Report on Legal Vocational Training in 2020 Part I

First of all, I would like to thank all the staff of xx Judicial Institute for their help and guidance in my internship, and thank you for your help and efforts in my smooth internship. From xx to xx, I worked as an intern in xx judicial office. Through internship, I gained practical work experience in the field of law, and consolidated and tested my knowledge level in law school for several years. Through practice, I understand the nature and tasks of grassroots judicial offices. Grass-roots judicial offices are the agencies of the county judicial bureau in the township people's government (street offices), and they are the functional departments that undertake the judicial administrative work of the township people's government (street offices), and work under the leadership of the county judicial bureau and the township people's government (street offices). Grassroots judicial offices comprehensively use people's mediation, legal publicity and education, law enforcement supervision, resettlement and assistance, legal services and other means to undertake a lot of basic work to implement the policy of governing the country according to law; It plays an important role in maintaining social stability at the grass-roots level, ensuring the development of market economy and promoting governance according to law. The specific tasks of grassroots judicial offices are:

1. Assist grass-roots governments to carry out legal governance and administrative law enforcement inspection and supervision;

2. Guide and manage people's mediation work and participate in mediation of major and difficult civil disputes;

3. Guide and manage grassroots legal work;

4 on behalf of the Township People's government (street offices) to deal with civil disputes;

5. Organize publicity and legal education;

6. Organize the transitional resettlement and assistance and education for released prisoners and those who have been released from reeducation through labor;

7. Participate in comprehensive management of social security;

8. Complete other related work assigned by the superior judicial administrative organ and the Township People's Government (street office).

During the internship, due to the shortage of judicial personnel, judicial work involves a wide range, the work is difficult, the working object is uncertain, and the working object is emotionally unstable. My internship can be said to be a mask, completely integrated into the judicial office and the staff in the office to do the daily judicial work according to their previous work plan. It mainly includes: popularizing law, guiding and managing grassroots people's mediation work, legal consultation, resettlement assistance, and participating in people's mediation work.

First, organize publicity and legal education.

Grassroots judicial offices are responsible for a lot of basic work to implement the policy of governing the country according to law, and publicity and legal education are the most basic work of judicial offices. The rule of law contains two basic principles, one is that the laws formulated are good laws, and the other is that the laws formulated are generally observed. Only through legal education can citizens understand the current laws and regulations in China and enhance their legal awareness, so that citizens can learn, know, understand and abide by the law.

During my internship, I learned from the cases I came into contact with at work that the grassroots people were seriously lacking in legal knowledge and legal awareness, and I deeply felt the importance and urgency of popularizing the law. During my internship, I carried out practical legal publicity work such as preparing legal lecture materials, making various publicity props and publishing legal wall newspapers. Faced with the worrying legal situation in rural areas, the work I did in my internship was so inadequate. We have to consider such a question: how should farmers' legal awareness be cultivated? With the development of economy, can legal awareness go up? I'm wondering whether we should spread our ideas about farmers and spread the law with our own voices. Popularizing law and legal education is a long-term task, which requires the continuous efforts of judicial workers.

Grassroots dispute mediation organizations generally have three levels, namely: town mediation center, district mediation station and village mediation Committee. The judicial mediation center in the town is a multi-level complex involving many departments (such as police station, family planning service station, industrial and commercial administration office, civil affairs office, letters and visits office, etc.). ), in which the judiciary plays a leading role. Adjusting and enriching the village mediation committee, improving the overall quality of the mediation committee team and ensuring the quality of mediation are all guided by the judicial office. During the internship, I participated in organizing members of the village mediation committee to study the Provisions of the People's Court on the Trial of Civil Cases Involving People's Mediation Agreements and the Filing of People's Mediation Files; Practical operation of filing files of people's mediation in judicial office. Some characteristics of grass-roots disputes are known from the filing of people's mediation files: first, the diversification of subjects; Second, the diversity of dispute types; Third, disputes often arise from trivial matters. Accumulated a certain knowledge reserve for future work.

Third, legal advice.

Providing legal advice and legal services is an important task of Huaifa Institute, but the work in this field is quite different in practice. Only one consultation on housing sales contracts may have a lot to do with the poor legal awareness of grassroots citizens. We can't relax or even slack off the grass-roots legal consultation work because of the lack of citizens' legal awareness, on the contrary, we should strengthen it. In the case that there is no legal service office at the grassroots level, the judicial office should explore how to provide legal services to the masses and help them solve problems. Only when citizens use the law to safeguard their rights and interests through personal experience can their legal awareness be further enhanced. Make them know and abide by the law and safeguard their legitimate rights and interests according to law.

Fourthly, resettlement and assistance.

Resettlement and assistance in education refers to a non-mandatory guidance, assistance in education, education and management activity under the unified leadership of the Party Committee and the government, relying on relevant departments and social forces to release prisoners and release them from reeducation through labor within a specified period of time. There are two meanings: one is to help educate released prisoners; The second is to provide transitional resettlement for prisoners before employment.

During the internship, I mainly did some resettlement and education work: first, I filed files for the released prisoners in the town; The second is to check and implement the work of helping and educating; The third is to conduct telephone review and help and educate the released prisoners who go out to work.

As a special group of society, released prisoners are more difficult to face life than ordinary people. In contact with them, I found that none of them want to be excluded from society, but their hearts are actually very fragile. They need more care, and social inclusion is their desire; Social justice is their urgent expectation. It is through their own efforts that resettlement education helps released prisoners to reduce the obstacles to returning to society. Let them turn over a new leaf, turn over a new leaf, reduce the probability of crime and eliminate social unrest. They paid a heavy price for their mistakes, and they atoned for their crimes. They are equal to us before the law. Why should we exclude them?

Verb (abbreviation of verb) participates in people's mediation.

People's mediation refers to an autonomous activity in which people use their own strength to educate themselves, manage themselves and serve themselves. Under the auspices of the People's Mediation Committee, according to laws, regulations, rules, policies and social ethics, mediate and persuade the two sides to promote mutual understanding, negotiate on an equal footing, reach an agreement voluntarily and eliminate disputes. Guiding and managing people's mediation and participating in the mediation of major and difficult civil disputes is one of the important tasks of the judicial office. The leading role of the judicial office in grassroots people's mediation is mainly reflected in: solving contradictions between cadres and the masses and various hot and difficult issues according to law, and mediating civil disputes; To guide the work of village-level coordination committees; Solve the contradictions and disputes across regions and industries; Carry out various forms of publicity and education on popularization of law and legal system; Solve contradictions and disputes, set up a coordination plan, combine adjustment and prevention, and implement coordination measures; Take on the difficult problems assigned by superiors and ensure that the problems are solved in towns and villages.

Eliminate contradictions and disputes in the bud and maintain social stability and harmony. Every month, the judicial office will carry out regular contradiction mediation in the whole town. During my internship, I had the honor to participate in the routine contradiction investigation and mediation work of the judicial office once a month. In the investigation of contradictions in the whole town, I also participated in the people's mediation work. At work, I found that the contradictions and disputes at the grassroots level mainly focus on: marriage and family, property debts, neighborhood relations and so on. The main reason is ignorance of legal knowledge, and contradictions and disputes will often be solved after understanding relevant legal knowledge. For this reason, I am thinking: What kind of laws do rural areas want? What can we do to send France to the countryside? Send criminal law and economic law? Send the most needed laws and regulations that are closely related to the people's own production and life.

Through internship, I also mastered some methods and skills of people's mediation. First of all, we should master legal knowledge systematically and have a wide range of knowledge to deal with all kinds of complicated contradictions and disputes; Secondly, in the mediation work, it is necessary to be affectionate and legal; Furthermore, the time, place, person, plot and reason of a dispute are the five elements of a civil dispute. Understanding and mastering these five elements in time is the basis and premise of doing a good job in mediation of various civil disputes. It can also be said that mastering these five elements is the most basic and key skill in mediating civil disputes.
