Regulations of People's Republic of China (PRC) Municipality on Sino-foreign Cooperation in Running Schools
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Education Law of the People's Republic of China, the Vocational Education Law of People's Republic of China (PRC) and the Education Promotion Law of the People's Republic of China for the purpose of regulating Sino-foreign cooperation in running schools, strengthening educational exchanges and cooperation with foreign countries and promoting the development of education. Article 2 These Regulations shall apply to the activities organized by foreign educational institutions and China educational institutions (hereinafter referred to as Chinese-foreign cooperatively-run schools) in China, with China citizens as the main enrollment targets. Article 3 Chinese-foreign cooperation in running schools is a public welfare undertaking and an integral part of education in China.

The state implements the policy of opening wider to the outside world, standardizing running schools, managing according to law and promoting development.

The state encourages the introduction of foreign high-quality educational resources and the development of Chinese-foreign cooperation in running schools. The State encourages Chinese-foreign cooperation in running schools in the fields of higher education and vocational education, and encourages China universities to cooperate with well-known foreign universities. Article 4 Chinese-foreign cooperatively-run schools and their legitimate rights and interests are protected by the laws of China.

Chinese-foreign cooperatively-run schools shall enjoy preferential policies prescribed by the state according to law and independently carry out education and teaching activities according to law. Article 5 Chinese-foreign cooperation in running schools must abide by the laws of China, implement China's educational policy, conform to China's morality, and shall not harm China's national sovereignty, security and social interests.

Chinese-foreign cooperation in running schools should meet the needs of China's educational development, ensure the quality of education and teaching, and devote itself to training all kinds of talents for China's socialist construction. Article 6 Chinese-foreign cooperatively-run schools may jointly establish educational institutions of all levels and types. However, institutions that implement compulsory education and special education such as military, police and politics may not be established. Seventh foreign religious organizations, religious colleges and religious personnel shall not engage in cooperative education activities in China.

Chinese-foreign cooperatively-run schools shall not engage in religious education or religious activities. Article 8 The administrative department of education of the State Council is responsible for the overall planning, comprehensive coordination and macro-management of Chinese-foreign cooperation in running schools nationwide. The education administrative department, labor administrative department and other relevant administrative departments of the State Council shall be responsible for the relevant work of Chinese-foreign cooperation in running schools within the scope of duties stipulated by the State Council.

The education administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the overall planning, comprehensive coordination and macro-management of Chinese-foreign cooperation in running schools within their respective administrative areas. The education administrative departments, labor administrative departments and other relevant administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, within the scope of their respective functions and duties, be responsible for the relevant Chinese-foreign cooperation in running schools within their respective administrative areas. Chapter II Establishment Article 9 An educational institution applying for the establishment of a Chinese-foreign cooperatively-run school shall have the status of a legal person. Article 10 Chinese-foreign cooperatively-run schools may invest in running schools with funds, physical objects, land use rights, intellectual property rights and other property.

The intellectual property investment of Chinese-foreign cooperatively-run schools shall not exceed one third of their respective investment. However, the intellectual property investment of foreign educational institutions invited by the administrative departments of education and labor in the State Council or the people's governments of provinces, autonomous regions and municipalities directly under the Central Government to jointly run schools in China may exceed 1/3 of their investment. Article 11 A Chinese-foreign cooperatively-run school shall meet the basic conditions stipulated by the Education Law of the People's Republic of China, the Vocational Education Law of People's Republic of China (PRC), the Higher Education Law of People's Republic of China (PRC) and other relevant administrative regulations, and be qualified as a legal person. However, Chinese-foreign cooperatively-run schools with higher education established by foreign educational institutions and institutions of higher learning with academic qualifications in China may not have legal personality.

The establishment of Chinese-foreign cooperatively-run schools shall be implemented with reference to the establishment standards of similar educational institutions at the same level held by the state. Article 12 An application for the establishment of a Chinese-foreign cooperatively-run school offering higher education at or above the undergraduate level shall be examined and approved by the education administrative department of the State Council; The application for the establishment of a Chinese-foreign cooperatively-run school offering higher vocational education and non-academic higher education shall be examined and approved by the people's government of the province, autonomous region or municipality directly under the Central Government where the proposed institution is located.

The application for the establishment of a Chinese-foreign cooperatively-run school offering secondary education, self-study examination, supplementary education and preschool education shall be examined and approved by the education administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government where the proposed institution is located.

The application for the establishment of a Chinese-foreign cooperatively-run school offering vocational skills training shall be examined and approved by the labor administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government where the proposed institution is located. Article 13 The establishment of a Chinese-foreign cooperatively-run school is divided into two steps: preparation and formal establishment.

However, those who meet the requirements for running a school and meet the set standards may directly apply for formal establishment. Article 14 To apply for the preparation for the establishment of a Chinese-foreign cooperatively-run school, the following documents shall be submitted:

(a) the bid report, which mainly includes: the Chinese-foreign cooperatively-run school, the name of the Chinese-foreign cooperatively-run school to be established, the training objectives, the scale of running a school, the level of running a school, the form of running a school, the conditions for running a school, the internal management system, fund raising and management, etc. ;

(2) Cooperation agreement, including: cooperation term, dispute settlement method, etc. ;

(three) the source of assets, the amount of funds and valid documents, and indicate the property rights;

(4) To donate school property, a donation agreement must be submitted, indicating the name of the donor, the amount, purpose and management method of the donated assets, and relevant valid documents;

(5) A certificate that the initial capital is not less than 65,438+05% of the capital invested by the Chinese-foreign cooperatively-run school.
