Previously, the Shenzhen Intermediate People's Court sentenced Alex Gao, the principal offender, to death, suspended for two years, confiscated all his personal property, and fined him 410.5 million yuan for organizing, leading and participating in underworld organizations, intentional injury, stirring up trouble, illegal detention, kidnapping, robbery, extortion, opening a casino, forced trading and stirring up trouble. Sentenced the defendant Rao Zhiqing to life imprisonment and fined 650,000 yuan; Wang Zhonghua was sentenced to 20 years in prison and fined 6,543,800 yuan. The remaining 45 defendants were sentenced to fixed-term imprisonment, and 1 defendant was exempted from criminal punishment. After the verdict was pronounced in the first instance, Alex Gao and other 35 people appealed to the Guangdong Provincial High Court.
The court of second instance found through trial that since the end of 1990s, Alex Gao has continuously recruited fellow villagers and integrated other evil forces, organized and implemented a series of illegal and criminal activities, such as intentional injury, trouble-making, illegal detention, kidnapping, extortion, forced trading, opening casinos, etc., and seized illegal interests, and gradually formed a large number of underworld organizations with Alex Gao as the organization and leader and Rao Zhiqing and Wang Zhonghua as key members.
In order to compete for the sphere of influence, in July 2000, Alex Gao gathered hundreds of people including Rao Zhiqing and hundreds of evil forces headed by Peng Yusheng (who had been sentenced) to demonstrate near Longhua Village Committee and gather people to make trouble. The two sides fought with harpoons, steel pipes, shovels, wooden sticks and other tools, which seriously disrupted the local social order and caused bad influence.
In order to crowd out and retaliate against opposing evil organizations, from June 5438 to February 2000, Alex Gao organized many people to shoot Peng Yusheng, causing him to fall to the ground after being shot in the leg, and then stabbed Peng Yusheng with a knife. In May of 20001year, Alex Gao commanded Rao Zhiqing, Wang Zhonghua and other members of organizations to chase Xie Moumou with guns and knives, causing his death.
The underworld organization and its members personally committed dozens of violent criminal activities, bullying and injuring the masses for evil, resulting in 1 death, 1 serious injury and 27 minor injuries, dominating Longhua and its surrounding areas, seriously undermining the local economic and social life order.
The court of second instance held that the basic facts of the original judgment were clear, the evidence was true and sufficient, the conviction was accurate, the sentencing was appropriate and the trial procedure was legal, so the above ruling was made according to law.
