Provisions on the administration of periodical publishing

Chapter I General Principles

Article 1 In order to promote the prosperity and development of China's periodical industry, standardize periodical publishing activities and strengthen periodical publishing management, these Provisions are formulated in accordance with the Regulations of the State Council on Publishing Management and relevant laws and regulations.

Article 2 These Provisions shall apply to periodical publishing activities within the territory of People's Republic of China (PRC).

Periodicals are published by periodical publishing units established according to law. Periodical publishing units must be approved by the General Administration of Press and Publication, hold a unified serial publication number in China, and obtain a periodical publishing license.

The term "periodical" as mentioned in these Provisions refers to a continuous publication with a fixed name, which is published in a certain period of time by volume, issue or year, quarter and month number.

The periodical publishing unit mentioned in these Provisions refers to a periodical agency established with the approval of the General Administration of Press and Publication in accordance with the relevant provisions of the state and performing the registration procedures. If a legal person has not established a periodical agency to publish periodicals, the periodical editorial department established by it shall be regarded as a periodical publishing unit.

Article 3 Periodical publishing must adhere to Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory and Theory of Three Represents, adhere to the correct direction of public opinion and publishing, adhere to the principle of giving priority to social benefits and unifying social and economic benefits, disseminate and accumulate scientific, technological and cultural knowledge conducive to improving national quality, economic development and social progress, carry forward the excellent culture of the Chinese nation, promote international cultural exchanges and enrich people's spiritual and cultural life.

Article 4 Periodical distribution is divided into public distribution and internal distribution.

Periodicals issued internally can only be issued within the territory according to the designated scope, and may not be publicly issued or displayed in the society.

Article 5 The General Administration of Press and Publication shall be responsible for the supervision and management of periodical publishing activities nationwide, formulate and implement the national periodical publishing total volume, structure and layout planning, and establish and improve the supervision and management systems such as periodical publishing quality evaluation system, periodical annual verification system and periodical publishing withdrawal mechanism.

Local press and publication administrative departments at all levels shall be responsible for the supervision and management of periodical publishing activities within their respective administrative areas.

Article 6 Periodical publishing units shall be responsible for periodical publishing activities such as editing and publishing.

The legal publishing activities of periodical publishing units are protected by law. No organization or individual may illegally interfere with, prevent or destroy the publication of periodicals.

Article 7 The General Administration of Press and Publication shall give awards to periodical publishing units and individuals who have made outstanding contributions to the prosperity and development of China's periodical industry.

Article 8 Social organizations in the periodical publishing industry shall, in accordance with their articles of association and under the guidance of the administrative department of press and publication, implement self-discipline management.

Chapter II Establishment of Periodicals and Establishment of Periodical Publishing Units

Article 9 To establish a periodical or periodical publishing entity, the following conditions shall be met:

(a) there is a clear name that does not duplicate the existing periodical;

(2) Having the name and articles of association of the periodical publishing entity;

(3) Having supervisors and organizers who meet the requirements recognized by the General Administration of Press and Publication;

(4) Having a definite scope of periodical publishing business;

(five) the registered capital of more than 300 thousand yuan;

(6) Having an organization that meets the needs of periodical publishing activities and editors who meet the qualifications prescribed by the state;

(7) Having a fixed workplace in the same administrative area as the organizer;

(eight) a clear legal representative or principal responsible person, and must be a citizen of China who has lived in China for a long time;

(9) Other conditions as prescribed by laws and administrative regulations.

In addition to the conditions listed in the preceding paragraph, it must also conform to the overall planning of the state on the total amount, structure and layout of periodicals and periodical publishing units.

Article 10 The central unit in Beijing shall establish a periodical and a periodical publishing unit, and the organizer shall report to the General Administration of Press and Publication for examination and approval after obtaining the consent of the competent unit.

The China People's Liberation Army and the Chinese People's Armed Police Force systematically establish periodicals and set up periodical publishing units, which shall be reported to the General Administration of Press and Publication by the Press and Publication Bureau of the Propaganda Department of the General Political Department of the China People's Liberation Army for approval.

Other units that establish periodicals and periodical publishing units shall apply to the administrative departments of press and publication of the provinces, autonomous regions and municipalities directly under the Central Government after examination and approval by the competent units, and report to the General Administration of Press and Publication for examination and approval after examination and approval by the administrative departments of press and publication of the provinces, autonomous regions and municipalities directly under the Central Government.

Article 11 When two or more sponsors jointly run a journal, a major sponsor must be identified, and the major sponsor shall apply.

The main sponsor of a periodical should be a subordinate unit of its competent unit. Periodical publishing units and main organizers must be in the same administrative region.

Article 12 To establish a periodical or periodical publishing entity, the sponsor of the periodical publishing entity shall apply and submit the following materials:

(1) An application form for periodical publication as required;

(two) the relevant qualification certificates of the competent unit and the organizer;

(three) the resume and identity certificate of the legal representative or principal responsible person of the publishing unit to be proposed and the professional qualification certificate issued by the relevant state departments;

(4) Editing the professional qualification certificate of the publisher;

(five) the source and amount of publishing funds and related documents;

(6) Articles of association of the periodical publishing entity;

(seven) the certificate of use of the workplace;

(eight) the feasibility report of periodical publication.

Article 13 The General Administration of Press and Publication shall, within 90 days from the date of receiving the application for establishing a periodical or periodical publishing entity, make a decision on approval or disapproval, and directly or by the administrative department of press and publication of the province, autonomous region or municipality directly under the Central Government, notify the organizer in writing; If it is not approved, it shall explain the reasons.

Article 14 A periodical organizer shall go through the registration formalities within 60 days from the date of receiving the approval decision of the General Administration of Press and Publication:

(1) Take the approval document to the press and publication administrative department of the local province, autonomous region or municipality directly under the Central Government to receive the periodical publication registration form, fill it out in quintuplicate, and report it to the press and publication administrative department of the local province, autonomous region or municipality directly under the Central Government after being examined and signed by the competent periodical unit. The press and publication administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall submit the periodical publication registration form to the General Administration of Press and Publication for the record within 15 days;

(2) Publicly issued periodicals can apply for serial publication numbers of international standards to ISSN China National Center and apply for bar codes to Bar Code Center of General Administration of Press and Publication;

(3) The press and publication administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall, after examining the Registration Form for Periodical Publishing, issue the Periodical Publishing License to the organizer within 10 days;

(four) the periodical publishing unit shall go through the registration formalities with the administrative department for industry and commerce with the periodical publishing license and obtain the business license according to law.

The registration form of periodical publication shall be kept by the periodical publishing unit, the organizer, the competent unit and the administrative department of press and publication of the local province, autonomous region or municipality directly under the Central Government.

Article 15 If a periodical organizer fails to go through the registration formalities within 60 days from the date of receiving the approval document from the General Administration of Press and Publication, the approval document will automatically become invalid and the registration authority will no longer accept the registration. The periodical organizer must return the relevant approval documents to the General Administration of Press and Publication.

If a periodical publishing unit fails to publish a periodical within 90 days from the date of registration, the General Administration of Press and Publication shall revoke the periodical publishing license, and the original registration administrative department of press and publication shall cancel the registration.

In case of any of the circumstances listed in the preceding paragraph due to force majeure or other justifiable reasons, the periodical publishing entity may apply to the original registered press and publication administrative department for extension.

Article 16 A periodical agency shall have the status of a legal person, obtain the status of a legal person upon approval and registration, and independently bear civil liability with all its legal person property.

The scope of periodical business as mentioned in these Provisions includes the purpose and language of running a periodical.
