Article 1 These Provisions are formulated to facilitate foreign resident news agencies and foreign journalists to cover and report in People's Republic of China (PRC) according to law, and to promote international exchanges and information dissemination.
Article 2 The term "resident foreign news agencies" as mentioned in these Regulations refers to the branches established by foreign news agencies in China to engage in news reporting.
Foreign journalists mentioned in these Regulations include foreign resident journalists and foreign short-term journalists. Foreign resident journalists refer to professional journalists who are dispatched by foreign news organizations and have been resident in China for more than six months and engaged in news reporting; Foreign short-term journalists refer to professional journalists who stay in China for no more than six months and engage in news reporting.
Article 3 China implements the basic national policy of opening to the outside world, protects the legitimate rights and interests of foreign resident news agencies and foreign journalists according to law, and provides convenience for them to engage in news reporting business according to law.
Article 4 Foreign resident news agencies and foreign journalists shall abide by the laws, regulations and rules of China, strictly abide by the professional ethics of journalism, report objectively and fairly, and shall not engage in activities that are inconsistent with the nature of their agencies and the status of journalists.
Article 5 The Ministry of Foreign Affairs of People's Republic of China (PRC) (hereinafter referred to as the Ministry of Foreign Affairs) is in charge of foreign resident news agencies and foreign journalists. The State Council Information Office and other departments are responsible for the affairs of foreign resident news agencies and foreign journalists within their respective responsibilities.
The foreign affairs department of the local people's government is entrusted by the Ministry of Foreign Affairs to handle the affairs of foreign resident news agencies and foreign journalists within their respective administrative areas. The information office of the local people's government and other departments are responsible for the affairs related to foreign resident news agencies and foreign journalists within their respective administrative areas.
Article 6 The establishment of resident news agencies and the dispatch of resident journalists by foreign news organizations in China shall be approved by the Ministry of Foreign Affairs.
Article 7 A foreign news agency applying to establish a permanent news agency in China shall submit the following materials to the Ministry of Foreign Affairs directly or through China's embassies and consulates abroad:
(a) a written application signed by the main person in charge of the news agency headquarters;
(2) introduction of news agencies;
(three) the introduction of the person in charge of the proposed institution, the resident journalists and staff to be sent;
(four) a copy of the certificate of the establishment of the news agency in its home country.
Article 8 After the application for establishing a resident news agency in China is approved, the person in charge of the resident news agency shall, within 7 working days from the date of his arrival in China, apply to the Ministry of Foreign Affairs for a foreign resident news agency certificate with his passport; Among them, the person in charge of the news agency resident outside Beijing shall, within 7 working days from the date of his arrival in China, apply for the Foreign Affairs Department of the local people's government entrusted by the Ministry of Foreign Affairs with his passport.
Article 9 Foreign news organizations applying for sending resident journalists shall submit the following materials to the Ministry of Foreign Affairs directly or through Chinese embassies and consulates abroad:
(a) a written application signed by the head of the news agency headquarters;
(two) to send a reporter to introduce;
(3) A photocopy of the certification document of the journalist to be sent to the host country to engage in professional activities.
If two or more foreign news organizations send the same resident reporter, they shall go through the application procedures separately in accordance with the provisions of the preceding paragraph, and indicate in their respective written applications the foreign news organizations where the reporter works part-time.
Article 10 After the application of a foreign resident correspondent is approved, the dispatched foreign correspondent shall apply for a foreign resident correspondent's card at the Ministry of Foreign Affairs with his passport within 7 working days from the date of his arrival in China; Among them, journalists resident outside Beijing should apply for a foreign resident journalist's card at the foreign affairs department of the local people's government entrusted by the Ministry of Foreign Affairs with their passports within 7 working days from the date of their arrival in China.
After obtaining a resident foreign correspondent's card, a foreign journalist shall apply to the public security organ in his place of residence for a residence permit.
Article 11 A foreign resident news agency shall submit a written application to the Ministry of Foreign Affairs to change its name and resident area, and go through the formalities of change after approval.
Foreign resident news agencies shall notify the Ministry of Foreign Affairs in writing within 7 working days after changing the person in charge and office address; Among them, the resident news agency stationed outside Beijing shall inform the foreign affairs department of the local people's government entrusted by the Ministry of Foreign Affairs in writing within 7 working days after the change of the responsible person and office address.
Article 12 If the foreign resident correspondent card needs to be extended upon expiration, the foreign resident correspondent shall apply to the Ministry of Foreign Affairs or the foreign affairs department of the local people's government entrusted by the Ministry of Foreign Affairs for extension in advance; Failing to do so within the time limit will be deemed as automatically giving up the qualification of foreign resident journalist, and his foreign resident journalist card will be cancelled.
Article 13 If a foreign resident news agency intends to terminate its business, it shall notify the Ministry of Foreign Affairs 30 days before it terminates its business, and go through the cancellation procedures of the foreign resident news agency card and its resident correspondent's foreign resident reporter card at the Ministry of Foreign Affairs or the foreign affairs department of the local people's government entrusted by the Ministry of Foreign Affairs within 7 working days from the date of termination.
If a foreign resident news agency has no resident reporter for more than 10 months, it shall be deemed that the agency automatically terminates its business and its foreign resident news agency certificate shall be cancelled.
If a resident foreign correspondent stays in China for less than six months each year, his resident foreign correspondent card will be cancelled.
Foreign resident news agencies shall, before their resident journalists leave their posts, go through the cancellation procedures of foreign resident journalists' cards with the Ministry of Foreign Affairs or the foreign affairs departments of local people's governments entrusted by the Ministry of Foreign Affairs.
Fourteenth foreign resident news agency card and foreign resident journalist card shall be announced to the public after cancellation.
For journalists whose foreign resident correspondent cards are cancelled, their correspondent cards will automatically become invalid after 10 days.
A journalist whose foreign resident correspondent card has been cancelled shall apply to the public security organ of his place of residence for visa or residence permit change registration with relevant documents within 10 days from the date of cancellation of the foreign resident correspondent card.
Article 15 Foreign journalists should apply for a journalist's visa to Chinese embassies and consulates abroad or visa agencies authorized by the Ministry of Foreign Affairs for permanent or short-term interviews.
Article 16 Foreign journalists accompanying heads of state, heads of government, speakers of parliament, members of the royal family or senior government officials in China shall apply for a journalist visa from Chinese embassies and consulates abroad or visa agencies authorized by the Ministry of Foreign Affairs.
Seventeenth foreign journalists in China, must obtain the consent of the units and individuals to be interviewed.
Foreign journalists should carry and show their resident foreign journalists' cards or visas for short-term interviews.
Eighteenth foreign resident news agencies and foreign journalists can employ China citizens to engage in auxiliary work through foreign affairs service units. Foreign affairs service units shall be designated by the Ministry of Foreign Affairs or the foreign affairs department of the local people's government entrusted by the Ministry of Foreign Affairs.
Article 19 Foreign resident news agencies and foreign journalists may temporarily import, set up and use radio communication equipment after going through the approval formalities according to law.
Article 20 If a foreigner engages in news coverage activities in China without obtaining or holding a valid foreign resident journalist's card or a short-term journalist's visa, the public security organ shall order him to stop his news coverage activities and deal with it in accordance with relevant laws.
Twenty-first foreign resident news agencies and foreign journalists who violate the provisions of these regulations shall be given a warning by the Ministry of Foreign Affairs and ordered to suspend or terminate their business activities; If the circumstances are serious, its foreign resident journalist card, foreign resident journalist card or journalist visa shall be revoked.
Twenty-second foreign resident news agencies and foreign journalists who violate other laws, regulations and rules of China shall be dealt with according to law; If the circumstances are serious, the Ministry of Foreign Affairs shall revoke its foreign resident journalist card, foreign resident journalist card or journalist visa.
Article 23 These Regulations shall come into force on June 6+10/October 6+July 6, 2008. 1990 65438+1October19 The Regulations on the Administration of Foreign Journalists and Permanent Foreign News Agencies promulgated by the State Council shall be abolished at the same time.
