On the Construction of Rule of Law in China
Drawing lessons from the wisdom of the ancients and perfecting modern management, I learned the book Han Feizi this month and got a clearer understanding of the core of ancient legalist thought that was not very clear at first. I admire the wisdom of my ancestors, but I can't help sighing that Chinese civilization has thoroughly analyzed human nature and social laws for a long time, but it can't escape the fate of history: from the Opium War to War of Resistance against Japanese Aggression, it suffered a series of national disasters and humiliation, but it didn't leap over the history of industrial revolution and information revolution in time, which is a satire on the wisdom of China people.

Sinology began in the Spring and Autumn Period, gradually disappeared after the May 4th Movement, and never recovered. Up to now, ideas from the West have been dominating China's political and economic life, including capitalism, socialism, commodity economy, market economy and even refined management. However, China people are more complicated, and China people's lives are multifaceted. Obviously * * * productism is dominated by brothers and sisters in private. As for the socialist ideal, it is possible on the surface, but in practice, only big brother is the direction. As a result, the law in the real life of modern China still has a strong legalist color, and it is a bit from "Confucianism outside the country" to "Confucianism outside the country"

I think this is the background factor of many problems encountered by modern western management in the process of localization in China. Essentially, it is an ontological conflict between Chinese and western cultures. When foreigners first came in, people in China thought foreigners were a bit silly: always say hello when you meet someone, who cares! Everything you say is true, that's polite, that's just for fun, understand! Do you have to get to the point? Don't you understand something outside the vernacular? Foreigners look so superficial, so real, so awkward. In fact, this shows that the essence of western culture is to clearly distinguish between man and nature, and what should be understood must be understood. One is one, one is two. This attitude made westerners launch the industrial revolution and took a big step on the road of conquering nature. China people are not, one is one, but one may be two, depending on how to understand how to behave. Therefore, the essence of China culture is to thoroughly understand people: people are a changeable balance, so we should always grasp people's hearts, grasp people's hearts, the world is yours, and the most difficult things must be rammed out by manpower! It is certainly inefficient to look at things in this way of thinking.

In view of the management of human nature, legalists put forward their view of rule of law: there are both explicit laws that make people believe in their rewards and punishments, and hidden art in their hearts, that is to say, the core of the whole rule of law is to govern people, to be precise, to serve the autocratic monarchy. Legalist rule of law came into being under the specific historical conditions of transition to feudal monarchy.

The purpose of modern western legal system is also to govern people, but its starting point is quite different from that of legalists, and its purpose is to govern human society. The modern legal system, which originated from the Renaissance and the Enlightenment, regards human society as an objective entity and realizes that this law should not only govern human society, but also aim at its well-being, which conforms to the law of natural development. Therefore, the western legal system has not racked its brains to think about how to let a person govern a society according to the hierarchical system from the beginning.

Whether our legal system is good or our management is good, the dilemma we are facing now is to combine these two diametrically opposite ways of thinking, because everyone does not accept the seriousness of western things in their daily personality thinking, so everyone will feel it. Then only in line with the concept of legal system to locate a harmonious society, in line with the concept of refined management to build a family-style enterprise team. This kind of construction requires everyone in the team to be meticulous about themselves and him within the scope of their duties, and to communicate harmoniously in private. They are brothers on the mountain. Life is really hard to ask for this height! However, reality requires leaders to do so.

I think this progress will eventually change to the road of modern management, just as the "Westernization Movement" will eventually be abandoned. The management of the company needs to establish a management system of "people believe in their rewards" and "believe in their punishment", and also strive to build an economic management system based on economic relations. As for the hidden tricks of management, you can use them properly, but it is by no means a long-term solution, because now is the era of information and knowledge explosion, others may know what you are playing, or you just pretend not to tease you-as a result, your energy and time are wasted on hide-and-seek
