Chapter I General Principles
Article 1 In order to strengthen and standardize coal mine safety training, improve the safety quality of employees, and prevent and reduce casualty accidents, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on Safety in Production, the Law of People's Republic of China (PRC) on the Prevention and Control of Occupational Diseases and other relevant laws and regulations.
Article 2 These Provisions shall apply to the safety training, assessment, certification, supervision and management of employees in coal mining enterprises.
The term "coal mining enterprises" as mentioned in these Provisions refers to enterprises engaged in coal resources mining activities within the legally approved mining areas, including group companies, listed companies, head offices, mining bureaus and coal mines.
The employees of coal mining enterprises mentioned in these Provisions refer to the principal responsible persons, safety production management personnel, special operations personnel and other employees of coal mining enterprises.
Article 3 The State Administration of Coal Mine Safety shall be responsible for guiding, supervising and managing the safety training for employees of coal mine enterprises throughout the country.
The competent departments of coal mine safety training of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the provincial competent departments of coal mine safety training) shall be responsible for guiding, supervising and managing the safety training of employees of coal mine enterprises within their respective administrative areas.
Provincial and below coal mine safety supervision institutions shall supervise the safety training of employees in coal mining enterprises within their jurisdiction according to law.
Article 4 Coal mining enterprises are responsible for safety training, and should educate and train employees in production safety according to law, so as to improve their awareness and ability of production safety.
The main person in charge of a coal mining enterprise is fully responsible for the safety training of its employees.
Article 5 The State encourages coal mining enterprises to change recruitment into enrollment. Coal mining enterprises that recruit new underground employees shall give priority to the employment of coal-related graduates from colleges, vocational high schools and technical schools.
Chapter II Organization and Management of Safety Training
Article 6 Coal mining enterprises shall establish and improve the safety training management system, formulate the annual safety training plan, specify the institutions responsible for safety training, equip full-time or part-time safety training management personnel, and draw funds for education and training according to the proportion stipulated by the state. Among them, the safety training funds shall not be less than 40% of the total education and training funds.
Article 7 Coal mining enterprises that meet the safety training requirements stipulated in the Basic Requirements for Safety Training Institutions (AQ/T80 1 1) shall give priority to self-training or entrust institutions with safety training conditions to conduct safety training.
Coal mining enterprises that do not have safety training conditions shall entrust institutions with safety training conditions to conduct safety training.
Institutions engaged in coal mine safety training shall report the situation of teachers, teaching, practice and training facilities in writing to the local provincial coal mine safety training department.
Eighth coal mining enterprises should establish and improve the safety training files of employees, and implement one file for each person. The contents of safety training files for employees of coal mining enterprises include:
(a) student registration form, including education level, position, title, work experience, skill level promotion and other contents. ;
(2) Copy of ID card and academic certificate;
(3) Previous safety training and assessment;
(four) records of illegal acts in production safety, and the situation of being investigated for responsibility, punished and dealt with;
(5) Other relevant information.
The archives of safety training for employees in coal mining enterprises shall be in accordance with the Provisions on the Filing Scope of Enterprise Documents and Materials and the Storage Period of Archives (DecreeNo. of the State Archives Bureau 10).
Article 9 Coal mining enterprises shall, in addition to establishing safety training files for employees, also establish enterprise safety training files, with one file for each period. The contents of safety training files of coal mining enterprises include:
(1) training plan;
(2) Training time and place;
(3) Training hours and teachers;
(4) course handouts;
(five) student roster, attendance and assessment;
(6) A comprehensive evaluation report;
(7) Other relevant information.
Coal mine enterprise safety training files of the main person in charge and safety production management personnel of coal mine enterprises shall be kept for more than 3 years, coal mine enterprise safety training files of special operators shall be kept for more than 6 years, and coal mine enterprise safety training files of other employees shall be kept for more than 3 years.
Chapter III Principal Responsible Persons and Safety in Production
Safety training and assessment of management personnel
Article 10 The main person in charge of a coal mining enterprise mentioned in these Provisions refers to the chairman, general manager, director of the Mining Bureau, mine manager and other personnel of the coal mining enterprise.
The term "safety production management personnel" as mentioned in these Provisions refers to the vice chairman, deputy general manager, deputy factory director, deputy mine manager, chief engineer and deputy chief engineer of coal mining enterprises, as well as the technical leaders of safety, coal mining, tunneling, ventilation, electromechanical, transportation, geological survey and dispatching, the leaders of safety production management institutions and their management personnel, and coal mining, tunneling, ventilation, electromechanical, transportation, geological survey and prevention.
Article 11 The mine manager, deputy mine manager, chief engineer and deputy chief engineer of a coal mine shall have a junior college degree or above in coal mine-related major, and have more than 3 years of coal mine-related work experience.
The person in charge of the coal mine safety production management institution shall have a technical secondary school degree or above in coal mine related majors, and have more than 2 years of work experience in coal mine safety production.
Twelfth coal mining enterprises should organize the main person in charge and safety production management personnel to carry out safety training on new laws and regulations, new standards, new regulations, new technologies, new processes, new equipment and new materials every year.
Article 13 The State Administration of Coal Mine Safety shall organize the formulation of assessment standards for safety production knowledge and management ability of main persons in charge of coal mining enterprises and safety production management personnel, and establish a national question bank.
The provincial department in charge of coal mine safety training shall, according to the assessment standards stipulated in the preceding paragraph, establish a provincial examination question bank and report it to the State Administration of Coal Mine Safety for the record.
Article 14 The assessment of the principal responsible person of a coal mining enterprise shall include the following contents:
(a) the national guidelines and policies on production safety and the laws, regulations, rules and standards related to production safety;
(two) the basic knowledge of safety production management, safety production technology and occupational health;
(3) Relevant regulations on major hazard source management, major accident prevention, emergency management and accident investigation and handling;
(4) Advanced experience in safety production management at home and abroad;
(5) Analysis of typical accidents and emergency rescue cases;
(six) other contents that need to be detected.
Fifteenth coal mine safety management personnel examination shall include the following contents:
(a) the national guidelines and policies on production safety and the laws, regulations, rules and standards related to production safety;
(two) safety production management, safety production technology and occupational health knowledge;
(three) casualty accident report, statistics and investigation and handling methods of occupational hazards;
(4) Contents and requirements of emergency management;
(5) Advanced experience in safety production management at home and abroad;
(6) Analysis of typical accidents and emergency rescue cases;
(seven) other contents that need to be detected.
Article 16 The State Administration of Coal Mine Safety is responsible for the assessment of the principal responsible persons and safety production management personnel of the headquarters of coal mining enterprises (including subsidiaries in Beijing) managed by the central government.
The provincial department in charge of coal mine safety training shall be responsible for the assessment of the principal responsible persons and safety production management personnel of coal mining enterprises other than those specified in the preceding paragraph within their respective administrative areas.
The State Administration of Coal Mine Safety and the provincial department in charge of coal mine safety training (hereinafter referred to as the assessment department) shall organize regular assessments and announce the assessment time in advance.
Article 17 The principal responsible persons and safety production management personnel of coal mining enterprises shall, within 6 months from the date of taking office, pass the assessment of safety production knowledge and management ability organized by the assessment department, and continue to maintain the corresponding level and ability.
The main person in charge of coal mining enterprises and the safety production management personnel shall, within 30 days from the date of taking office, submit an application for examination to the examination department in accordance with the provisions of Article 16 of these Provisions, and submit relevant materials such as employment documents, academic qualifications and work experience.
After receiving the application and materials from the main person in charge of the coal mining enterprise and the safety production management personnel, the examination department shall organize the corresponding examination in time if it meets the requirements after examination; If it is found that the applicant does not meet the requirements of Article 11 of these Provisions, the applicant shall not be tested for safety production knowledge and management ability, and the applicant and its coal mining enterprises or their appointment and removal organs shall be informed in writing to adjust their jobs.
Article 18 The examinations of the main persons in charge of coal mining enterprises and the personnel in charge of production safety shall be conducted by computer at designated test sites. The examination questions are randomly selected from the national examination question bank and the provincial examination question bank, and the proportion of examination questions in the national examination question bank accounts for more than 80%. Full score in the exam 100, and above 80 points are qualified.
The examination department shall publish the examination results within 5 working days from the end of the examination.
Article 19 After the main person in charge of the coal mining enterprise and the safety production management personnel pass the examination, the examination department shall issue a certificate of assessment of safety production knowledge and management ability (hereinafter referred to as the assessment certificate) within 10 working days from the date of publication of the assessment results. The examination certificate is valid throughout the country.
The main person in charge of the coal mining enterprise and the safety production management personnel fail to pass the examination, and can make up the exam once; If the make-up exam is still unqualified, you may not apply for assessment again within 1 year. The assessment department shall notify its coal mining enterprises or their appointment and removal organs to adjust their posts.
Twentieth assessment departments should conduct an assessment of the knowledge and management ability of production safety of the main person in charge and the management personnel of production safety in coal mining enterprises every three years.
Chapter IV Safety Training, Assessment and Certification of Special Operations Personnel
Twenty-first coal mine special operations personnel and their types of work shall be determined by the State Administration of Work Safety in conjunction with the State Administration of Coal Mine Safety, and adjusted in a timely manner; No other unit or individual may change its scope without authorization.
Article 22 Coal mine special operators shall have a junior high school education or above (new coal mine special operators shall have a senior high school education or above since June 1, 2065438), have relevant work experience in coal mines, or have relevant professional qualifications of vocational high school, technical school or technical secondary school or above.
Article 23 The State Administration of Coal Mine Safety shall organize the formulation of training plans and assessment standards for coal mine special operators, and establish a unified examination question bank.
The provincial department in charge of coal mine safety training is responsible for the examination and certification of coal mine special operators within their respective administrative areas, and may also entrust the department in charge of coal mine safety training of the municipal people's government with districts to implement the examination and certification of coal mine special operators.
The provincial competent department of coal mine safety training and the competent department of coal mine safety training of the municipal people's government with districts entrusted by it are hereinafter collectively referred to as the examination and certification department.
Twenty-fourth coal mine special operations personnel must pass the special safety technical training and examination, and the provincial coal mine safety training department issued the "People's Republic of China (PRC) special operation certificate" (hereinafter referred to as the special operation certificate), before they can take up their posts.
Twenty-fifth coal mine special operations personnel shall, before taking the qualification examination, carry out special training on safety production knowledge and practical operation ability in accordance with the prescribed training outline. Among them, the initial training time shall not be less than 90 hours.
Graduates who have obtained vocational high schools, technical schools or technical secondary schools or above are engaged in special operations corresponding to their majors. Those who hold academic certificates and are verified by the examination and certification department are exempted from initial training and directly take the qualification examination.
Twenty-sixth participants in the qualification examination for special operations in coal mines shall fill in the examination application form, and the applicant or the coal mining enterprise shall submit an application to the examination and certification department of his place of work or residence with a copy of his ID card, a copy of his education or a training certificate issued by a training institution. The examination and issuance department shall organize the examination within 60 days after receiving the application and related materials. If it does not meet the examination conditions, it shall inform the applicant or its coal mining enterprise in writing.
Twenty-seventh coal mine special operation qualification examination includes safety production knowledge examination and practical operation ability examination. After passing the safety production knowledge examination, the practical operation ability test shall be carried out.
The qualification examination for coal mine special operations shall be conducted at the specified test sites. The examination of safety production knowledge shall use a unified examination question bank, and the computer examination shall be adopted. The practical operation ability examination shall adopt the unified national examination standard. The perfect score in the exam is 100, and more than 80 points are qualified.
The examination issuing department shall publish the examination results within 10 working days after the examination.
If the applicant passes the examination, the examination and issuance department shall complete the certification work within 20 working days from the date of passing the examination.
If the applicant fails the exam, he can take it again; Those who fail the make-up exam shall re-participate in the corresponding safety technical training.
Twenty-eighth special operations operation certificate is valid for 6 years, valid throughout the country.
The style, standard and number of the special operation certificate shall be uniformly stipulated by state administration of work safety.
Article 29 If it is necessary to extend the renewal of the certificate of operation for special operations at the expiration of the validity period, the holder shall attend special training for not less than 24 hours 60 days before the expiration of the validity period, and submit an examination application to the local examination and certification department or the original examination and certification department by himself or his enterprise with the training certificate. Those who pass the examination of safety production knowledge and practical operation ability will be issued a new special operation certificate within 20 working days.
Thirtieth special operations personnel who have left the special operations post for more than 6 months, but the special operations operation certificate is still valid, and need to re-engage in the original special operations, should re-take the practical operation ability examination, and can only work at their posts after passing the examination.
Thirty-first special operation certificate is lost or damaged, it shall promptly submit a written application to the original examination and issuing department, which shall reissue it.
If the information recorded in the special operation certificate changes, a written application shall be submitted to the original examination and certification department, and it shall be updated after being examined and confirmed by the original examination and certification department.
Chapter V Safety Training and Assessment of Other Employees
Thirty-second other employees in coal mines should have junior high school education or above.
The term "other employees in coal mines" as mentioned in these Provisions refers to other employees engaged in production and business activities except the main person in charge of coal mines, safety production management personnel and special operations personnel, including other persons in charge of coal mines, other management personnel, technicians and workers in various positions, dispatched workers and temporary workers.
Article 33 Coal mining enterprises shall conduct safety training for other employees to ensure that they have the necessary knowledge, skills and emergency handling ability, and know their rights and obligations in safety production.
Thirty-fourth provincial coal mine safety training departments are responsible for formulating safety training plans and assessment standards for other employees in coal mining enterprises.
Thirty-fifth coal mining enterprises or institutions with safety training conditions shall conduct safety training for other employees in accordance with the training outline. Among them, the safety training for team leaders engaged in coal mining, tunneling, electromechanical, transportation, ventilation, water prevention and other work shall be organized and implemented by the coal mining enterprises at the next higher level in their coal mines; If there is no superior coal mining enterprise, it shall be organized and implemented by this unit.
The initial safety training time for other employees in coal mining enterprises shall not be less than 72 hours, and the annual retraining time shall not be less than 20 hours.
Coal mining enterprises or institutions with safety training conditions shall issue safety training certificates to other employees after passing the safety training; Those who have not been trained and obtained the training certificate are not allowed to work at their posts.
Article 36 Coal mining enterprises shall, after passing the safety training for new underground workers, practice for four months under the leadership of experienced workers' masters and obtain the internship qualification certificate signed by the workers' masters before they can work independently.
Generally speaking, a master worker should have a skill level above the intermediate level, have more than 3 years of corresponding work experience and have no illegal command, illegal operation or violation of labor discipline.
Article 37 Coal mining enterprises shall undergo corresponding safety training before adopting new technologies, new processes, new materials or using new equipment, and they may not take up their posts until they have passed the training.
Chapter VI Supervision and Administration
Article 38 The provincial department in charge of coal mine safety training shall publish on its website the assessment certificates of the main persons in charge of coal mining enterprises and safety production management personnel, and the issuance and cancellation of special operation certificates for special operators, and accept social supervision.
Thirty-ninth coal mine safety training departments and coal mine safety supervision institutions shall supervise and inspect the following situations of coal mine enterprise safety training, and shall be given administrative punishment according to law if illegal acts are found:
(a) to establish a safety training management system, formulate an annual training plan, designate an institution responsible for safety training management, and equip full-time or part-time safety training management personnel;
(two) in accordance with the provisions of the investment and use of safety training funds;
(three) the safety training conditions of coal mining enterprises that implement independent training;
(four) the safety training files of coal mining enterprises and their employees;
(five) the assessment of the main person in charge and the safety production management personnel;
(six) special operations personnel certificates;
(seven) the application of new technologies, new processes, new materials and new equipment, and the safety training of employees when they leave their posts or change jobs;
(8) Safety training for other employees.
