Decision of the Standing Committee of Qinghai Provincial People's Congress on Amending the Regulations on the Work of People's Congresses of townships, nationality townships and towns in Qinghai Province (2020) 1. Article 1 is amended as: "In order to standardize the work of people's congresses in townships, nationality townships and towns, promote the construction of people's congresses in townships and improve the system of people's congresses, these Regulations are formulated in accordance with the relevant provisions of the Organic Law of Local People's Congresses and Local People's Governments at All Levels in People's Republic of China (PRC). The Election Law of the National People's Congress of the People's Republic of China and the Law on Deputies to the National People's Congress and Local People's Congresses of the People's Republic of China are combined with the actual situation of this province. 2. Article 2 is renumbered as Article 3 and amended as: "The people's congresses of townships, nationality townships and towns shall uphold the leadership of the Party, adhere to democratic centralism and exercise their functions and powers according to law. "three. Article 5 is amended as: "The funds for the work of the people's congresses of townships, nationality townships and towns and their chairmen's groups, as well as the funds for the activities of their deputies, shall be included in the fiscal budget at the corresponding level for protection, and shall be earmarked by the county-level finance. 4. Paragraph 3 of Article 9 is amended as: "A meeting of the people's congress at the corresponding level may be convened temporarily upon the proposal of more than one fifth of the deputies. The temporary meetings of the people's congresses of townships, nationality townships and towns may be less than one day. V. Article 11 is amended as: "The presidium of the people's congress of a township, nationality township or town shall be responsible for the following work when preparing, convening and presiding over the meeting of the people's congress at the corresponding level:

"(a) Determine the date and schedule of the meeting;

"(two) to draft the agenda of the meeting, the draft election method, the draft suggestions and criticisms, put forward the list of suggestions of the members of the presidium and the members of the credentials committee, and submit them to the Congress for deliberation;

"(three) to decide on the list of people attending the meeting;

"(four) through the examination report on the qualifications of representatives;

"(five) to determine the list of candidates for the chairman, vice chairman, head, deputy head, mayor and deputy mayor of the Township People's Congress in accordance with legal procedures;

"(six) to decide on the handling of the inquiry case and submit the recall case to the General Assembly for consideration;

"(seven) to submit draft resolutions and decisions to the Congress for deliberation and voting;

"(8) Organizing state functionaries elected by the people's congresses at the corresponding levels to take the constitutional oath;

"(9) Other matters that need to be handled by the presidium according to law." Six, thirteenth is amended as: "the main agenda of the first meeting of the people's congresses of townships, nationality townships and towns every year:

"(a) to listen to and consider the work reports of the people's governments of townships, nationality townships and towns;

"(two) to listen to and consider the work report of the chairman group of the people's congresses of townships, nationality townships and towns during the intersessional period;

"(three) to examine and approve the budget, budget implementation or financial revenue and expenditure report within their respective administrative areas;

"(four) other matters within the scope of statutory functions and powers.

"The people's congresses of townships, nationality townships and towns hold their second meeting every year, mainly to listen to and consider the special work reports of the people's governments of townships, nationality townships and towns and the reports on the handling of suggestions made by representatives, and decide on major issues of general concern to the people within their administrative areas and other matters within their statutory functions and powers. "7. Article 24 is amended as:" When the people's congresses of townships, nationality townships and towns are deliberating various reports and other bills, deputies may ask questions to the people's governments at the corresponding levels, and the responsible persons of the people's governments shall answer or explain the questions on the spot. If it is really impossible to answer on the spot, it should be carefully studied and dealt with, and feedback should be given in time after the meeting. Eight, Article 25 is amended as: "The presidium of the people's congresses of townships, nationality townships and towns consists of seven to eleven people. The chairman and vice-chairmen of the people's congresses are members of the presidium.

"The chairmen and vice-chairmen of the people's congresses of townships, nationality townships and towns shall not hold the posts of township people's governments; Those who hold the post of township people's government shall resign from the post of chairman and vice-chairman to the people's congress at the corresponding level. " Nine, two paragraphs are added to Article 26 as the third and fifth paragraphs: "The meeting of the presidium shall be convened and presided over by the chairman of the people's congress of a township, nationality township or town or the vice chairman entrusted by the chairman.

According to the needs of the work, the Presidium may require the heads of the people's governments of townships, nationality townships and towns and relevant units to attend the meetings of the Presidium as nonvoting delegates. Article 27 is amended as: "The Presidium of the people's congresses of townships, nationality townships and towns shall perform the following duties when the people's congresses at the corresponding levels are not in session:

"(a) to choose the vital interests of the people and issues of general concern to the society within their respective administrative areas, and to arrange for representatives to listen to and discuss the special work reports of the people's governments at the corresponding levels in a planned way;

"(two) according to the actual situation of the administrative region, there are plans to organize representatives to inspect the implementation of laws and regulations, to carry out inspection, research and other activities, and to transfer the report formed by the inspection and research activities to the relevant organs and organizations for research and treatment, and to give feedback to the representatives;

"(three) to conduct a preliminary review of the budget, draft final accounts, budget implementation and adjustment plan at the corresponding level;

"(four) to listen to and reflect the suggestions, criticisms and opinions of the deputies and the people on the work of the people's government at the corresponding level;

"(five) according to the requirements of the deputies, contact and arrange for the representatives of the people's congresses at the corresponding levels or at higher levels to hold representative certificates to conduct on-the-spot inspections and meet with the heads of state organs at the corresponding levels;

"(six) to organize representatives to supervise the implementation of the resolutions and decisions of the people's congresses at the corresponding levels, and to put forward opinions and suggestions;

"(seven) there are plans to organize representatives to evaluate the work of the people's government at the corresponding level and relevant units, carry out satisfaction evaluation, and make the evaluation and evaluation results public;

"(eight) the suggestions, criticisms and opinions put forward by the representatives shall be forwarded to the relevant organs and organizations for research and handling, and the reports on the handling shall be heard and considered, and the representatives shall be urged to reply to the research and handling in a timely manner;

"(nine) to establish and improve the system of contact between representatives and voters in the original constituency and the people, and to organize representatives to report their duties to voters in the original constituency on a regular basis;

"(ten) to urge the people's governments of townships, nationality townships and towns to make preparations for the work report and relevant proposals submitted to the Congress for deliberation;

"(eleven) to strengthen the construction of representative performance platform, through the establishment and improvement of representative liaison station (room) or network platform, smooth social conditions and public opinion expression and reflection channels;

"(twelve) to establish a representative performance file, record the performance of the representative, and make it public;

"(thirteen) to handle matters assigned or entrusted by the people's congresses at the corresponding levels and the people's congresses at higher levels and their standing committees;

"(14) Other matters stipulated by laws and regulations." The work of the presidium during the intersessional period shall be reported to the people's congress at the corresponding level. "
