Measures for the appointment and removal of personnel of the Standing Committee of Xiamen Municipal People's Congress
Chapter I General Provisions Article 1 These Measures are formulated in accordance with the relevant provisions of the Constitution and laws and in the light of Xiamen's actual conditions in order to ensure that the Standing Committees of the People's Congresses at all levels in Xiamen (hereinafter referred to as NPC Standing Committees) exercise their power of appointment and removal of personnel according to law. Article 2 These Measures shall apply to the appointment, removal, decision and approval of the Standing Committee of Xiamen Municipal and District People's Congress. Article 3 the NPC Standing Committee must adhere to the principles of revolutionization, youthfulness, knowledge, specialization and having both ability and political integrity, fully promote democracy and strictly follow legal procedures. Chapter II Scope of Appointment and Dismissal Article 4 the NPC Standing Committee appoints, dismisses or elects the following posts in the organs of state power at the corresponding level:

(1) When Director the NPC Standing Committee is unable to work or is absent due to health reasons, the NPC Standing Committee will elect one of the deputy directors to act as the director until the director recovers health or the people's congress elects a new director;

(two) when the people's Congress is not in session, according to the nomination of the meeting of directors of the NPC Standing Committee, appoint individual vice-chairmen and some members of the special committees of the people's Congress;

(3) To appoint and remove Deputy Secretary-General the NPC Standing Committee, director of the general office, deputy directors, directors, deputy directors and members of various working committees according to the nomination of the meeting of directors of the NPC Standing Committee;

(four) according to the nomination of the meeting of directors of the NPC Standing Committee, the appointment and removal of directors and deputy directors of other offices in the NPC Standing Committee. Article 5 the NPC Standing Committee has decided to appoint or remove the following personnel from the state administrative organs at the corresponding level:

(a) when the people's Congress is not in session, the mayor and the district head are unable to hold their posts or absent for some reason. According to the nomination of the meeting of directors of the Standing Committee of the National People's Congress, the executive deputy mayor and deputy district head of the people's government at the corresponding level will decide on the candidates for the agency;

(two) when the people's Congress is not in session, according to the nomination of the mayor and the district head, decide on the individual appointment and removal of the deputy mayor and the deputy district head;

(3) To decide on the appointment and removal of the secretary-general, directors and directors of the people's government at the corresponding level on the nomination of the mayor and district head. Article 6 the NPC Standing Committee appoints or dismisses the following personnel from the state judicial organs:

(a) when the people's Congress is not in session, the president of the people's court at the corresponding level is unable to serve or becomes vacant for some reason, and the deputy president of the people's court at the corresponding level shall decide the candidate for the agency upon nomination by the meeting of directors of the Standing Committee of the National People's Congress;

(2) To appoint or remove the vice presidents, presidents, vice presidents, members of judicial committees and judges of the people's courts at the corresponding levels upon nomination by the presidents of the people's courts at the corresponding levels;

(3) The president of Xiamen Maritime Court shall be appointed and removed by the Standing Committee of the Municipal People's Congress, and vice presidents, presidents, vice presidents, members of judicial committees and judges shall be appointed and removed by the Standing Committee of the Municipal People's Congress. Article 7 the NPC Standing Committee appoints, dismisses or approves the following posts of the state procuratorial organs:

(a) when the people's Congress is not in session, the procurator-general of the people's procuratorate at the corresponding level is unable to serve or is absent for some reason, and the deputy procurator-general of the people's procuratorate at the corresponding level shall decide the candidate for the agency upon nomination by the meeting of directors of the NPC Standing Committee. Deciding to act as attorney general shall be reported to the people's procuratorate at the next higher level and the NPC Standing Committee for the record;

(2) To appoint or remove deputy procurators, members of procuratorial committees and procurators of the people's procuratorates at the corresponding levels on the nomination of the procurator-general.

(3) To approve the appointment and removal of the procurator-general of the people's procuratorate at the next lower level upon the request of the procurator-general of the people's procuratorate at the corresponding level. Chapter III Procedures for Appointment and Dismissal Article 8 A case of appointment and dismissal of personnel submitted to the NPC Standing Committee for deliberation shall be presented in a written report signed by the person in charge of the organ, and attached with a report on the appointment and dismissal of cadres, inspection materials of the personnel to be appointed or dismissed or written materials of the reasons for the dismissal of the personnel to be appointed or dismissed. The above reports and materials were delivered to the General Office of the NPC Standing Committee 15 days before the the NPC Standing Committee meeting. The investigation materials shall accurately reflect the specific situation of the proposed personnel's morality, ability, diligence, achievements, democratic and legal concepts and whether they have the necessary legal knowledge to perform the proposed duties. Article 9 The personnel appointment and removal organ of the NPC Standing Committee is responsible for understanding the relevant situation of the personnel appointment and removal case and reporting to the meeting of directors of the NPC Standing Committee. Article 10 The meeting of directors shall discuss and decide whether to submit the case of personnel appointment and dismissal to the NPC Standing Committee for deliberation. Eleventh the NPC Standing Committee, when deliberating the case of personnel appointment and removal, shall require the person in charge of the organ to attend the meeting to explain the case of personnel appointment and removal, listen to the deliberation opinions and answer questions. If the main * * * is unable to attend the meeting due to special circumstances, it shall explain the reasons and entrust the deputy * * * to attend the meeting for explanation. Article 12 When deliberating and appointing Deputy Secretary-General of the NPC Standing Committee, director and deputy director of general office, directors and deputy directors of working committees and other offices in the NPC Standing Committee, deputy directors of special committees of individual people's congresses, deputy mayors and deputy heads of people's governments, secretary-general, director and director of people's governments, the vice-president of people's courts and deputy procurator-general of people's procuratorates to be appointed shall speak at the meeting of the Standing Committee.

When deliberating and appointing the President and Vice President of Xiamen Maritime Court, the person to be appointed shall make a speech at the meeting of the Standing Committee. If he cannot attend the meeting due to special reasons, he shall submit written materials.

Other persons to be appointed shall attend the meeting and meet with the members of the Standing Committee.
