Decision of Hainan Provincial People's Congress on Amending the Rules of Procedure of Hainan Provincial People's Congress (2002)
Article 1 is amended as: "These Rules are formulated in accordance with the Constitution of People's Republic of China (PRC), the Organic Law of Local People's Congresses and Local People's Governments at Various Levels in People's Republic of China (PRC), the Election Law of the National People's Congress of the People's Republic of China and Local People's Congresses at Various Levels, the Law of the People's Republic of China on Deputies to the National People's Congress and other relevant laws, and in combination with the practical experience of provincial people's congresses." 2. Article 2 is amended as: "The meeting of the provincial people's congress shall perform various duties stipulated by the Constitution and laws." 3. Paragraph 2 of Article 8 is amended as: "The provisions of the preceding paragraph shall not apply to the interim meeting of the provincial people's congress, but the delegates shall be informed in advance of the date of the meeting and the main topics to be discussed at the meeting." 4. Item (5) of Article 12 is amended as: "Deadline for deputies to put forward motions and questions". 5. Article 18 is amended as: "The special committees of the provincial people's congress, the planning and budget review committee and the motion review committee of the general assembly shall, under the leadership of the presidium and in accordance with the provisions of these rules, perform their respective duties during the meeting. The candidates for the General Assembly Planning and Budget Review Committee and the Motion Review Committee shall be nominated by the Standing Committee of the Provincial People's Congress among the current delegates and submitted to the preparatory meeting for approval. " 6. Article 19 is amended as: "If the members of the provincial people's government, the president of the provincial higher people's court and the chief procurator of the provincial people's procuratorate are not deputies to the provincial people's congress, they shall attend the meetings of the provincial people's congress as nonvoting delegates; Deputies to the National People's Congress elected by the province, the working bodies of the Standing Committee of the Provincial People's Congress, the Intermediate People's Court of Hainan Province, the People's Court of Yangpu Economic Development Zone, the Hainan Branch of the Provincial People's Procuratorate, the Procuratorate of Yangpu Economic Development Zone and the heads of other organs and organizations may attend the meeting of the Provincial People's Congress as nonvoting delegates upon the decision of the Standing Committee of the Provincial People's Congress. " 7. Paragraph 1 of Article 22 is amended as: "The presidium, the Standing Committee of the provincial people's congress, the special committees of the provincial people's congress and the provincial people's government may, within the scope of their functions and powers, submit proposals to the provincial people's congress, which shall be decided by the presidium to be included in the agenda of the meeting."

The second paragraph is amended as: "A delegation or a group of representatives with more than 10 may submit a motion to the provincial people's congress, and the presidium shall decide whether to put it on the agenda of the meeting, or refer it to the motion review committee of the general assembly or the relevant special committee of the provincial people's congress for deliberation and comments, and the presidium shall decide whether to put it on the agenda of the meeting, and issue a report on the handling opinions of the motion passed by the presidium. When the motion review committee of the General Assembly or the relevant special committee of the provincial people's congress deliberates the motion, it may invite the sponsor to attend the meeting as a nonvoting delegate and express his opinions. " 8. Article 23 is amended as: "The sponsor and the relevant special committees of the provincial people's congress and the relevant working bodies of the Standing Committee of the provincial people's congress shall provide relevant information for the proposal included in the agenda of the meeting." Nine, Article 24 is amended as: "The sponsor of the motion included in the agenda of the meeting shall present an explanation of the motion to the meeting. After deliberation by the delegations, the proposal will be submitted by the presidium to the relevant special committees of the provincial people's congress for deliberation, and a report will be submitted, which will be deliberated and decided by the presidium and submitted to the plenary session of the General Assembly for voting. " 10. Article 26 is amended as: "The draft local regulations included in the agenda of the meeting shall be deliberated by all delegations after hearing the explanations of the draft local regulations at the plenary session of the General Assembly.

"The relevant special committees of the provincial people's Congress may consider the draft local regulations included in the agenda of the meeting, put forward deliberation opinions to the presidium, and issue them to the meeting.

"Included in the agenda of the meeting of the draft local regulations after deliberation by the delegations and the relevant special committees of the provincial people's Congress, by the Legislative Affairs Committee of the provincial people's Congress according to the deliberation opinions of the delegations and the relevant special committees, unified consideration of the draft local regulations, put forward a report on the deliberation results and a revised draft to the presidium, after deliberation and adoption by the presidium meeting, printed and distributed to the meeting.

Where there are different opinions on major issues during the deliberation of the draft local regulations, the executive chairman of the presidium may convene a meeting of heads of delegations to listen to the deliberation opinions of delegations and discuss them, or convene representatives elected by delegations to discuss them, and report the discussion and opinions to the presidium. The title of Chapter IV is amended as: "Deliberating the work report and examining the plan and budget." 12. Article 31 is amended as: "One month before the meeting of the provincial people's congress is held, the planning and financial departments of the provincial people's government shall submit the draft plan for national economic and social development, the implementation of the plan, the draft budget and the implementation of the budget to the relevant special committees of the provincial people's congress, or submit it to the financial and economic working institutions of the provincial people's congress standing committee for preliminary examination and comments according to the decision of the meeting of directors of the provincial people's congress standing committee, and the meeting of directors of the provincial people's congress will give feedback to the provincial people's government. The preliminary examination opinions of the financial institutions of the Standing Committee of the Provincial People's Congress shall be decided by the meeting of directors and submitted to the Planning and Budget Review Committee of the General Assembly for deliberation. " Article 32 is amended as: "When the provincial people's congress meets every year, the provincial people's government shall submit a report on the draft national economic and social development plan and its implementation, a report on the draft budget and its implementation to the meeting, and issue the main indicators of the national economic and social development plan, the relevant balance sheet (draft), the budget balance sheet (draft) and the budget implementation to the meeting, which will be reviewed by all delegations and the relevant special committees of the provincial people's congress, and the planning and budget review committee of the conference.

"The relevant special committees of the provincial people's Congress or the General Assembly Planning and Budget Review Committee shall, according to the preliminary examination opinions of the delegations and the financial and economic working institutions of the Standing Committee of the provincial people's Congress, review the report on the draft plan for national economic and social development and the implementation of the plan, the report on the draft budget and the implementation of the budget, and submit a report on the results of the review and a draft resolution to the presidium. After deliberation and approval by the presidium, the meeting will be issued, and the draft resolution on the national economic and social development plan and the draft resolution on the budget and budget implementation will be submitted to the plenary session of the General Assembly for voting.
