(a) law enforcement agencies authorized by laws and regulations to implement comprehensive administrative law enforcement in the cultural market and responsible to the people's government at the same level;
(two) law enforcement agencies entrusted by the relevant administrative departments to implement comprehensive administrative law enforcement in the cultural market, accept the guidance and supervision of the entrusting organ, and be responsible to the entrusting organ. Article 4 The comprehensive administrative law enforcement in the cultural market shall follow the principles of fairness, justice and openness, and establish an operational mechanism of administrative law enforcement with clear rights and responsibilities, standardized behavior, effective supervision and strong guarantee. Article 5 The Ministry of Culture is responsible for guiding the comprehensive administrative law enforcement work in the national cultural market, establishing a unified and perfect comprehensive administrative law enforcement system in the cultural market, building a technical supervision system in the national cultural market, strengthening the professionalization, standardization and informatization construction of the comprehensive administrative law enforcement team in the cultural market, and improving the performance appraisal of the comprehensive administrative law enforcement in the cultural market.
The relevant administrative departments shall, within their respective functions and powers, guide the comprehensive law enforcement agencies to carry out law enforcement business according to law.
Comprehensive law enforcement agencies at all levels shall be responsible for the comprehensive administrative law enforcement of the cultural market within their respective administrative areas in accordance with the division of responsibilities. Chapter II Law Enforcement Agencies and Law Enforcement Personnel Article 6 Comprehensive law enforcement agencies and relevant administrative departments shall establish a cooperation mechanism, grasp the basis, standards and relevant administrative licensing of administrative law enforcement in a timely manner, regularly report market trends and administrative law enforcement, and put forward policies or work suggestions. Seventh cultural market comprehensive administrative law enforcement personnel (hereinafter referred to as law enforcement personnel) shall meet the following conditions:
(1) Having China nationality;
(two) at least eighteen years of age;
(three) law-abiding, good conduct and good health;
(four) familiar with the laws and regulations of cultural market management, and master the business knowledge and skills required for cultural market management;
(5) Having no criminal record or being expelled from public office;
(6) Other conditions stipulated by laws and regulations.
The employment of law enforcement personnel shall be based on the relevant provisions of the Civil Service Law of People's Republic of China (PRC). Article 8 Law enforcement officers may not engage in administrative law enforcement until they have passed the on-the-job training and examination and obtained the Certificate of Comprehensive Administrative Law Enforcement in People's Republic of China (PRC) Cultural Market or the Certificate of Administrative Law Enforcement issued by the people's governments at all levels.
Comprehensive law enforcement agencies shall conduct business assessment on law enforcement personnel every year. Law enforcement officers who fail to pass the examination shall temporarily detain their law enforcement certificates. Article 9 Comprehensive law enforcement agencies shall provide professional training for law enforcement personnel in a planned way, and encourage and support law enforcement personnel to participate in on-the-job continuing education. Tenth comprehensive law enforcement organs should be equipped with special investigation and inquiry rooms, evidence preservation rooms and other facilities and equipment necessary for administrative law enforcement such as transportation, communication, evidence collection and testing; Buy personal accident insurance for law enforcement officers. Eleventh comprehensive law enforcement agencies should implement a regular job rotation system for law enforcement personnel. The continuous working hours of law enforcement officers in the same law enforcement post shall not exceed 5 years in principle. Twelfth relevant administrative departments or comprehensive law enforcement agencies may commend and reward comprehensive law enforcement agencies and law enforcement personnel who have made outstanding achievements in their work according to relevant regulations. Chapter III Law Enforcement Procedures Article 13 Comprehensive law enforcement agencies shall establish and improve the reporting system of 123 18 cultural market, publicize the reporting methods to the public, promptly and effectively accept and handle reports according to law, and give certain rewards to those who have made meritorious reports.
Illegal acts found in daily inspections or regular inspections, illegal acts reported by citizens, legal persons and other organizations, cases assigned by superiors, reported by subordinates or transferred by relevant departments shall be dealt with in a timely manner. Fourteenth 12 hours of major cases, the local comprehensive law enforcement agencies should report the case to the superior. The superior comprehensive law enforcement agency or the entrusting organ shall supervise the investigation and handling of major cases. Fifteenth cases of administrative violations in the cultural market shall be under the jurisdiction of the relevant administrative departments at or above the county level or comprehensive law enforcement agencies where the illegal acts occur. Where laws, regulations and rules provide otherwise, such provisions shall prevail. Disputes over jurisdiction shall be reported to the administrative organ at the same level and at the next higher level of * * * for designation of jurisdiction.
If it is found that the accepted case does not belong to its own jurisdiction, it shall be handed over to the relevant administrative departments and comprehensive law enforcement agencies with jurisdiction in time; If an illegal act is suspected to constitute a crime, it shall be transferred to judicial organs for handling according to law. Sixteenth law enforcement officers should dress appropriately and wear law enforcement signs when performing official duties according to law. Seventeenth comprehensive law enforcement agencies to carry out administrative law enforcement activities, should be strictly in accordance with the laws, regulations and the procedures prescribed in these measures, and make law enforcement documents according to law.
