Regulations of Chongqing Municipality on Police Auxiliary Personnel of Public Security Organs
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the relevant laws and administrative regulations and in the light of the actual situation of this Municipality in order to standardize the management of police auxiliary personnel in public security organs, ensure that police auxiliary personnel perform their duties according to law and safeguard their legitimate rights and interests. Article 2 These Regulations shall apply to the recruitment, use, guarantee and supervision of police auxiliary personnel of public security organs within the administrative area of this Municipality. Article 3 The auxiliary police of public security organs as mentioned in these Regulations (hereinafter referred to as auxiliary police) refers to non-people police personnel recruited for the society according to the development of social security situation and the actual needs of public security work, who provide auxiliary support for the daily operation and police activities of public security organs.

Auxiliary police are divided into civilian auxiliary police and service auxiliary police.

Social forces such as public security joint defense, public security volunteers, village protection teams and school protection teams, as well as personnel engaged in logistics services such as catering, security and cleaning in public security organs, do not belong to the auxiliary police. Article 4 The people's governments of cities, districts and counties (autonomous counties) shall incorporate the construction of auxiliary police into the national economic and social development plan, and include the wages, rewards, social security, equipment, clothing and training of auxiliary police into the government budget at the corresponding level for protection. Fifth city, county (Autonomous County) public security organs responsible for the recruitment, use, supervision and management of auxiliary police.

Institutions, finance, human resources and social security, retired military affairs and other departments shall, according to their respective responsibilities, do a good job in the management of auxiliary police. Article 6 The acts of auxiliary police in performing their duties according to law shall be protected by law, and relevant units and individuals shall support and cooperate with them.

The consequences caused by the performance of duties by the auxiliary police shall be borne by the public security organs. Chapter II Recruitment Article 7 The public security organs of cities, districts and counties (autonomous counties) shall, in conjunction with the establishment and financial departments at the same level, make overall consideration of local economic and social development, social security situation, actual population management and other factors in accordance with the principles of controlling the total amount, improving the quality and inclining to the grassroots, scientifically calculate the demand for police force, and reasonably verify the quota of auxiliary police personnel according to regulations, which shall be implemented after being approved by the people's government at the same level and reported to the public security organ at the next higher level for the record. Article 8 The recruitment of auxiliary police officers shall follow the principles of openness, fairness, competition and merit-based, and the recruitment conditions and procedures shall be strict. Article 9 An auxiliary police candidate shall meet the following basic requirements:

(1) Having China nationality;

(two) support the Constitution of People's Republic of China (PRC), abide by national laws and regulations, and have good conduct;

(3) over eighteen years old and under thirty-five years old;

(4) Having the working ability required to perform their duties, the civilian auxiliary police shall have a junior college degree or above, and the service auxiliary police shall have a high school degree or above;

(5) Having the physical conditions and psychological qualities required for the normal performance of duties;

(6) Other conditions stipulated by laws and regulations. Article 10 Anyone who is under any of the following circumstances shall not be recruited as an auxiliary police:

(a) subject to criminal punishment or suspected crime has not been closed;

(2) judicial custody, administrative detention;

(three) because of prostitution, gambling, public security management punishment or a history of drug abuse;

(4) Being dismissed from public office or military service, or being dismissed or dissolving labor relations due to serious violation of discipline and law;

(5) Being included in the list of serious untrustworthy subjects according to law;

(six) other circumstances that are not suitable for police assistance. Eleventh recruitment of auxiliary police should be unified procedures, through public recruitment announcement, registration, qualification examination, written examination, physical fitness test, interview, physical examination, inspection, publicity and other links, merit-based admission. Article 12 The following personnel shall be given priority in employment under the same conditions:

(a) the survivors of martyrs and soldiers, people's police and auxiliary police who died in the line of duty;

(2) Retired soldiers and rescuers who quit the national comprehensive fire rescue team;

(three) courageous people;

(4) graduates majoring in public security or law;

(five) personnel with professional qualifications and skills required for the post.

The first item of the preceding paragraph can be planned and targeted separately.

According to the needs of the work, special recruitment can be carried out for hard and remote areas, special positions and urgently needed talents. The specific measures shall be formulated by the municipal public security organ in conjunction with the municipal human resources and social security department. Thirteenth employed auxiliary police should establish labor relations according to the recruitment position. Chapter III Duties, Rights and Obligations Article 14 According to the arrangement of the public security organ, the civilian auxiliary police may engage in the following auxiliary police work:

(1) Administrative affairs such as clerical assistant, file management, wiring inquiry, window service, accepting applications, collecting, checking and inputting information;

(2) Psychological consultation, medical treatment, translation, computer network maintenance, data analysis, software research and development, safety monitoring, communication guarantee, fund analysis, non-confidential financial management, laboratory analysis, on-site investigation, inspection and appraisal, police dog training, barracks construction, new media operation and maintenance and other technical support work;

(three) the custody, maintenance, custody and management of police equipment other than weapons and police equipment;

(four) other work that can be assisted by civilian auxiliary police according to state regulations.
