eighteenth enterprises funded (with payment vouchers) to carry out professional training of culture and technology for employees. When employees propose to terminate their labor relations with enterprises, the training contract has been executed according to the training contract; If no training contract is signed, it shall be implemented according to the labor contract. Disputes arising from training fees shall be handled in accordance with the relevant provisions of the state on the handling of labor disputes.
Chapter III Training Guarantee
Article 19 An enterprise may, according to needs, independently or jointly set up staff training institutions and report them to the competent department of the enterprise for the record, or entrust social public training institutions for training.
Twentieth enterprises should be equipped with full-time teachers and managers for staff training in accordance with the relevant provisions of the state.
Professional title evaluation, job appointment, promotion, salary adjustment, reward, housing and welfare of full-time teachers and managers of staff training should be treated equally with general education and teaching personnel or professional and technical personnel.
Twenty-first enterprises shall, in accordance with the following provisions of the state, extract and use staff training funds:
(1) Staff training funds are calculated according to 65,438+0.5% of the total wages of employees, and the enterprise's own funds can be used for staff training appropriately;
(two) staff training funds should be based on the needs of enterprises, reasonable arrangements for the proportion of staff skills training;
(three) the technical training fees used by enterprises for introducing projects and technological transformation projects can be charged in the project;
(four) the funds used by trade unions for the amateur education of employees shall be used by trade unions at all levels;
(five) the enterprise staff training funds should be used reasonably, and the balance of the current year can be carried forward to the next year.
Article 22 Enterprises may commend and reward factory directors, managers, staff training institutions and outstanding staff and workers who have made achievements in their posts.
Article 23 With the approval of the local people's government at or above the county level, the labor administrative department and the comprehensive economic department may levy a certain proportion of employee training funds on enterprises that fail to withdraw and use employee training funds and carry out employee training in accordance with state regulations, so as to organize joint training, or support public training institutions to undertake the task of employee training in enterprises that pay fees.
Chapter IV Punishment
Twenty-fourth enterprises in violation of these provisions, one of the following acts, by the labor administrative department of the government or the comprehensive economic department to give criticism and education to the directly responsible person and the legal representative of the enterprise, shall be ordered to make corrections:
(a) failing to organize employee training according to the provisions of the state;
(two) occupation of staff training school buildings, damage the legitimate rights and interests of training teachers or managers, affecting the normal training work;
(3) forcing untrained employees to work at their posts;
(four) do not use the training funds according to the provisions of the state or use the training funds for other purposes.
Twenty-fifth workers in violation of the provisions, one of the following acts, by the enterprise to give criticism and education, education refuses to correct, can be given administrative sanctions:
(a) do not obey the arrangement of the unit to participate in staff training without reason;
(two) a serious violation of the rules and regulations of the unit, disrupting the normal training of employees;
(three) the destruction of staff training schools and equipment.
Twenty-sixth enterprises and employees who fail to perform the obligations stipulated in the training contract shall bear the liability for breach of contract.
Twenty-seventh training institutions that undertake the task of staff training violate these regulations, and under any of the following circumstances, they shall be criticized and educated by the labor administrative department or the comprehensive economic department of the government. If the circumstances are serious, their training qualifications may be cancelled:
(A) the teaching management is chaotic, the training quality is not high, and the assessment quality is poor;
(2) Infringe on the rights and interests of the employees being trained, and the circumstances are serious;
(three) in violation of state regulations, arbitrary classes, arbitrary charges, arbitrary certification;
(four) interception, misappropriation of training funds.
Chapter V Supplementary Provisions
Twenty-eighth enterprise employees to participate in training to obtain nationally recognized academic qualifications and professional qualification certificates, should be implemented in accordance with the relevant provisions of the state.
Article 29 The Ministry of Labor and the State Economic and Trade Commission shall be responsible for the interpretation of these Provisions in accordance with the division of responsibilities.

Article 8 Training courses held by students from non-directly affiliated units transferred from different industries, provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning shall be reviewed and balanced by the Talent Development Department of the State Building Materials Bureau, and relevant matters can be handled only after the training plan reaches the competent departments of building materials industry in relevant provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning; Training courses held in provinces, autonomous regions, municipalities directly under the central government and cities under separate state planning shall be approved by the competent departments of building materials industry in provinces, autonomous regions, municipalities directly under the central government and cities under separate state planning.

Article 14 On-the-job training certificates for middle-level cadres in building materials enterprises owned by the whole people at or above the county level shall be uniformly printed by the State Building Materials Bureau. Except for the teacher classes and training pilot classes organized by the State Building Materials Bureau, certificates shall be mainly issued by the competent departments of building materials industries in various provinces and cities. The printing and issuance of the training certificate for general cadres in building materials enterprises shall be determined by the competent departments of building materials industry in all provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning.
Fifteenth technical level training of skilled workers in the building materials industry, by the provinces, autonomous regions, municipalities directly under the central government and cities under separate state planning, building materials industry departments and local labor departments agreed.
