Chapter IV Personnel Training and Occupational Safety Protection of Medical and Health Institutions Measures for the Administration of Medical Wastes
Medical waste related staff and management personnel shall meet the following requirements:

(a) to master the provisions of relevant national laws, regulations, rules and relevant normative documents, and to be familiar with the rules and regulations, work processes and work requirements of medical waste management formulated by this institution;

(two) to master the correct methods and operating procedures for the classified collection, transportation and temporary storage of medical wastes;

(three) to master the safety knowledge, professional technology, occupational health and safety protection of medical waste classification;

(four) to master the measures to prevent medical waste from stabbing and scratching in the process of classified collection, transportation, temporary storage and disposal, and the treatment measures after the occurrence;

(five) to master the emergency measures for the loss, leakage, diffusion and accidents of medical wastes. The main contents of supervision, inspection and spot check of medical and health institutions are:

(1) Rules and regulations on medical waste management and their implementation;

(2) Working conditions for classified collection, transportation, temporary storage and internal disposal of medical wastes;

(3) Registration materials and records related to medical waste management;

(four) in the management of medical waste, the safety protection of relevant personnel;

(5) Reporting, investigation and handling of medical waste loss, leakage, diffusion and accidents;

(6) On-site health monitoring. Medical and health institutions in violation of the "Regulations" and the provisions of these measures, in any of the following circumstances, the health administrative department of the local people's government at or above the county level shall order it to make corrections within a time limit and give a warning; If no correction is made within the time limit, a fine of 2,000 yuan to 5,000 yuan shall be imposed:

(a) the medical waste management system has not been established, or there is no monitoring department or full-time (part-time) staff;

(two) the relevant personnel have not received relevant legal and professional skills, safety protection and emergency treatment training;

(3) Failing to register the medical wastes or failing to save the registration materials;

(4) Failing to take occupational health protection measures for the personnel and management personnel engaged in classified collection, transportation, temporary storage and disposal of medical wastes within the institution;

(five) failing to clean and disinfect the used medical waste transport tools in time;

(six) the medical and health institutions that have built their own medical waste disposal facilities have not regularly tested and evaluated the sanitary effect of medical waste disposal facilities, or have not filed and reported the results of testing and evaluation. If a medical and health institution violates the Regulations on the Management of Medical Wastes and the provisions of these Measures in any of the following circumstances, the health administrative department of the local people's government at or above the county level shall order it to make corrections within a time limit, give it a warning and may impose a fine of not more than 5,000 yuan; If no correction is made within the time limit, a fine of 5000 yuan or more and 30 thousand yuan or less shall be imposed:

(1) The temporary storage places, facilities or equipment of medical wastes do not meet the hygiene requirements;

(2) Failing to classify medical wastes into special packages or containers;

(three) the use of medical waste transport does not meet the requirements. If a medical and health institution violates the Regulations on the Management of Medical Wastes and the provisions of these Measures in any of the following circumstances, the health administrative department of the local people's government at or above the county level shall order it to make corrections within a time limit, give it a warning and impose a fine of more than 5,000 yuan/kloc-0,000 yuan; If no correction is made within the time limit, a fine of 6.5438+0 million yuan and 30,000 yuan shall be imposed; Causing the spread of infectious diseases, the original issuing department shall temporarily suspend or revoke the practice license of medical and health institutions; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Discarding medical wastes in medical and health institutions, dumping or stacking medical wastes in non-storage places, or mixing medical wastes with other wastes and domestic garbage;

(2) handing over medical wastes to units or individuals that have not obtained business licenses;

(3) Failing to strictly disinfect sewage, excreta of patients with infectious diseases and patients suspected of infectious diseases in accordance with the Regulations and these Measures, or failing to meet the discharge standards prescribed by the state and being discharged into the sewage treatment system;

(4) Failing to manage and dispose of domestic garbage generated by patients with infectious diseases or suspected patients with infectious diseases according to medical wastes. These Measures shall come into force as of the date of promulgation.
