During the whole trial, Deng Yujiao didn't speak much, and her voice was relatively small, but her thoughts were clear.
According to the indictment read by Badong County Procuratorate and Prosecutor Yang who appeared in court for public prosecution, on the evening of May 6, 2009, Deng, director and deputy director of the Investment Promotion Office of Yesanguan Town, Badong County, and others went to the "Xiong Feng Dream City Hotel" in Yesanguan Town, Badong County after drinking. Deng, Huang and others want to go to the hot springs for a "heterosexual bath". Huang Dezhi found Deng Yujiao washing clothes in VIP5 private room, so he entered the room and asked Deng Yujiao to accompany him to take a bath. He claimed that he was not a waiter in the spa, and got rid of Huang's pull and refused his request.
Subsequently, Deng Yujiao left the VIP5 room. In the corridor, I met Tang, a waiter in KTV area, and told Tang that the guests mistakenly thought she was a waiter in spa area and entered the waiter lounge with Tang. At this time, there are three waiters, Luo Moumou, Wang Mou and Yuan Mou, watching TV in the lounge.
Huang Dezhi followed Deng Yujiao into the lounge and insulted him. Deng rushed to the lounge and learned that he refused to provide "escort bath" service. Together with Huang Dezhi, he insulted Deng Yujiao, took out a pile of money to show off, and hit Deng Yujiao in the face and shoulder.
Deng Yujiao said that if she had money, she would not accompany her. After being persuaded by the waiter Luo Moumou, he wanted to leave the lounge and was pulled back by Deng. At this time, Ruan Moumou, the foreman who heard the news, explained to Deng that Deng was not a waiter in the spa area and asked to leave the lounge.
Trying to leave again, Deng pulled him back and pushed him down on the sofa. Deng Yujiao stood up, took out a fruit knife from her bag, and hid it behind her back. Deng Dagui pushed Deng Yujiao down on the sofa again. Deng Yujiao kicked Deng Gui with her foot, pushed Deng Gui away and stood up. Deng pounced again and stabbed Deng with a fruit knife, causing injuries to his left neck, left forearm, right chest and right shoulder. Huang Dezhi stepped forward and was stabbed in the right arm by Deng Yujiao. Deng was seriously injured and died after being rescued.
Forensic identification by the Criminal Science and Technology Department of Badong County Public Security Bureau: Deng died of acute hemorrhagic shock due to the rupture of the great blood vessel in the neck and the rupture of the right lung caused by others. Huang Dezhi was slightly injured in his right arm.
The public prosecution agency also claimed that Deng Yujiao surrendered himself to the public security organ after the incident and truthfully confessed the facts of the case.
According to the indictment, during the investigation, entrusted by the public security organs, the Forensic Psychiatric Judicial Appraisal Institute of Hubei Provincial People's Hospital and the Judicial Appraisal Institute of Wuhan Psychiatric Hospital conducted psychiatric medical appraisal on Deng Yujiao, and the conclusion was: "Deng Yujiao is bipolar disorder and has partial (limited) criminal responsibility."
The public prosecution agency believes that Deng Yujiao caused one death in the process of stopping Deng's illegal infringement, and his defensive behavior obviously exceeded the necessary limit, which was excessive defense. According to Articles 2 1 and 234 of the Criminal Law, the facts of the crime are clear and the evidence is really sufficient, so he should be investigated for criminal responsibility for intentional injury. However, the punishment should be mitigated or exempted. At the same time, because Deng Yujiao is a mental patient who has not completely lost the ability to recognize or control his own behavior, he can be given a lighter or mitigated punishment according to Article 18 of the Criminal Law. If there are circumstances of surrender, the punishment may be lightened or mitigated.
According to people attending the trial, Deng Yujiao's defense lawyers Wang Shaopeng and Liu Gang pleaded not guilty. They stressed that Deng Yujiao's defensive behavior was appropriate and moderate, and did not exceed the necessary limit; Deng Yujiao's behavior also conforms to the provisions of Article 20 of the Criminal Law. She has unlimited defense rights and should not bear criminal responsibility.
After nearly an hour of court debate, the judge announced an adjournment at 10: 30 in the morning. After discussion by the collegial panel, the judge announced the verdict on 1 1 in the morning: Deng Yujiao's behavior constituted the crime of intentional injury, but it was excessive defense. Deng Yujiao limited his criminal responsibility and had the plot of surrender, so he was exempted from punishment.
The judgment basically recognized the prosecution's allegations and partially adopted the lawyer's defense opinions.
According to Caijing reporter, the No.1 court of Badong County Court can accommodate more than 50 spectators, but only eight media, including Xinhua News Agency, People's Daily, Hubei Satellite TV, Enshi TV and Changjiang Badong.com, were allowed to attend the trial. The relevant departments of Badong County rejected the application of other media to participate in the hearing on the grounds that the hearing had ended.
From 7: 00 in the morning, people began to gather at the entrance of Badong County Court. At the end of the trial, about four or five hundred people were watching outside the court. The relevant departments of Badong County specially arranged police forces at the entrance of the court and on both sides of the street to maintain order.
