Article 2 The Standing Committee of the Municipal People's Congress (hereinafter referred to as the Standing Committee of the Municipal People's Congress) exercises the power of appointment and removal; We should act in strict accordance with the law and adhere to the principle of democratic centralism. Article 3 These Measures shall apply to the staff of local state organs who are appointed, removed and approved by the Standing Committee of the Municipal People's Congress according to the law. Article 4 When the director of the Standing Committee of the Municipal People's Congress is unable to work or absent due to health reasons when the Municipal People's Congress is not in session, the Standing Committee of the Municipal People's Congress shall, on the nomination of the meeting of directors, elect one of the deputy directors to act as the director until the director recovers health or the people's Congress elects a new director. Article 5 When the Municipal People's Congress is not in session, if the mayor, the president of the Municipal Intermediate People's Court and the procurator-general of the Municipal People's Procuratorate are unable to hold their posts for some reason, they shall decide on the candidates to act as agents among the deputies upon the nomination of the meeting of directors of the Standing Committee of the Municipal People's Congress, and the decision to act as the procurator-general shall be reported to the provincial people's procuratorate and the Standing Committee of the provincial people's Congress for the record. Article 6 When the Municipal People's Congress is not in session, individual vice-chairmen and some members of the special committees of the Municipal People's Congress shall be appointed upon nomination by the meeting of directors of the Standing Committee of the Municipal People's Congress. Article 13 Where the staff of local state organs are submitted to the Standing Committee of the Municipal People's Congress for appointment or removal, the submitting organ shall submit the case of appointment or removal to the Standing Committee of the Municipal People's Congress seven days before the meeting of the Standing Committee of the Municipal People's Congress.
Submitted to the Standing Committee of the Municipal People's Congress for deliberation, the personnel appointment and removal case must be accompanied by a resume, realistic performance and written materials for the reasons for appointment and removal. The fourteenth Standing Committee of the Municipal People's Congress shall take the examination of laws, regulations and other knowledge before the appointment. The examination results will be announced at the meeting of the Standing Committee of the Municipal People's Congress. Those who fail the exam will not be hired for the time being, and those who fail the make-up exam will not be hired. Article 15 Before the Standing Committee of the Municipal People's Congress deliberates the case of personnel appointment and removal, the nominee shall introduce and explain the personnel to be appointed and removed at the meeting of the Standing Committee of the Municipal People's Congress.
Nominated and appointed individual deputy mayors and the Secretary-General, director and director of the Municipal People's Government, vice president of the Municipal Intermediate People's Court and deputy procurator-general of the Municipal People's Procuratorate shall attend the meeting before deliberation at the meeting of the Standing Committee of the Municipal People's Congress, meet with the members of the Standing Committee of the Municipal People's Congress and speak. Article 16 When the Standing Committee of the Municipal People's Congress deliberates the case of personnel appointment and dismissal, the person in charge of the organ shall attend the meeting to listen to opinions. Members of the Standing Committee of the Municipal People's Congress put forward questions, and the organ in question shall give a reply.
Article 17 After the Standing Committee of the Municipal People's Congress receives the materials reported by the people and reflecting the nomination and appointment of personnel, the reporting organ or the complainant shall make a written report or oral explanation to the meeting of the Standing Committee of the Municipal People's Congress. Article 18 Where a case of appointment and removal of personnel submitted to an organ for deliberation requires withdrawal before it is put to the vote, the deliberation of the Standing Committee of the Municipal People's Congress on the case of appointment and removal shall be terminated. Article 19 When the Standing Committee of the Municipal People's Congress decides on the appointment, removal, acceptance of resignation, by-election and recall of deputies to the people's congress at the next higher level, it shall vote by secret ballot. Voting must be approved by more than half of all members of the Standing Committee of the Municipal People's Congress. Article 21 Deputy Secretary-General of the Standing Committee of the Municipal People's Congress appointed by the Standing Committee of the Municipal People's Congress, directors and deputy directors of the office and research office, directors and deputy directors of various working committees, deputy mayors and secretaries-general of individual municipal people's governments, directors and directors of the Municipal People's Government decided to appoint, vice presidents, presidents and vice presidents of the Municipal Intermediate People's Court appointed, members and judges of the judicial committee approved to be appointed, deputy chief procurators of the Municipal People's Procuratorate, and procurators of county and district people's procuratorates.
