If you mean the patent application by "issuing patent", it depends on whether the duplicate checking date of your paper is after the publication date of the invention patent application. A general application for a patent for invention will be made public after 18 months from the date of filing (priority date refers to priority date), as long as you don't make a request for early disclosure. You should apply for a patent before publishing an article. Long-term publication of a patent application will generally not destroy the novelty of the article, but short-term publication of the article will destroy the novelty of the patent application.
