The "minimum consumption" clause exists in the society, occupies an increasing proportion and plays an important role. However, it has brought a lot of controversy. On the one hand, it supports the view of "minimum consumption" in commercial utilization, on the other hand, it says that "minimum consumption" infringes on the interests of consumers. Here, the author mainly demonstrates the rationality and legitimacy of the existence of the "minimum consumption clause" from the perspective of civil law, sociology of law and freedom of contract, and further discusses the limitations and suggestions behind the "minimum consumption clause" through legislation.
