The establishment of social organizations in districts, cities and counties shall be examined by the relevant competent departments of the districts, cities and counties, and the district, city and county civil affairs bureaus shall apply for registration. Article 7 National, province-wide and inter-provincial (autonomous regions and municipalities directly under the Central Government) social organizations that set up a meeting, league or branch in this city shall file with the Civil Affairs Bureau with the original registration authority certification documents and accept supervision and management.
The establishment of institutions or branches by city-wide social organizations in districts, cities and counties shall be approved by the Civil Affairs Bureau and subject to the supervision and management of the local civil affairs bureau. Chapter III Registration of Establishment Article 8 To apply for the establishment of a social organization, the following conditions shall be met:
(1) Having articles of association that comply with laws, regulations and rules and reflect the wishes of members;
(two) there are responsible persons and more than 20 members;
(3) Having a fixed office or contact address;
(4) Having necessary funds or funds.
Academic social groups should also have academic leaders. Article 9 To apply for the establishment of a social organization, the following materials shall be submitted to the registration authority:
(a) the application and feasibility report;
(2) Qualification certification documents;
(3) Articles of association;
(4) Resumes of the candidates for president (director) and secretary-general;
(5) Members or a list of members;
(six) proof of the property right or the right to use the office building;
(7) Credit certificate of funds. Article 10 The articles of association of a social organization shall include the following contents:
(a) the name (legal person social organizations should have English translation);
(2) purpose;
(3) Activity area and business scope;
(4) Membership and rights and obligations;
(5) Procedures and functions of the organization;
(6) The procedures for the formation, terms of reference and term of office of the person in charge;
(7) Procedures for amending the Articles of Association;
(8) Procedures for the termination of social organizations;
(9) Sources of funds and financial management;
(10) Other matters. Article 11 The name of a social organization shall be consistent with its business scope, membership distribution and activity area.
The name of a non-city social organization shall indicate the name of the local administrative division. Twelfth in the same administrative region or the same industry, the same or similar social organizations shall not be established repeatedly. Article 13 After receiving an application for registration, the registration authority shall make a decision on whether to accept it or not within 10 days. Within 30 days after accepting the application, a written reply shall be made on whether to approve or disapprove the registration.
If the applicant refuses to accept the decision of the registration authority not to register, he may apply to the registration authority at the next higher level for reconsideration within 10 days after receiving the reply, and the registration authority at the next higher level shall make a reconsideration decision within 30 days and report it to the people's government at the same level for the record. Fourteenth approved registration of social organizations, the registration authority issued a "social organization registration certificate". Those who meet the conditions of a legal person shall be issued with the Registration Certificate of a Social Organization as a Legal Person. Fifteenth approved registration of social organizations, with the registration certificate in accordance with the relevant provisions of the seal and open a bank account, the account seal, account, membership card samples should be submitted to the registration authority for the record. Chapter IV Alteration and Cancellation of Registration Article 16 If a social organization changes its name, legal representative (person in charge), competent business department, office space or contact address, it shall go through the change registration with the registration authority within 10 days after obtaining the consent of the original qualification examination authority. Seventeenth social organizations in any of the following circumstances, it shall go through the cancellation of registration with the original registration authority:
(1) The unincorporated social organization is changed into a legal person social organization;
(two) to complete the purposes and tasks stipulated in the articles of association;
(3) The number of members is less than 20;
(4) Failing to carry out activities within two years or dissolving by itself;
(5) No funds. Eighteenth social organizations to cancel the registration, should be signed by the legal representative (person in charge) of the application for cancellation of registration, the examination opinions of the competent department of business, proof of creditor's rights and debts, registration certificate and seal, to the registration authority for cancellation of registration. Chapter V Supervision and Administration Article 19 The business activities of social organizations shall be guided by the relevant competent departments. Twentieth social organizations in charge of business can be entrusted by the registration authority to conduct qualification examination and business guidance.
The competent department of social organization business shall cooperate with the registration authority in the supervision and management of social organizations.
