Legal analysis: When renting a house, both parties can sign a rental contract as long as they express their true meaning and do not violate the law. According to the Measures for the Administration of Commercial Housing Leasing, illegal buildings cannot be rented, that is to say, houses without real estate licenses can be rented if they are not illegal buildings.

Legal basis: Article 6 of the Measures for the Administration of Commercial Housing Leasing shall not be leased under any of the following circumstances:

(a) illegal construction;

(two) does not meet the mandatory standards for safety, disaster prevention and other engineering construction;

(three) in violation of the provisions to change the nature of housing use;

(four) other circumstances in which laws and regulations prohibit rental.
