The defendant was originally informed that Qin Zhong was the credit card holder of his bank, and the defendant used this card to overdraw the plaintiff's funds. The calculation date was April 30, 20 16 (the currency is the same below). After the card was overdrawn, the plaintiff asked the defendant to repay, but the defendant has not fulfilled the repayment obligation so far. The plaintiff asked the court to order the defendant to return the overdraft of 973,065,438 yuan +0.47.
In our opinion, according to the defendant's domicile information provided by the plaintiff, the address could not be delivered to the defendant through the postal department, and the plaintiff also said that it was impossible to provide other identity information of the defendant, so it was impossible to confirm the authenticity of the defendant's identity information provided by the plaintiff at the time of prosecution. Accordingly, in accordance with the provisions of Item (2) of Article 119 and Item (3) and Item (2) of Paragraph 1 of Article 154 of the Civil Procedure Law of People's Republic of China (PRC), the ruling is as follows:
The plaintiff's lawsuit against the Credit Card Center of Shanghai Pudong Development Bank Co., Ltd. was dismissed.
