Article 37 The personal freedom of People's Republic of China (PRC) citizens shall be inviolable.
No citizen shall be arrested unless approved or decided by the people's procuratorate or decided by the people's court, and shall be executed by the public security organ.

Article 39 The residences of People's Republic of China (PRC) citizens shall be inviolable. It is forbidden to illegally search or illegally invade citizens' houses.
Fortieth People's Republic of China (PRC) citizens' freedom and privacy of communication are protected by law. When public security organs and procuratorial organs check communication according to the procedures prescribed by law, no organization or individual may infringe upon citizens' freedom and privacy of communication for any reason, except for the needs of national security or criminal investigation.
Forty-first People's Republic of China (PRC) citizens have the right to criticize and make suggestions to any state organ or state functionary; Any state organ or state functionary has the right to lodge a complaint, accusation or report to the relevant state organ for illegal or dereliction of duty, but shall not fabricate or distort facts to make false accusations or frame up.
For citizens' complaints, accusations or exposures, the relevant state organs must find out the facts and be responsible for handling them. No one can suppress it, and no one can retaliate.
People who have suffered losses due to the infringement of civil rights by state organs and state functionaries have the right to compensation according to law.
