Jiangxi province fire regulations (revised on 20 10)
Chapter I General Provisions Article 1 In order to prevent fires and reduce fire hazards, strengthen emergency rescue work, protect personal and property safety, and maintain public safety, these Regulations are formulated in accordance with the provisions of the Fire Prevention Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the fire control work and related emergency rescue work within the administrative area of this province. Article 3 Fire control work shall follow the principle of giving priority to prevention and combining prevention with elimination, implement the responsibility system for fire control safety, and establish and improve a socialized fire control network in accordance with the principles of unified leadership of the government, supervision by departments according to law, overall responsibility of units and active participation of citizens. Article 4 People's governments at all levels shall, according to the needs of economic and social development, establish public security fire brigades, full-time fire brigades, volunteer fire brigades and other forms of fire fighting organizations, strengthen the training of fire fighting technicians, and improve the ability of fire prevention, fighting and emergency rescue.

The people's governments at or above the county level shall establish a comprehensive emergency rescue team based on the public security fire brigade and other superior professional emergency rescue teams.

Organs, organizations, enterprises, institutions and other units as well as village (neighborhood) committees shall establish full-time fire brigades and voluntary fire brigades according to the relevant regulations and the actual needs of fire control work. Article 5 People's governments at all levels shall be responsible for the fire control work within their respective administrative areas, and incorporate the fire control work into the national economic and social development plan to ensure that the fire control work is compatible with the economic and social development.

The people's governments at or above the county level shall incorporate the funds for fire control undertaking undertaken locally into the financial budget at the corresponding level, and gradually increase the financial input with the development of economy, the change of fire control tasks and the improvement of financial support capacity to ensure the needs of fire prevention and fighting.

The people's governments at or above the county level shall incorporate the funds needed for the construction and work of the comprehensive emergency rescue team into the financial budget at the corresponding level. The purchase of emergency rescue vehicles, equipment and materials shall be made by comprehensive emergency rescue teams at all levels, with reasonable demand plans and budgets and special financial arrangements at the same level. Article 6 The public security organs of the people's governments at or above the county level shall supervise and manage the fire control work within their respective administrative areas, and the fire control institutions of the public security organs of the people's governments at the corresponding levels shall be responsible for the implementation.

The fire control work of military facilities shall be supervised and managed by the competent units, and the fire control institutions of public security organs shall provide assistance; The fire control work of underground mines and nuclear power plants shall be supervised and managed by the competent units.

Where laws and regulations have other provisions on forest fire prevention, such provisions shall prevail. Seventh maintenance of fire safety is the responsibility of the whole society. All units and individuals have the obligation to protect fire control facilities, prevent fires and report fire accidents. All units and adults have the obligation to participate in organized fire fighting.

Encourage units and individuals to support fire public welfare undertakings. Article 8 People's governments at all levels shall organize and carry out regular fire prevention publicity and education to raise citizens' awareness of fire safety.

Organs, organizations, enterprises, institutions and other units should strengthen the publicity, education and training of fire prevention for their own personnel, and improve their ability to check and eliminate fire hazards, put out initial fires and organize evacuation and escape.

The public security organs and their fire control institutions shall strengthen the publicity of fire control laws and regulations, and urge, guide and assist the relevant units to do a good job in fire control publicity and education.

The competent departments of education, human resources and social security, schools and relevant vocational training institutions shall incorporate fire prevention, fire fighting and emergency escape into education, teaching and training.

Radio, television, newspapers, Internet sites and other media should actively set up fire safety education columns and carry out public welfare fire prevention publicity and education.

Trade unions, the Communist Youth League, women's federations and other organizations shall, according to the characteristics of their respective working objects, take various forms to do a good job in fire prevention publicity and education.

Village (neighborhood) committees shall assist the people's governments and public security organs and other departments to strengthen fire control publicity and education. Ninth people's governments at all levels and the relevant competent departments shall, in accordance with the relevant provisions of the state and this province, commend and reward the units and individuals that have made outstanding contributions in fire prevention, fighting and emergency rescue work. Article 10 Persons who are injured, disabled or killed in business training, fire fighting and emergency rescue shall be given work-related injuries, medical treatment and pension benefits in accordance with the relevant provisions of the state and this province. Chapter II Responsibility for Fire Control Safety Article 12 The principal responsible persons of people's governments at all levels shall bear overall leadership responsibility for fire control work, and the responsible persons in charge shall bear specific leadership responsibility for fire control work in their respective fields. Thirteenth people's governments at or above the county level shall perform the following fire duties:

(a) the implementation of fire laws, regulations and rules, the preparation of fire planning and organize their implementation;

(two) responsible for the construction of public fire control facilities, equipment, fire training bases and fire control organizations;

(three) the implementation of the responsibility system for fire safety, supervision and inspection of the relevant competent departments of the people's government at the same level and the people's governments at lower levels to perform their duties of fire safety;

(four) to organize the relevant competent departments of the people's government at the same level to carry out targeted fire safety inspections;

(five) to formulate fire accidents and comprehensive emergency rescue plans, organize emergency rescue of major fire fighting and other major disasters and accidents, and organize regular drills;

(six) other duties as prescribed by laws, regulations and rules.

Under the leadership of the people's governments at or above the county level, the fire safety committees of the people's governments at or above the county level regularly study, coordinate and solve major problems in fire control work within their respective administrative areas, and urge and guide all departments and units to perform their duties in fire control work.
