Measures for the Administration of Expert Database of Environmental Impact Assessment Review (202 1 Amendment)
Article 1 These Measures are formulated in accordance with the Environmental Impact Assessment Law of the People's Republic of China in order to strengthen the management of the expert database for environmental impact assessment review and ensure the fairness and impartiality of the review activities. Article 2 These Measures shall apply to the establishment and management of the expert database for environmental impact assessment review (hereinafter referred to as the expert database). Article 3 The expert database is divided into national databases and local databases.

The National Library is established and managed by the Ministry of Ecology and Environment. Local libraries shall be established and managed by the competent administrative department of environmental protection of the local people's governments at or above the municipal level. Article 4 An expert database shall meet the following conditions:

(a) in line with the requirements of professional and industrial classification of environmental impact assessment and review experts;

(2) Having the necessary facilities and management system software for randomly selecting experts; Article 5 Experts selected into the expert database shall meet the following conditions:

(1) Having deep attainments in this major or industry, and being familiar with the domestic and international situation and trends of this major or industry;

(two) adhere to the principle, decent style, can perform their duties seriously, objectively and fairly;

(three) familiar with the relevant laws, regulations and policies of the state, and master the technical specifications and requirements of environmental impact assessment and review;

(four) with senior professional titles, engaged in related professional work for more than five years;

(five) healthy, able to undertake the examination work. Article 6 When an expert is selected into the expert database, he shall apply to the competent administrative department of environmental protection that established the expert database (hereinafter referred to as the establishment department) through personal application or unit recommendation. Where the recommendation method is adopted, the unit shall obtain the consent of the recommended person in advance.

Personal application and unit recommendation shall be accompanied by certification materials that meet the conditions stipulated in these Measures. Article 7 The compiling department shall publish the information and conditions for the selection of expert database; Select the applicant or recommender, and solicit the opinions of relevant industry authorities and other relevant departments or experts as needed; For qualified applicants or referees, it is decided to be selected into the expert database and published.

Experts with special needs, approved by the establishment department, can be directly selected into the expert database. Eighth experts to participate in the special planning environmental impact report review group shall be randomly selected from the list of experts in the expert database according to the professions and industries involved. Article 9 The experts participating in the evaluation team shall earnestly perform their duties in a scientific, realistic and responsible manner, put forward the evaluation opinions objectively and fairly within the prescribed time limit, and be responsible for the evaluation conclusions.

Experts participating in the evaluation team have an interest in the institutions that provide technical services for environmental impact assessment. If the situation may affect the fairness of the evaluation, they should take the initiative to avoid it. Tenth experts to participate in the evaluation team have the right to express their opinions independently according to the division of labor and requirements of the evaluation team, without interference from any unit or individual. Article 11 The compiling department shall establish archives for the experts selected into the expert database.

The preparation department shall implement dynamic management of the expert database, make adjustments every 2 years, and publish the adjustment results. Twelfth experts selected into the expert database in any of the following circumstances, shall be given a warning by the preparation department; If the circumstances are serious, it shall be disqualified from being selected into the expert database and announced:

(a) irresponsible, fraudulent, or other objective and unfair performance of examination duties;

(two) without justifiable reasons, not to participate in the assessment work more than twice as required;

(3) Having an interest in an institution that provides technical services for environmental impact assessment, which may affect the fairness of the review and does not voluntarily withdraw;

(four) the disclosure of technical secrets, commercial secrets and other circumstances that are not suitable for publicity;

(five) accepting property or other benefits from others, which affects the objective and fair performance of the examination duties.

If the circumstances specified in the preceding paragraph violate the relevant laws and administrative regulations of the state, legal responsibilities shall be investigated according to law. Thirteenth these Measures shall come into force as of September 6, 2003 +0.
