Second, the exemption conditions are to evaluate and hire senior professional and technical positions in accordance with the relevant provisions of the state. Requirements of the National Licensed Pharmacist Qualification Examination: The examination takes two years as a cycle, and participants in all subjects must pass all subjects within two consecutive examination years. Chapter 1 General Provisions?

Article 1 In order to ensure the implementation of the licensed pharmacist qualification system and strengthen the registration management of licensed pharmacists, these Measures are formulated in accordance with the Interim Provisions on the Licensed Pharmacist Qualification System jointly issued by the Ministry of Personnel and the State Administration of Pharmaceutical Products.

Article 2 Licensed pharmacists shall practise a registration system. The State Administration of Pharmaceutical Products is the competent authority for the registration of licensed pharmacists in China, and the drug administrations of all provinces, autonomous regions and municipalities directly under the Central Government are the competent authorities for the registration of licensed pharmacists in their respective jurisdictions.

Article 3 A person who holds a licensed pharmacist qualification certificate shall apply for registration with a registration institution and obtain a licensed pharmacist registration certificate before practicing as a licensed pharmacist.

Article 4 Licensed pharmacists shall be registered according to the category, scope and region of practice. The practice category is pharmacy and traditional Chinese medicine; The scope of practice is drug production, drug management and drug use; The practicing areas are provinces, autonomous regions and municipalities directly under the Central Government.

Article 5 Licensed pharmacists can only be registered in the licensed pharmacist registration institution, and practice in a practice unit according to the registered practice category and scope.

Chapter II Application for Registration

Article 6 After obtaining the qualification certificate of licensed pharmacist, the personnel of a pharmaceutical production, trading and use unit may apply for registration with the licensed pharmacist registration agency where the practicing unit is located.

Article 7 To apply for registration as a licensed pharmacist, the following conditions must be met:

(1) Obtaining the qualification certificate of licensed pharmacist; ?

(two) abide by the law, abide by professional ethics; ?

(3) Being in good health and being able to persist in working as a licensed pharmacist; ?

(four) with the consent of the practicing unit. ?

Article 8 Registration shall not be granted under any of the following circumstances:

(a) does not have full capacity for civil conduct; ?

(two) due to criminal punishment, less than two years from the date of completion of the punishment to the date of application for registration; ?

(3) Having been punished for canceling the qualification of licensed pharmacists for less than two years;

(four) other circumstances stipulated by the state that are not suitable for practicing pharmacist business. ?

Article 9 A person who applies for registration for the first time shall fill in the Application Form for First Registration of Licensed Pharmacists and submit the following materials:

(1) Qualification certificate of licensed pharmacist;

(2) A copy of the identity certificate;

(3) 5 recent one-inch bareheaded frontal half-length photos;

(4) a medical examination form issued by a hospital at or above the county level within 6 months;

(five) the certificate of the practicing unit;

(six) a copy of the business unit's legal business certificate.

Article 10 The registration period of licensed pharmacists is three years. The holder must apply to the original licensed pharmacist registration agency for re-registration three months before the expiration of the validity period. If the re-registration formalities are not completed within the time limit, the registered certificate of licensed pharmacist will automatically become invalid and can no longer practice as a licensed pharmacist.

Article 11 To apply for re-registration, the applicant shall fill in the Application Form for Re-registration of Licensed Pharmacists and submit the following materials:

(1) Licensed pharmacist qualification certificate and licensed pharmacist registration certificate;

(two) the examination materials of the practice unit;

(3) Registration certificate of continuing education for licensed pharmacists;

(4) a medical examination form issued by a hospital at or above the county level within 6 months. ?

Twelfth who obtained the "licensed pharmacist qualification certificate", according to the provisions of continuing education credits, can retain the qualification of licensed pharmacist. To apply for registration after obtaining the qualification certificate of licensed pharmacist for one year, in addition to the provisions of Article 9, it is also necessary to submit the Registration Certificate of Licensed Pharmacist's Continuing Education, which contains the record of his participation in continuing education.

Chapter III Registration and Administration?

Thirteenth licensed pharmacist registration institutions shall, within 30 working days from the date of accepting the application, register those who meet the requirements; Do not meet the conditions of registration, and notify the applicant in writing, explain the reasons. ?

Article 14 A licensed pharmacist registration institution shall register in accordance with the professional category indicated in the Licensed Pharmacist Qualification Certificate of the registration applicant.

Fifteenth licensed pharmacist registration institutions to register, in the "Licensed Pharmacist Qualification Certificate" registration column stamped with the special seal for registration, and issued to the State Pharmaceutical Products Administration unified printing of the "Licensed Pharmacist Registration Certificate".

Article 16 Where a licensed pharmacist changes his practice unit or scope in the same practice area, he shall go through the change registration formalities at the original licensed pharmacist registration institution, fill in the Registration Form for the Change of Licensed Pharmacists, and submit the following materials:

(1) Licensed pharmacist qualification certificate and licensed pharmacist registration certificate;

(two) a copy of the legal business certificate of the new business unit; A licensed pharmacist who changes his practice area shall go through the registration formalities at the original licensed pharmacist registration institution, fill in the Registration Form for Change of Licensed Pharmacist, and re-apply for registration at the licensed pharmacist registration institution in the new practice area. The new licensed pharmacist registration institution shall withdraw the original licensed pharmacist registration certificate and issue a new licensed pharmacist registration certificate when going through the registration formalities.

Seventeenth registered pharmacists in any of the following circumstances, it shall be cancelled:

(a) Dead or declared missing; ?

(2) Being subject to criminal punishment; ?

(3) The qualification certificate of licensed pharmacist is revoked;

(four) by administrative dismissal; ?

(5) unable to engage in licensed pharmacist business due to health or other reasons. The unit where the licensed pharmacist works shall apply to the registration institution within 30 working days for cancellation of registration, and fill in the Registration Form for Cancellation of Registration of Licensed Pharmacists. After verification, the licensed pharmacist registration institution shall cancel the registration and withdraw the licensed pharmacist registration certificate.

Eighteenth licensed pharmacists registration institutions will report the registration situation to the State Pharmaceutical Products Supervision and Administration for the record every year, and make regular announcements.

Article 19 If the State Administration of Pharmaceutical Products finds that the licensed pharmacists reported for the record do not meet the prescribed conditions, it has the right to order the licensed pharmacist registration agency to review and correct them.

Twentieth if a party refuses to accept the refusal or cancellation of registration, it may apply for administrative reconsideration or bring a lawsuit to the people's court according to law.

Article 21 Anyone who practices fraud in registration, transfers, borrows or forges the Licensed Pharmacist Qualification Certificate, Licensed Pharmacist Registration Certificate and Licensed Pharmacist Continuing Education Registration Certificate, once found, shall be confiscated and cancelled by the licensed pharmacist registration institution. If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 22 Any staff member of a licensed pharmacist registration institution who neglects his duty, abuses his power or engages in malpractices for selfish ends in the registration work shall be given administrative sanctions by his unit in accordance with the relevant provisions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter IV Supplementary Provisions

Twenty-third "licensed pharmacist qualification certificate" holder without registration, do not have the qualification of licensed pharmacist, shall not engage in licensed pharmacist business activities. The certificate issued by the licensed pharmacist is invalid.

Article 24 A practicing entity refers to a legal entity that produces, deals in and uses drugs.

Article 25 The State Administration of Pharmaceutical Products shall be responsible for the interpretation of these Measures.
