(a) the preparation of liquefied gas medium and long-term development planning, reasonable setting up business outlets;
(2) Examining the qualifications of operators and issuing business licenses for hazardous chemicals;
(three) to guide and supervise business activities and investigate and deal with illegal business activities;
(four) responsible for the professional knowledge training and assessment of business personnel;
(five) in conjunction with the relevant departments of liquefied gas storage and distribution station (field) construction for fixed-point review and completion acceptance;
(six) to assist the price administrative department in managing the sales price of liquefied gas;
(seven) to assist the public security fire department to do a good job in the safety management of liquefied gas business;
(eight) to assist the public security fire control, technical supervision, labor and other administrative departments to investigate and deal with major liquefied gas accidents. Article 5 The administrative department in charge of commodity circulation of counties (autonomous counties and cities) shall be responsible for the operation and management of liquefied gas in their respective areas in accordance with the main responsibilities other than Item (2) of Article 4 of these Measures. Article 6 The relevant departments shall supervise and manage the liquefied gas industry according to their respective responsibilities. Seventh liquefied gas wholesale operators must meet the following conditions:
(a) there are liquefied gas storage and distribution stations (fields) that meet the requirements of national planning standards;
(2) Having a stable liquefied gas source that meets the national quality standards;
(3) Having technical management personnel at or above the intermediate level who are familiar with this major;
(4) It has funds suitable for its business scale;
(five) there are pressure vessels and their safety accessories that meet the requirements of the state;
(six) there are measuring instruments that meet the requirements of the state;
(seven) there are fire and explosion prevention facilities and their management systems;
(eight) a safety management system that meets the technical specifications and standards for fire control;
(nine) other conditions stipulated by laws, regulations and rules. Eighth liquefied gas retail operators must meet the following conditions:
(a) there are liquefied gas supply stations (points) that meet the network planning;
(2) Having storage facilities and business premises that meet the requirements of national standards;
(3) Having professional technical management personnel for liquefied gas;
(four) there are fire and explosion-proof facilities in line with national norms and their responsibility system and safety management system. Article 9 Units and individuals engaged in liquefied gas business shall apply for a business license for hazardous chemicals according to the following procedures:
(a) to apply for business to the local administrative department of commodity circulation in counties (autonomous counties and cities), and fill out the Application Form for Business License of Hazardous Chemicals;
(2) The local commodity circulation administrative department shall, within 10 days from the date of receiving the Application Form for Hazardous Chemicals Business License, conduct a preliminary examination together with the public security fire department and fill in the preliminary examination opinions, and report them to the municipal commodity circulation administrative department for examination and approval;
(three) the municipal administrative department of commodity circulation shall, within 10 days from the date of receiving the preliminary examination opinions, issue a business license for dangerous chemicals if it meets the conditions, and explain the reasons in writing if it does not meet the conditions.
Units and individuals engaged in liquefied gas business shall apply to the local administrative department for industry and commerce for a business license with the business license for hazardous chemicals. Article 10 It is forbidden to forge, transfer, lend, lease, buy or sell or alter the business license of dangerous chemicals. Article 11 Operators transporting liquefied gas shall apply to the transportation, public security and fire control departments for the Transport License for Dangerous Goods and the Transport License for Dangerous Chemicals on the strength of the Business License for Dangerous Chemicals. Article 12 The administrative department in charge of commodity circulation shall review the qualifications of liquefied gas operators every year, and those who pass the examination are allowed to continue to operate. Thirteenth operators should apply to the local commodity circulation administrative departments and relevant departments 30 days in advance. After the administrative department of commodity circulation withdraws the business license of dangerous chemicals, it shall go through the formalities of closing down the business at the administrative department for industry and commerce. Fourteenth operators shall abide by the following provisions:
(1) It is forbidden to directly fill liquefied gas cylinders with tank trucks;
(2) It is forbidden to dispose of residual liquid without permission, and it is forbidden to dump liquefied gas between liquefied gas cylinders. Filling liquefied gas and removing residual liquid must be carried out in the fixed facilities of liquefied gas storage and distribution station (field);
(3) Apply to an inspection unit with legal qualifications on schedule to inspect liquefied gas storage tanks, pressure pipelines, pressure gauges, tank trucks and gas cylinders, and establish complete equipment files;
(four) business premises to implement a one-point-one certificate, prohibit unlicensed operation;
(five) wholesale operators must check the "chemical dangerous goods business license" before they can supply gas to retail operators;
(6) Signing gas supply contracts with users and handling insurance procedures for users;
(seven) liquefied gas must be stored in a special warehouse, and the business outlets must store it in limited quantities;
(8) The residual liquid before filling a gas cylinder shall not exceed 0.5 kg, and the quality and measurement of the filled liquefied gas shall meet the standards stipulated by the administrative department of technical supervision;
(nine) employees must participate in training and assessment according to the relevant provisions of the state;
(ten) consciously accept the supervision and inspection of commodity circulation and relevant administrative departments;
(eleven) the implementation of the price of liquefied gas formulated by the price administrative department.
