Time for the Third Revision of Trademark Law: 2065438+August 30, 2003 The Decision on Amending the Trademark Law of People's Republic of China (PRC) was passed by the fourth session of the Standing Committee of the 12th National People's Congress of NPC for the third time, and will come into force on May 1 day, 2065438. Basis: Decision of NPC Standing Committee on Amending the Trademark Law of People's Republic of China (PRC).
1. Paragraph 1 and Paragraph 2 of Article 4 are merged and amended as: "If a natural person, legal person or other organization needs to obtain the exclusive right to use the trademark of its goods or services in production and business activities, it shall apply to the Trademark Office for trademark registration."
Two. Article 6 is amended as: "Goods that must use registered trademarks according to laws and administrative regulations must apply for trademark registration, and those that have not been approved for registration shall not be sold in the market."
3. One paragraph is added to Article 7 as the first paragraph: "The application for registration and the use of trademarks shall follow the principle of good faith."
4. Article 8 is amended as: "Any mark that can distinguish the commodities of natural persons, legal persons or other organizations from those of others, including words, graphics, letters, numbers, three-dimensional marks, color combinations and sounds, and the combination of the above elements, may apply for registration as a trademark."
5. Items 1 to 3 of the first paragraph of Article 10 are amended as: "(1) identical with or similar to the national name, national flag, national emblem, national anthem, military flag, military emblem, military song and medal of People's Republic of China (PRC), and identical with the name, symbol, specific place name or the name and figure of the landmark building where it is located;
(2) identical with or similar to the name, national flag, national emblem or military flag of a foreign country, except with the consent of the government of that country;
(3) identical with or similar to the name, flag, emblem, etc. Intergovernmental international organizations, except those approved by the organization or not easily misleading the public. "
Item 7 of the first paragraph is amended as: "(7) deceptive, which is easy to make the public misunderstand the quality and other characteristics of the goods or the place of origin".

Article 1 This Law is formulated in order to strengthen trademark administration, protect the exclusive right to use trademarks, urge producers and operators to ensure the quality of goods and services, safeguard the reputation of trademarks, safeguard the interests of consumers and producers and operators, and promote the development of socialist market economy.
Article 2 The Trademark Office of the State Council Administration for Industry and Commerce shall be in charge of the national trademark registration and administration. The State Council Administration for Industry and Commerce has set up a Trademark Review and Adjudication Board to handle trademark disputes.
